Amendment 0004--Construction Manager as Constructor (CMc) for the Alexander Hamilton U.S. Custom House Water Infiltration Remediation Project
Request for Information Responses Solicitation No.: 47PC0320R0002
May 7, 2021
Question 1: In terms of the estimate required for this proposal submission (price proposal, estimate cost of work, etc.), are we allowed to share both the drawings and specifications with our local subcontractor market so they can assist us accordingly? If there is a section in one of the documents provided to us that speaks to this, can you kindly advise of where we can read/locate that information?
Response 1: Please refer to Standard A: PBS P-100, Facilities Standards for the Public Buildings Service; Security Requirements, which refers to GSA Order PBS 3490.2, Documents Security for Sensitive But Unclassified Building Information.
As per PBS 3490.2:
“Building information designated SBU must be protected with access strictly controlled and limited to those individuals having a legitimate business need to know such information. Those with a need to know may include Federal, State and local government entities, and nongovernment entities engaged in the conduct of business on behalf of or with GSA.
Nongovernment entities may include architects, engineers, consultants, contractors, subcontractors, suppliers, utilities, and others submitting an offer or bid to GSA, or performing work under a GSA contract or subcontract. Recipient contractors must be registered as “active” in the System for Award Management (SAM) database at www.sam.gov and have a legitimate business need to know such information. If a subcontractor is not registered in the SAM and has a need to possess SBU building information, the subcontractor shall provide to the contractor its DUNS number or its tax ID number and a copy of its business license. The contractor shall keep this information related to the subcontractor for the duration of the contract and subcontract.”
It is the responsibility of the prime contractor to safeguard the documents and ensure any subcontractors they engage with for coordination and price proposals abide by the same standards as the prime.
Question 2: A101 to the left and right of the stairs on Bowling Green where the statues currently sit the tag on the left ref. MEM03 and the one on the right indicates JNT03.
There is no language to remove the statues, however, this would be required to complete either of these details. Please clarify which tag is correct and if the intent is to remove and reinstall the statues.
Response 2: Both MEM 03 and JNT 03 apply to the statues, which will remain in place. MEM 03 is for the installation of waterproofing below the two statue pedestals which directly flank the stairs. The area below the main stairs and these two statue pedestals is accessible from a hatch inside the building. This space below the stairs and statue pedestals is standing height. Please refer to A-409 for a section of the main stairs, which shows a doorway accessible to the chamber below one of the statue pedestals beyond. The waterproofing will be installed directly over the existing concrete topping slab in the space below the stairs and statue pedestals. JNT 03 refers to installing sealant with lead cap joints at the top of all sky-facing joints at all four statue pedestals.
Question 3: A409 “remove existing concrete topping slab over terracotta.” Is this accessible from behind the stair? Or is it the intent that the stair be removed and reinstalled in its entirety?
Response 3: The existing concrete topping slab will remain in place below the stairs and flanking statue pedestals. The note will be revised to say “Existing concrete topping slab to remain in place.”
Question 4: S511/3 the note indicates to remove loose fill from the center of the column. Is the expectation that the column be dismantled and reassembled to complete this scope? Please clarify intent.
Response 4: The existing built-up steel column should not be dismantled. It shall remain in place, protected during construction. Only the brick masonry encasement and the brick infill within the built-up column cavity shall be removed. The built-up steel column section is made of two channels (about 10 inches apart) tied together by triangular lattice on two sides. It is intended that the brick infill within the built-up steel column cavity shall be carefully removed by using hand held tools. The inside cavity steel shall be cleaned, prepared and corrosion protection coating system should be applied.
Question 5: Is the proposed phasing plan set in stone or can it be modified?
Response 5: The CMc is to provide design services as indicated in the SOW and will engage with the GSA, A/E, CMa and project stakeholders in developing a Construction Work Sequencing and Phasing plan as a deliverable during the Design Phase.
Question 6: Are there noise restrictions and hours when no noise can be made?
Response 6: Yes. The building will be occupied and any disruptive work that interferes with the operation of the occupants in the building will need to be done during non-working hours.
Normal building hours are typically Monday thru Friday 7:00AM - 5:00PM; however special events such as Court sessions and museum events will take precedence. The CMc as part of design and construction services will actively engage with the GSA, A/E, CMa and project stakeholders in developing Construction Work Sequencing and Phasing plan and shall coordinate any after-hours work accordingly to accommodate tenant and building operations.
Question 7: Due to Covid restrictions, staff having reactions to their Covid shot, staff contracting Covid and the quarantine period, ability to meet in person in large groups to discuss and review the drawings we are requesting a minimum of a one week extension on the bid and RFI period.
Response 7: Amendment 0002 issued on April 21, 2021 extended the RFI deadline to April 30, 2021 at 3:00 pm local time, and the proposal / offer deadline to May 17, 2021 at 3:00 pm local time.
Question 8: Is there a changing area for the workers to be provided?
Response 8: No designated changing area for workers. However, during the design phase and with coordination of the building and stakeholders, a laydown area for the CMc during construction operations is to be coordinated. CMc will be responsible for the laydown area and can use it as needed.
Question 9: Is there a lay down area or storage for the materials to be salvaged and reused?
Response 9: See RFI Response No.8.
Question 10: Our firm has not been required to file a disclosure statement in the past. Do we still need to complete one for this RFP?
Response 10: Per the Solicitation, offerors are required to complete and submit the Offeror Representations and Certifications with their proposal submissions. With respect to CAS, reference is made to Reps and Certs provisions FAR 52.230-1 Cost Accounting Standards Notices and Certification (JUN 2020) and FAR 52.230-7 Proposal Disclosure—Cost Accounting Practice Changes (Apr 2005). Read the provisions for details on use of Modified v. Full CAS coverage. The Cost Accounting Standards Board Disclosure Statement (CASB DS-1) is required to be completed and submitted in response to Evaluation Factor 6, regardless of whether Modified or Full CAS coverage applies to your offer. The only exception is if the offeror is a small business--small businesses are exempt from CAS.
