25. Specification Section – 283111 – Voice Fire Alarm, Part 1 – Item 1.4 – System Design Description: . “The contractor shall furnish and install a complete networked nodal, "intelligent", fire alarm voice evacuation and communication system as specified herein and indicated on the drawings.”
Question – It is our understanding that the Solicitation is a Request for Proposal (RFP) design-bid-build project with the Government’s AE being responsible for the design portion (providing a full and complete set of Specifications and Plans with all devices shown) and the successful offeror being responsible for bidding and building the project based on the Specifications and Device quantities per the Plans provided by the Government’s AE. Put another way, the successful offeror will not be required to perform any design-build services as part of the contract. Is this correct?
This is not correct. Contractor is required to adhere to all of the bid documents and the referenced codes. Contractor is responsible for shop drawings.
26 Part 1 – Item 1.2 – Summary – Sections A through H Question – are the device locations as shown on the plans in full compliance with all of the above referenced Sections (A through H)?
It is the contractor’s responsibility to provide shop drawings in compliance with the bid drawings and specifications.
27. Part 1 – Item 1.5 – Submittals – Section B:. “Provide product submittal data with fire alarm installer's name, manufacturer, project name,NICET Level IV certification, and the installer’s State fire alarm license. The State fire alarm license shall be issued from the State in which the project resides.
Question – does this federal project require a State of New Mexico fire alarm license for the installing contractor/distributor based upon the United States Supreme Court ruling provided?
“To the extent that the State of Oklahoma is requiring licensure of contractors to work on this Federal project, such a requirement has been held to be unenforceable. From as far back as at least 1956, the United States Supreme Court has held that a state may not enforce licensing requirements which, though valid in the absence of federal regulation, give "the State's licensing board a virtual power of review over the federal determination" that a person or agency is qualified and entitled to perform certain functions, or which impose upon the performance of activity sanctioned by federal license additional conditions not contemplated by Congress. "No State law can hinder or obstruct the free use of a license granted under an act of Congress."
See:
Sperry v. Florida, 373 U.S. 379, 385, 83 S. Ct. 1322 (1963) (relying in part on Leslie Miller, Inc. v. Arkansas, 352 U.S. 187, 77 S. Ct. 257 (1956)” “In Leslie Miller, the United States Supreme Court held: Mere enumeration of the similar grounds for licensing under the state statute and for finding "responsibility" under the federal statute and regulations is sufficient to indicate conflict between this license requirement which Arkansas places on a federal contractor and the action which Congress and the Department of Defense have taken to ensure the reliability of persons and companies contracting with the Federal Government. Subjecting a federal contractor to the Arkansas contractor license requirements would give the State's licensing board a virtual power of review over the federal determination of "responsibility" and would thus frustrate the expressed federal policy of selecting the lowest responsible bidder. Leslie Miller, Inc., at 352 U.S. 187, 189-190. (Emphasis added)”.
In short, the State of Oklahoma cannot enforce licensure laws for a contractor to perform work on a federal project. The decision to use a contractor is in the sole discretion of the governmental agency seeking the contract and the decision as to a “responsive and responsible” cannot be usurped by a conflicting state requirement. The Supremacy Clause governs, and any contractor should be free to bid this project without requirement of a state license. I respectively ask that this requirement be removed based upon this federal court ruling.
After consulting with the GSA Regional Counsel's Office, I have determined that the cited cases are not applicable to our circumstances. In the case, the Court stated that the Commissioner of Patents may implement regulations and provide federal rights to the people pertaining to practices at the Patent Office regardless of how the state practice is conducted. In this procurement, GSA is not conferring any additional rights or implementing new regulations. GSA is conducting a procurement and has included particular state licensing requirements in the evaluation because it was determined that those requirements are relevant and beneficial for this requirement and would be helpful in evaluating the technical capabilities of offerors.
28. Part 1 – Item 1.8 – Functional Description of System – Section A-1-b – AND – Section 2.4 - Printer: “Display the status change messages on the system printer.”
Question – a system printer is not shown on the plans or alarm matrix. Does this project require a system printer? Refer to 2.4 of the specification.
29. Part 1 – Item 1.8 – Functional Description of System – Section A-1-f: “Release all electronically locked egress doors.”
Question – will the owner provide the quantity of locked egress door locations that are required to be released? Contractor is responsible for field verifying if any other doors have magnetic locks. Access was provided to all areas during the site visit.
30. Part 1 – Item 1.8 – Functional Description of System – Section A-1-g: “Release all electronically locked stairwell exit doors.”
