Project Title: PCH MEP Renovation Building: The United States Custom House Location: Philadelphia, PA Building Number: PA0144ZZ

Contract Number: TBD

GSA Project Manager: Brian Muller Project Executive: Ed Myers GSA Contracting Officer: Stephen Khori GSA Project Engineer : Evan Shillington

1.2 Project Description

The building is suffering from recurrent flooding caused by the aged domestic water piping system and significant temperature and indoor air quality issues caused by the insufficient and outdated HVAC system. Electrical system components will be replaced to support the HVAC systems. Mitigation of hazardous materials and associated sprinkler modifications will be accomplished in disturbed areas as part of the project.

To repair the building’s domestic water system, the piping will need to be exposed, abated of asbestos, inspected, and repaired. Concurrently, the building’s induction unit system will be removed, abated of asbestos, and upgraded to a four-pipe fan coil system.

Due to the invasive nature of this work and the presence of hazardous materials, the majority of building tenants will be moved into internal swing space.

The less invasive aspects of the project include repairing the storm water system, replacing the building automation system, replacing the air handling units, partial conversion to variable air volume serving interior zones, replacing the heating and chilled water systems, and replacing the boilers.

As noted above, this renovation is in an occupied building so the proposed project includes allowances for internal swing space. The project minimizes tenant impact by using internal swing space and hazardous materials enclosures, as well as by completing the scope items together.

1.3 Existing Building and Site

The United States Custom House, completed in 1934, was designed by Ritter and Shay, one of the principal early 20th century architectural firms in Philadelphia.

The distinctive skyscraper, design with Art Modern and Art Deco detailing, provided Philadelphia, the nation’s largest freshwater port, with a new building for this port of entry.

The seventeen-story tower blends into the neighboring three and four-story historic streetscape with a square, three-story, limestone clad base from which rises a brick-clad tower in cruciform plan with a central vertical five-bay limestone face on each facade. These upper stories step back again in four sections towards a crowning illuminated terra cotta lantern reminiscent of a lighthouse. On top of this modern skyscraper, the architects placed a form that symbolized the lighthouse, a beacon to the port of Philadelphia.

The building's domestic water piping has experienced multiple failures over the last five years. As a result, the building has experienced several large scale floods that have caused millions of dollars of widespread damage to tenant improvements, the building shell and tenant agency personal property. The building is a historical landmark containing multiple historic architectural and art installations that could potentially be irreparably damaged if another water release event was to occur.

The most recent flood was in August 2018 and the threat of another flood is imminent. The flood risks have significantly jeopardized the marketability of the asset. Tenant agencies have begun to vacate the building. The building's HVAC system is almost 20 years past it's useful life and is a high risk for failure. The Region has invested in makeshift solutions to combat the issues in the short term but the deficiencies need a longer term resolution. The Region submitted a design request for a full modernization project in the 2017 cycle but it was determined that the project was too costly to be feasible. A revised feasibility study was completed in 2017 that addressed the feasibility of a plumbing and HVAC project.

1.4 Preliminary Program

The Preliminary Program is provided as a general description of the project to begin initial design studies of the project. A program of requirements shall be finalized as part of the design process and is the responsibility of the A/E.

This Statement of Work (SOW) is for architectural and engineering (A/E) services.

The General Services Administration (GSA) intends to design and modernize the existing Philadelphia Custom House (PCH) building. The planned project delivery is Construction Manager as Contractor (CMc).

The PCH building is suffering from recurrent flooding caused by the aged domestic water piping system and significant temperature and indoor air quality issues caused by the insufficient and outdated HVAC system.

Major Scope The main purpose of the project is a modernization of the HVAC system, major plumbing repair and upgrades, and electrical/fire safety/BAS upgrades to accommodate these systems.

HVAC

More details on the exact requirements for the HVAC upgrade can be found in Option B of the study. Option B will be used as the base program for this project.

The Major scope items associated with the HVAC modernization are as follows:

DDC Controls Upgrade

AHU Replacement and associated ductwork distribution.

Condenser Water Piping Replacement

New Hot Water Pumps and Piping

Chilled Water Piping Replacement

Perimeter HVAC System Conversion to 4 pipe fan coil units

VAV Conversion for interior zones

Chiller and Chilled Water Economizer HX

Addressed Aged Boiler Breeching

Steam and Condensate Distribution Replacement

Ventilation and Exhaust Fan Replacement

Stem Radiator Replacement with Hydronic Heating

Plumbing More details on the exact requirements for the plumbing upgrade can be found in Option B of the study. Option B will be used as the base program for this project.

