Amendment 0001 is issued to provide answers to questions received in writing in response to the solicitation document, and to provide changes to the document entitled “The Solicitation”.
1. Answers to questions are provided as follows:
Question 1: With regards to pages 15, 16 and 28 of the RFP, and the requirements of Factor 5 of the Technical Proposal, we are requested to address if we have submitted a price proposal subject to PLA requirements. PLA’s are not generally utilized in the Utah market and we don’t anticipate using a PLA for this project. Please advise on how we are to respond to Factor 5 of the Technical Proposal.
Answer 1: IV.K. project labor agreement (PLA) on pages 15 and 16 will only apply to proposals submitted subject to PLA, if the offeror does not submit a PLA proposal, Section IV.K. will not apply.
For Factor 5, in the offeror’s technical proposal, state whether the offeror intends to submit a PLA proposal, non-
PLA proposal or both. Offerors indicating the submission of a PLA proposal under the technical proposal will be verified at the price submission phase. Please reference Section II.C Technical Proposal on page 7 of 28 of The
Solicitation.
Question 2: Section V.A. (c)(2) on page 19 of the solicitation regarding submission of proposal states “The first page of the proposal must show…” Does this information need to be included on the cover sheet or is it acceptable to include within the cover letter?
Answer 2: It is acceptable for offerors to include information as required under Section V.A (c)(2) within a cover letter.
Question 3: Section V.A. (e)(1) on page 20 of the solicitation regarding restriction on disclosure and use of data states “Mark the title page with the following legend…” Does this information need to be included on the cover sheet or is the table of contents page acceptable?
Answer 3: It is acceptable for offerors to include information as noted under Section V.A. (e)(1) within a cover letter.
Question 4: Factor 3 submittal requirement on page 27 of the solicitation states “technical approach shall be no more than ten
(10) single-sided 8 1/2” x 11” pages, single spaced, and with a minimum 10 point font. The Government will only consider the offeror’s first five pages in response to this factor.” Does this mean that we can include 10 pages, but only the first 5 pages will be read/considered?
Answer 4: Amendment 0001 includes a correction to Factor 3. The corrected factor now reads “The offeror’s technical approach narrative shall be no more than ten (10) single-sided, 8 1/8” x 11” pages, single spaced, and with a minimum of 10 point font. The Government will only consider the offeror’s first ten pages in response to this factor.”
Question 5: Section II.A. calls for “Standard Form 24 – Bid Bond/Offer Bid Guarantee” to be submitted with the “Technical
Proposal”. Can you confirm this is correct since we are not submitting our price until the later submission? If it is correct, what are we “Guaranteeing”.
Answer 5: Yes, the offeror’s bid bond shall be provided with the offeror’s technical proposal submission.
Question 6: Was attendance on today’s virtual pre-bid meeting mandatory?
Answer 6: Though attendance to the Pre-Proposal Conference was highly encouraged, it was not mandatory.
Question 7: It appears in CLIN’s 0003-0017 you are asking us to create bids for the overall scope of work (CLIN 0003) and then various options (CLINs 0004-0017). These prices are going to be considered as a GMP line items based on 75% conceptual design. You are asking use to be a CMc and assist the GSA and design team through pre-construction services (CLIN 0001) April 2021 – April 2022. How do we provide a GMP for each CLIN 0003-0017, when design is still being determined and there are many variables that will affect each line item? You also want the CMc to be

We are capable and willing to complete all CLINs as budgets or Target Value Design line items, just not sure the purpose of asking for CLIN GMP line items. How will these CLINs be viewed once the
CMc is awarded and how will they be used to assist the design team and the GSA in design?
Answer 7: Offerors are highly encouraged to review GSAM/R Subpart 536.71 – Construction-Manager-as-Constructor
Contracting to gain an overall understanding of recent GSA policy regarding CMc contracting.
Offerors should provide a GMP for CLINs 0003-0017 based on the 75% Concept Design, which will be released on or around March 1, 2021. The GMP (which is the sum of the estimated cost of work (ECW), CMc contingency allowance (CCA), and the fee for construction work) is the ceiling price for each CLIN. During the design phase, the A-E contractor and the CMc shall collaborate on the design and constructability issues. The goal of this collaboration is to establish a final estimated cost of work (ECW) that does not exceed the original target ECW.
The Government intends to negotiate the final ECW between the 75% Construction Documents and the 100%
Construction Documents. The Shared Savings Incentive is the shared portion (30%) of the difference between the final GMP and the final cost of performance.
In accordance with GSAR/M Subpart 536.71 – Construction-Manager-as-Constructor Contracting, for purposes of evaluation, the total evaluated price shall include the firm-fixed-price for design phase services, the construction work GMP option(s), and any other fixed-price line items. Considering the design documents will be at a 75%
Concept Design at the time of the price proposal submission, the Government is requesting a GMP for each optional construction CLIN rather than a firm-fixed-price proposal for each optional construction CLIN.
The GMP optional construction CLINs will be established at contract award. The GMP for each optional construction CLIN is the ceiling price that is the maximum that may be paid to the contractor, except for any adjustment under the contract clauses providing for an equitable adjustment or other revision of the contract price under stated circumstances.
The GSA intends to exercise the “primary” GMP option (CLIN 0003) if the final ECW, CCA, and fee for the construction work are not greater than the GMP as established at contract award or as adjusted in accordance with
FAR Part 43. The “non-primary” GMP options (CLINs 0004-0017) may be exercised if funds are available and if the final ECW, CCA, and fee for the construction work are not greater that the GMP as established at contract award or as adjusted in accordance with FAR Part 43.
Question 8: Will the Pre-Proposal Conference presentation slides be made available for our use?
Answer 8: A copy of the Pre-Proposal Conference slides will be provided to Offerors who request the slides and who have returned a properly completed SBU form; however, offerors are advised that the slides are NOT incorporated into the solicitation and/or any resulting contract. Nothing said and/or provided at the Pre-Proposal Conference is binding. The solicitation and attachments are the governing documents for this acquisition. Any changes to the solicitation will be made via a formal amendment. If a statement was made during the Pre-Proposal Conference that appears inconsistent with the solicitation documents, offerors should submit their proposal based on the solicitation and its documents.
Question 9: In order to get more accurate pricing for trades such as the MEP trades we will need to involve our subcontractors.
The subcontractors will want more commitment from us in order for them to really dive into the details and give good information on constructability and costs. In the pricing proposal, is the cost of work going to be evaluated for selection and the GMP set from this proposal, or is the intent just to verify the budget and the GMP will be set at a later date after the CMc is on board?
Answer 9: Offerors are highly encouraged to review GSAM/R Subpart 536.71 – Construction-Manager-as-Constructor
Contracting to gain an overall understanding of recent GSA policy regarding CMc contracting.
The Government will evaluate offers for award purposes by adding the total price for all options (CLINs 0003-
0017) to the total price for the basic requirement (CLIN 0001).
The GMP will be established at contract award. The GMP is the ceiling price that is the maximum that may be paid to the contractor, except for any adjustment under the contract clauses providing for an equitable adjustment or other revision of the contract price under stated circumstances.