Question - will the owner provide the quantity of locked stairwell exit door locations that are required to be released? Contractor is responsible for field verifying if any other doors have magnetic locks. Access was provided to all areas during the site visit.
31. Part 1 – Item 2.2 – Fire Command Room – Section A: “Provide a main fire alarm control and voice communication panel in the designated fire command room.”
Question – is the new fire alarm control panel (shown on the first floor) located in the designated fire command room? Wherever the fire alarm control panel is located by the GSA FPE will be the designated fire command room.
Question - If not, will the contractor be required to furnish an additional fire control panel (not shown on the plans) to be installed in the designated fire command room? No.
32. Part 1 – Item 2.16 – Sprinkler Waterflow Switch – Section A – AND – Section 2.17 – Valve Supervisory: “Provide connection to all waterflow switches with an individual addressable monitor module.”
Question – are all existing waterflow switches shown on the plans? If not, will the owner provide quantities prior to the bid? Soils lab and Indoor parking garage are the only locations with a sprinkler system. Contractor will need to field verify when constructing shop drawings.
“Provide connection to all valve supervisory switches with individual addressable monitor module”
Question – are all existing sprinkler valve supervisory switches shown on the plans? If not, will the owner provide quantities prior to the bid?
Soils lab and Indoor parking garage are the only locations with a sprinkler system. The contractor is responsible for field verifying quantities and when constructing shop drawings.
33. Part 1 – Item 3.1 – Installation – Section A-7: “Provide shielded wiring for all Notification & SLC circuits installed in same conduit as other fire alarm system wiring.”
Question – if the fire alarm manufacturer does not require shielded wiring, will the owner require shielded wire? (shielded wire can be a source for ground faults) Yes
34. Part 1 – Item 3.4 – Test and Reports – Section A: “This technician shall have a current fire alarm license issued by the State in which the project resides”
Question - does this federal project require a State of New Mexico fire alarm license for the NICET Level III technician who will perform final control panel connections and supervise testing of the system? “To the extent that the State of Oklahoma is requiring licensure of contractors to work on this Federal project, such a requirement has been held to be unenforceable. From as far back as at least 1956, the United States Supreme Court has held that a state may not enforce licensing requirements which, though valid in the absence of federal regulation, give "the State's licensing board a virtual power of review over the federal determination" that a person or agency is qualified and entitled to perform certain functions, or which impose upon the performance of activity sanctioned by federal license additional conditions not contemplated by Congress. GSA is conducting a procurement and has included particular state licensing requirements in the evaluation because it was determined that those requirements are relevant and beneficial for this requirement and would be helpful in evaluating the technical capabilities of offerors.
35. Part 1 – Item 3.5 – Existing Fire Alarm System – Section B: “No portion of the existing building fire alarm system shall be permanently taken out of service or demolished until the new fire alarm system has been installed, tested, and accepted by the GSA Fire Protection Engineer.
Question – sheet note #15 on plan sheet FA-1 states “the manual pull station shall be installed in same location as the existing manual pull station” – will the owner allow the contractor to provide a temporary install of the new pull stations using the existing pull station vertical conduit? Only where the conduit is concealed in the wall
36. Part 1 – Item 3.1 – Installation – Section A-9: “All wiring for SLC signaling circuits shall be of the low capacitance type to reduce waveform distortion.”
Question – Prior to the bid, will the owner specify the acceptable rating for the low capacitance cable in pF/FT? Our standard 14/2 FPLP solid cable is rated at 26 pF/FT. NFPA 72 and specifications will apply.
37. Please provide the most recent Asbestos Containing Material (ACM) report for this facility.
a. Is the contractor responsible for retaining the services of an ACM abatement service where cutting or drilling of ACM is needed to complete the scope of work? See the asbestos report submitted with the solicitation.
38. Please confirm the contractor’s work hours/days for this facility. Work can be completed during normal business hours as long as there is not a lot of noise and disruption to the tenants and no bad smells. Disruption, noise, or smells become a problem to tenants, the project will be moved to after hours and weekend work. Weekend work is authorized in addition to normal business hours as well if needed but must be approved by GSA PM and Building Manager and CO prior before starting weekend work.
Building Location Hours: Every attempt must be made to ensure normal building operations are not interrupted. Operating hours for this facility are from 7:00am to 5:00pm. Notify Project Manager and Building Manager of any work that may cause disruption during the day. If work after hours needs to be accomplished the Project Manager must be notified a minimum of 7 days in advance.