The major scope items associated with the Plumbing modernization are as follows:

Installation of ball valves in the main risers

Potential abandonment or recommissioning of used/unused risers as recommended in the study

Removal of iron plugs and installation of copper caps.

Storm Water system lining

Storm Water system replacement

Lateral plumbing piping replacement

Challenges

1. Asbestos The United States Custom House is on the historic registry and was constructed in 1932-1934. There have been multiple large scale abatement projects relating to asbestos in common and accessible areas of the facility. Asbestos is known to be on pipe insulation behind walls and in mastic for floor tiles. To repair the building's domestic water system, the piping will need to be exposed, abated of asbestos, inspected, and repaired. Concurrently, the building's induction unit system will be removed, abated of asbestos, and upgraded to a four-pipe fan coil system.

Asbestos abatement will be a large part of this project.

2. Phasing This type of construction is highly disturbing to a tenant and will need to be done in unoccupied space. Phasing tenants in and out of swing space in order to free up floors for the construction to be done will be an important part of this project.

3. Historic Preservation The Philadelphia Custom House is listed on the National Register of Historic Places. The first three floors of the building contain highly decorative public corridors and a rotunda that must be protected during the construction process.

This rotunda contains 31 George Harding murals that must be protected during construction. Any water damage could potentially destroy these invaluable works.

The less invasive aspects of the project include repairing the storm water system, replacing the building automation system, replacing the air handling units, partial conversion to variable air volume serving interior zones, replacing the heating and chilled water systems, and replacing the boilers.

1.5 Construction Procurement Method

This project will be procured under Construction Manager as contractor (CMc) by a Best Value Source Selection process from construction firms responding to an advertisement on FedBizOps. The project goal is to award the CMc after receipt of the concept submission. The government intends to award the guaranteed maximum price (GMP) contract after receiving the 75% construction documents.

1.6 Architect/Engineer Project Management Responsibilities

1.6.1 Authorities

The GSA Contracting Officer is the sole entity with the authority to modify the scope of this contract. The A/E is prohibited from initiating any changes that may result in an increase in the contract amount or contract time, or would result in any delay to the work, without expressed written documentation from the GSA Contracting Officer.

1.6.2 Coordination

In the best interest of the project, GSA expects the A/E to work in collaboration with the entire Project Delivery Team. The A/E shall provide GSA with sound management advice regarding all services to be performed on this project under the SOW. The project goal shall be to achieve the best quality and value while controlling schedule and budget. 1.13 Energy and Sustainability

The Contractor shall use an integrated design process to meet or exceed the performance requirements for energy and sustainability and provide a design that will achieve the goals for the construction of a high-performing green building as set forth in the contract documents. In addition, the Contractor shall provide a design that minimizes the amount of energy needed to operate the building.

The primary performance requirements relating to energy and sustainability are found in Section 5.4 “Whole Building Energy Performance Requirements” of the P100, which provides, in pertinent part, as follows: (1) the design shall comply with the Energy Policy Act (EPAct) of 2005 (EISA 2007) requirement that the predicted energy performance meets or exceeds 30% energy consumption http://www.gsa.gov/bim savings as compared to ASHRAE 90.1; (2) the Contractor shall follow the ASHRAE 90.1 Appendix G- Building Performance Rating Method, which provides specific guidance on the rules and procedures to simulate building energy use;

and, (3) the design shall meet 65% fossil fuel-generated energy consumption savings as compared to ASHRAE 90.1 and Appendix G thereto (note that this is different from the energy cost savings required for LEED credits).

The design shall meet or exceed fossil fuel reduction requirements mandated by Section 433 of the Energy Independence and Security Act of 2007 (EISA).

If the Contractor is unable to achieve the mandate contained in EPAct, the Contractor shall provide the CO with: (1) documentation to establish the highest level of estimated energy savings for the proposed design; and (2) documentation to establish why EPAct cannot be satisfied.

1.14 Guiding Principles Checklist (GPC)

In February 2016, and in accordance with Executive Order 13696 (Planning for Federal Sustainability in the Next Decade, March 19, 2015), the Council on Environmental Quality issued the Guiding Principles for Sustainable Federal Buildings and Associated Instructions (the Guiding Principles). Each agency subject to EO 13696 (including GSA) is responsible for evaluating which of its buildings comply with the Guiding Principles, and ensuring that sufficient evidence and documentation is readily available to demonstrate compliance with the Guiding Principles for those buildings. (As set forth below, GSA uses a Guiding Principles Checklist (see Section IV APPENDIX, subsection LL) within the gBUILD database to track compliance.)