39 Will type EMT conduit be required in exposed ceilings and mechanical spaces or, is flexible cable acceptable? No conduit shall be exposed below a ceiling.Conduit is intended to be concealed above the ceiling. Where the ceiling is a hard lid mc cable can be utilized and run by lifting out light fixtures. Where spaces are exposed to structure EMT conduit is required.
40. Can a 20’ contractor storage container be located on-site for material storage? Yes on the 2nd upper deck parking lot. Location will be discussed after the award.
41. Where existing FA devices are removed, is a blank cover plate acceptable as a final finish or, does the existing abandoned opening require drywall patching and painting?
A blank cover plate that covers the entire footprint of the old device is required.
4 2. Will exposed conduits require painting to match existing surfaces? If yes, is color matching acceptable or will the Government provide paint colors?
Conduit is intended to be concealed above the ceiling. Where the ceiling is a hard lid mc cable can be utilized and run by lifting out light fixtures.
4 3. Is the use of a scissor lift for high ceiling work in the entryway acceptable? If yes, please describe the floor protection measures required by the Government. There is no way for a scissor lift to get into the entryway due to the stairs at the front and the elevator would not hold a lift. Due to the historic nature of the entryway and not being able to find matching marble, a scissor lift may be heavy for the material as well. Rolling scaffolding would be a better option with Ram Board on the floor.
4 4. Can a 20-yard trash dumpster be located onsite? Yes on the 2nd upper deck parking lot.
Location will be discussed after the award.
45. Will the GSA provide CAD drawing for the plans we received in PDF format?
Yes, the available CAD drawings will be provided after award. Files cannot be uploaded in SAM.gov.
46. Will the GSA provide Mechanical plans? None available
47. Will the GSA provide as-built drawings of the existing system? None available
4 8. The specifications call for a NICET 3 Engineer be on site throughout the project including conduit install and wire pull. Since Conduit and Wire Pull are a low voltage electrical function / tasks and do not require the expertise of a NICET3 engineer, will the Government allow the Contractor to have a NICET3 Engineer on-site at the time of devise programming, installation , turn up and testing of the devices and panels? Not on site for the full duration of the project.
Must be on site per the specifications including conduit installation and wire installation.
49. There is no node shown in the Soils Building and Laboratory. Will it require its own node?
Yes
50. What is the occupancy classification for this building? Business
5 1. Can you please provide room labels for the Soils Building and Laboratory? There are original PDF drawings with room numbers on them that can be provided after the award.
5 2. Does the existing FA system currently shut down the A/H units. If so, can we use the same control point to shut them down? If the answer is no, can we install a shunt type breaker in the electrical panel to shut them down? Shunt breaker is not allowed. Existing shutdown method is unknown.
53. Can you kindly post the site walk attendees list? Sent with Amendment 2
54. Can we get a bid extension due to the time restraints between RFI answers bids current due date? Yes, proposal due date is extended
55. The Fire Alarm specification Part 2 – Products, 2.1 Manufacturers, lists Siemens Building Technologies, Cerberous Pro or approved equal. Can you confirm that the Siemens Desigo Fire Modular will be acceptable for this bid? A data sheet has been provided for your reference.
See answer to 67.
56. Refer to SF 1442. In addition to pages 1 and 2 of the SF 1442, should we fill out and submit page 3 of the SF 1442, Supplies or Services, as there are blank lines in column UNIT PRICE (e) and AMOUNT (f)? Yes. Please use page 3 to state the total proposed price. Be sure to demonstrate your firm’s proposed price using the provided Bid Schedule, and provide pricing detail to demonstrate build-up of all costs by using a Detail Page tab for each major Division.
57. Refer to Factor 1 – Experience on Similar Projects. What percent complete constitutes “substantially complete” for a reference project? A project at or beyond 90% complete would be considered “substantially complete”. This means that the majority of the project has been completed and the contractor is working on punch list items.
58. Refer to Factor 1 – Experience on Similar Projects. The requirements state that a project must be performed in an occupied and functioning office building in Factor 1, but Factor 3 allows PPQs to be submitted for a multi-story occupied building as defined under Scope. Can projects under Factor 1 be for a multi-story occupied building or must they only be for an office building?
Factor 1 has been revised to remove the restriction of a functioning office building. The revision now states that the project must have been performed in “an occupied multi-story building.” The language for a “functioning office building” has been removed. See revised Technical Evaluation Factors which will be sent in Amendment 2.
59. Refer Factor 3 – Past Performance. Since PPQs are to be sent by the client to the Government, can we include a table listing the three projects, their respective clients, and the client’s POC information for the Government should the Government have to reach out to the client? We understand no more than 2 attempts will be made, and it is the offeror’s responsibility to ensure timely delivery of PPQs by the client(s) to the Government. The 2 attempts referenced in this section apply to the contact made for the purposes of verifying information on the Questionnaire. The Government will not contact clients to request Questionnaires if they have not been received. It is the sole responsibility of the Offeror to follow up with each client to encourage their timely submission of the completed, signed Questionnaire. Questionnaires received by the Government later than the time and date specified in the Solicitation for receipt of proposals will not be accepted or evaluated. A table of projects is not necessary since the client’s information will be on the PPQ.
60. Refer to Factor 3 – Past Performance. Should the PPQs requested from clients for Factor 3 be for the same projects listed in Factor 1? The projects listed in Factor 1 are not required to be the same projects referenced in Factor 3, the Questionnaire. They can be the same projects, but they do not have to be the same projects. Each factor is evaluated separately.
61. Refer to Factor 3 – Past Performance. Under the definition of Similar, a project must cost “greater than $250,000,” but this contradicts the statement under Magnitude defining acceptable projects as those with a “minimum value of $250,000.” Can PPQs be requested for projects in Factor 3 that are greater than OR EQUAL TO $250,000? Please resolve the discrepancy.
These sections in Factor 3 have been revised to clarify that it is acceptable for projects to be equal to or greater than a value of $250,000.00. See revised Evaluation Factors in Amendment 2.
62. Refer to Factor 3 – Past Performance. Under Acceptable, the directions state that offerors must submit the PPQ “in the version in the solicitation” and are advised “a CPARS report should not be provided by the contractor in lieu of a PPQ.” Any CPARS received will be deemed unacceptable by the Government. However, the next bullet states a project submitted on a PPQ cannot already have a completed Final CPAR as described in 1.b. below. See our two questions below:
o Please address this direct contradiction by advising whether or not we can submit PPQs for projects that also have Final CPARs and if we cannot, please advise on whether or not the Government will look up a reference project’s final CPARs in the system as a means of evaluating our past performance for Factor 3 since we have been instructed not to send in CPARs of any kind.
o What text is supposed to appear in “1.b. below”? There was no 1.b to reference in the original RFP or Amendment 1’s revised text for Factor 3. See revised Technical Evaluation Factors in Amendment 2. The sentence that reads “a project submitted on a Questionnaire cannot already have a completed final Contractor Performance Assessment Report, as described in 1.b. below” has been removed. CPARs should not be sent by the offeror. However, a project submitted on a Questionnaire can already have a completed final CPARs.
63. We will be submitting a substitution request for a Simplex Fire Alarm system, and data sheets for an approved equal.
See answer to 67.
64. Will the contractor who is awarded the FA project at the Gallup Federal Building be responsible for confirming with an environmental consulting firm if an ACM or abatement plan will be necessary? Based upon the asbestos study included in amendment 2. Based on the asbestos study no areas of work should be hot. If the contractor does encounter asbestos during construction, work will be stopped and the situation will be assessed at that time.
65. Is this project to be completed / constructed during nights and weekends? Work can be completed during normal business hours as long as there is not a lot of noise and disruption to the tenants and no bad smells. Disruption, noise, or smells become a problem to tenants, the project will be moved to after hours and weekend work. Weekend work is authorized in addition to normal business hours as well if needed but must be approved by GSA PM and Building Manager and CO prior before starting weekend work.
66. Can we submit this electronically (via email)? Yes, it is requested to be emailed.
67. As in Part 2 - Products, 2.1 Manufacturers: What are the qualifications of an “approved equal?”
Approved equal: Equipment with all the same functionality, quality controls and serviceability will be considered equal.
Functionality: Equivalent features as the three models specified and meeting all specification requirements.
Quality Controls: Specification Section 1.6 Quality Assurance states that the installation shall be accomplished by a certified distributor of the product submitted. A distributor is defined as the following:
The manufacturer must limit the purchase, installation and repair of their fire alarm system strictly through certified (authorized) distributorships. The manufacturer shall provide factory training and tech support to their licensed Authorized Distributors for the proper use of their equipment. Certified (authorized) distributorships are granted to independent Fire Alarm companies.
Serviceability: Manufacturers must license a minimum of three independent Fire Alarm installation contractors as certified (authorized) distributors of their brand of fire alarm products within 200 miles of the project site.
68. The bid indicates that the Project Manager needs to have an Architectural or Engineering degree. Are there other qualifications (i.e. 10 years experience) that would qualify if they do not have a college degree? If the PM does not have an Architectural or Engineering Degree, a Construction Management Degree or at least 5 years of fire alarm installation experience with at least 5 years PM experience could be substituted.