GSA developed its Guiding Principles Checklist (composed of Guiding Principles Criteria, or GPCs) to track and report its new construction and major modernization projects’ compliance with the Guiding Principles. The GPCs are only required for these two project types, which either construct or significantly expand structures, or replace nearly all major building systems. GSA makes no warranties or guarantees regarding the Checklist and, thus, the Contractor should not rely on or use the Checklist as a source for determining mandatory design requirements. That stated, in developing the design submissions, the Contractor should refer to the Checklist and be prepared to articulate, via GSA’s web-based gBUILD database described below, how GPC requirements are being met by the project’s design and construction, and why certain requirements, if any, cannot be met (e.g., because not applicable or not life-cycle-cost effective (as those terms as described in the Guiding Principles)).

1.15 Energy Modeling and Performance

The Contractor shall develop an energy model to predict the annual energy consumption of the building. (Note that the energy model is different from the energy cost savings required for LEED credits.) The contractor may utilize the project BIM to serve as the basis of the energy model. See BIM Guide 05. The energy model shall integrate energy-related information and criteria from other sections of the SOW that may affect energy savings. In developing the energy model, the following definitions, assumptions, and conditions shall apply:

Baseline Building: The baseline building is based on the minimum requirements set forth by ASHRAE / IESNA Standard 90.1-2013 and Appendix G thereto. (Note that this is not the Energy Cost Budget Method used by ASHRAE for standard code compliance calculations.)

Proposed Building: Space designed by the Contractor.

Simulations: The simulations shall be modeled with an 8,760 hour program in accordance with ASHRAE 90.1-2013, Section IV APPENDIX, subsection G.

Updates: The Contractor shall calculate the annual energy usage and Energy Use Intensity, in kBTU/GSF/year, at each phase of the design process from concept submittal through final construction documents.

As-Built Conditions: During the construction phase, the Contractor shall update the energy model to as-built conditions.

Ownership: The Government’s rights to the model are set forth in the applicable FAR/GSAR clauses incorporated into the contract.

1.16 GSA High Performance Building Tracking (gBUILD)

GSA uses an online system called the Green Building Upgrade Information Lifecycle Database (gBUILD) to centrally track and report sustainability information for its design and construction program. One of the main purposes of the gBUILD system is to track, document, and otherwise demonstrate compliance with the Guiding Principles (E.O. 13693).

The Contractor shall input information into gBUILD at the following four milestones: (1) Concept Design; (2) 100% Design Development, (3) 90% Construction Documents; and (4) Substantial Completion. Required information for projects includes: scope/technology details; anticipated energy and water performance; and total/diverted tons of construction and demolition waste at substantial completion. For new construction and major modernization projects, the Contractor shall also input information into gBUILD to record compliance with the Guiding Principles Checklist described above. The Contractor shall provide the GSA’s gBUILD team (gbuild@gsa.gov) with the name and contact information for the main gBUILD point of contact and any additional employees who will input project-specific information into gBUILD. In addition to inputting information, the Contractor shall work to collaboratively respond to data calls issued by GSA central office ODC within 60 days.

GSA (gbuild@gsa.gov) will provide the Contractor with system instructions, training, support, and access. The Contractor’s gBUILD access is subject to satisfying HPSD-12 security requirements

1.17 Personnel Security Requirements

In the performance of work required under this contract, all A/E personnel must present proper identification to gain access to occupied building areas housing federal operations. A/E personnel means A/E employees and A/E subcontractor employees at all tiers. This requirement does not apply to unoccupied building areas under construction, provided that access to any adjacent or surrounding occupied building areas housing federal operations is separately controlled.

A/E personnel requiring routine access to occupied building areas housing federal operations, over a period of 30 days or more, shall undergo background investigations (National Agency Check with Written Inquiries (NACI) or equivalent or higher) conducted by the United States Government, and will be issued Government-wide standard secure and reliable forms of identification issued by the Federal Government (i.e., federal personal identity verification (PIV) credentials) as required under Homeland Security Presidential Directive-12 (HSPD-12). Credentialed A/E personnel must wear their PIV credential cards visibly above the waist at all times while in occupied building areas housing federal operations.

All other A/E personnel requiring intermittent access to occupied building areas housing federal operations will be issued visitor badges upon entry, must wear their visitor badges visibly above the waist, and must surrender their visitor badges upon exit.

All non-PIV credentialed A/E personnel must be escorted at all times (including after hours) while in occupied building areas housing federal operations. The escort must be a PIV credentialed individual who has been found suitable after completion of the required background investigation

NOTE: It is the A/E’s responsibility to obtain security clearances for employees working in a Federal Building. GSA is not responsible for work delays or additional costs associated with the A/E’s failure to obtain clearances for their employees. A submission deadline will not be extended due to the A/E’s failure to obtain security clearance(s)

1.17.1 Law Enforcement Checks and Background Investigations

The GSA will designate a Department of Homeland Security (DHS) Federal Protective Service (FPS) representative to coordinate the required law enforcement checks and background investigations. The A/E shall justify the need for and obtain the GSA approval of all requests for A/E personnel law enforcement checks or background investigations, before initiating further action.

For each A/E employee (including A/E subcontractor employees) required to undergo a law enforcement check, the A/E shall provide a legible ten-print fingerprint submission.

For each A/E employee (including A/E subcontractor employees) required to undergo a background investigation, the A/E shall provide the following documents:

A completed Questionnaire for Non-Sensitive Positions (Standard Form 85P) A legible ten-print fingerprint submission A Declaration for Federal Employment (Optional Form 306) with items 1, 2, 8 through 13, 16, and 17a completed (or a document containing the same information)

The required forms may be downloaded from the GSA website at:

www.gsa.gov/forms .

The GSA will provide fingerprinting at no cost for A/E personnel requiring law enforcement checks or background investigations. Alternatively, fingerprinting may be obtained from local or state law enforcement agencies.

Any fees charged by these agencies shall be non-reimbursable.

The A/E shall provide the documents required above to the GSA or directly to the designated DHS FPS representative, at least 30 days before the subject individuals will require daily/weekly access to building areas housing federal operations. The documents required for each applicant shall be provided in a separate sealed and secure envelope.

A/E personnel for whom background investigations have been requested must appear at least once in person before the designated DHS FPS representative and present two acceptable original identity source documents. One of these documents must be a valid (unexpired) picture ID issued by a state government or the federal Government.

A/E personnel requiring daily/weekly access to building areas housing federal operations may be in possession of previously issued valid federal PIV credentials. For each such A/E employee (including A/E subcontractor employees), the A/E shall provide evidence verifying that the employee: (1) possesses a valid (unexpired) federal PIV credential; and two (2) has undergone the required suitability or national security level investigation comparable to or higher than that required on this contract. If both of these conditions cannot be met, a new background investigation shall be required.

1.17.2 Credentialing and Return of Credentials

A federal PIV credential may be issued after an initial background check has been completed. If the ensuing further background investigation results in a preliminary finding that the subject individual is unsuitable to occupy a position at the designated sensitivity level, the PIV credential may be revoked and the subject individual denied access to building areas housing federal operations pending completion of any adjudication and/or appeal process or final determination. Unsuitable individuals may be escorted out of building areas housing federal operations by DHS FPS, Immigration and Customs http://www.gsa.gov/forms

Enforcement (ICE), or other law enforcement entities, if necessary to protect Government employees, property, and interests.

To receive an approved PIV credential, the applicant must appear in person before the designated DHS FPS representative and again present an original valid (unexpired) picture ID issued by a state government or the federal Government. Additionally, the applicant must sign an affidavit attesting to acceptance of the PIV credential and related responsibilities.

The A/E immediately shall deliver to the GSA each federal PIV credential obtained for performance of this contract, under whichever of the following conditions occurs earliest:

Receipt of notification from GSA that the PIV credential has been revoked Determination that the subject individual no longer requires daily/weekly access to building areas housing federal operations Release of the subject individual from A/E or A/E subcontractor employment Completion of subcontract work (for PIV credentials issued to A/E subcontractor employees) Expiration of this contract

In the event that an A/E PIV credential is damaged, lost, misplaced or stolen, the A/E immediately shall notify the GSA and, if needed, request a replacement. Damaged PIV credentials shall be returned to the GSA.

1.17.3 Subcontractors

The A/E shall incorporate provisions in all applicable A/E subcontracts as necessary to ensure compliance with all requirements provided in this A/E Personnel Security Requirements section.