Question 11: If the disclosure statement is required, can we submit a draft with the RFP and then submit a finalized disclosure statement if awarded a contract?
Response 11: Offers shall contain a fully completed CASB DS-1 form as part of the technical proposal submission, unless the offeror is a small business (see small business exemption referenced in RFI Response No. 10).
Question 12: Please define disruptive construction work and type of demolition that must be performed during non-business hours. What are the off hours that work may take place?
Response 12: See RFI Response No.6.
Question 13: Please explain the purpose of salvaging the WT’s. Is the client open to an alternate scope?
Response 13: It is our understanding that the Tee-beams (WT’s) to which you are referring are horizontal WT’s in the lower inner section of the foundation wall. Those WT’s are to be left in place, exposed (by removing masonry surrounding them), cleaned and repainted before pouring proposed concrete. We believe the WT’s are contributing to stability of free standing vertical columns and removing them might require other means to keep the vertical columns in place.
They also act as lateral reinforcement in existing brick masonry spanning between columns.
Question 14: Please confirm that the removal call out on all demolition sheets are included in the DEM01, DEM02, DEM03, or DEM 04 quantities defined in the restoration schedule (i.e.
“Metal Counter Flashing” called out on left hand side of A-401.00 is part of the DEM 02 removal titled above)
Response 14: The Restoration Schedule includes all the Base Bid and Allowance quantities for the demolition tags shown on DM-101. The demolition quantities are SF areas and include the removal of assemblies (ie. multiple layers of waterproofing, fill, base flashings/counter flashings, drains, grates, etc.) as identified in the demolition section details, wall sections and section details.
Question 15: Please confirm that only the specific items called out as “and protect” are to be included in protection base bid pricing.
Response 15: Including the specific elements noted to be protected, in general all existing construction to remain should be protected in place. Interior should also be protected during construction. For example: At areaways on Bowling Green, where existing sidewall construction is required to be protected, and temporary shoring is required to be provided, it is understood that all protection measures will be provided to protect existing construction.
Please also refer to draft GSA Division One specifications for general requirements for cutting & patching and selective demolition; the CMc as part of design services will work with the A/E, GSA, CMa and other stakeholders to generate construction documents and specification requirements for the construction phase of the project.
Question 16: Please confirm if an existing conditions survey will be required by the contractor to identify the specific location of the quantities defined in the restoration schedule
Response 16: An existing conditions report was completed as part of the pre-design work by the AE. Due to deterioration over time, CMc will need to verify quantities following NTP for the construction phase. During the design review phase, specific location and quantities of restoration will change as construction documents are developed; the CMc will be an active participant during the design phase of the project and shall provide the services as indicated in the SOW to include, but not limited to constructability review, proposed alternatives and independent recommendations. The location of the Base Bid quantities should be clear, but the AOR/EOR will provide clarity if needed. The Contractor should notify the EOR/AOR of any specific conditions uncovered which are not included in the Base Bid, including Allowance Items or field conditions, for which the EOR/AOR will define locations/quantities.
Question 17: Please confirm if there is a specific order that the broken-out phasing must be completed in.
Response 17: See RFI Response No.5.
Question 18: Please confirm if on site storage will be available for any materials that are to be reinstalled, in all phases of work.
Response 18: See RFI Response No. 8.
Question 19: Please provide description, detail and area (square footage) for SKL-01-Metal Frame Light Vault .
Response 19: SKL 01 is an Alternate for approximately 680 SF, which is at the Bowling Green areaways. This Alternate is for the replacement of the existing historic cast iron and glass light vault with new to match. Refer to Spec Section 086300 Metal-Framed Skylights for more information.
Question 20: Please provide description, detail and area (square footage) for SKL-02-Light Vault Glass.
Response 20: SKL 02 is for the replacement of cracked glass units at the existing skylight vaults at the top of the main entrance stairs. Each glass unit is approximately 4”x4”.
Question 21: Please provide detail for MAS-04 and BOL 01.
Response 21: MAS-04 will be removed from the set in future design documents. BOL 01 is a placeholder detail and is for the replacement of the existing bollards at the corners of the loading dock entrances. The new bollards will be similar to the existing, which are concrete encased in metal and will be coordinated with CMc as construction documents are developed.
Question 22: Please provide sizes of windows WIN-01.
Response 22: There will no longer be any window replacement included in this scope of work, so disregard this.
Question 23: Please provide sizes of louvered windows WIN-02.
Response 23: Some louvers will be replaced as part of the mechanical scope of work. A detail will be provided in later submissions. Refer to Spec Section 089100 Louvers for more information.
Question 24: Please provide details of BOL-New Bollards.
Response 24: See RFI Response No. 21.
Question 25: Detail 1/A-409.00 calls out to remove the existing topping slab and Coal Tar Pitch and apply new Fluid Applied Membrane per detail 1/A-410.00. Detail FLA04 on A-506.00 calls out to tie the new Fluid Applied Membrane per MEM03 on A-511.00 into existing Coal Tar Pitch.
Please advise.
Response 25: FLA 01 referenced on A-410 should be FLA 04 on A-506. This is for fluid applied flashing to be installed at the base of the main stairs and extended over the retaining wall curb.
This flashing will not come into contact with any existing coal tar pitch. The description on A-506 to tie into existing coal tar pitch is incorrect. The new fluid applied flashing will extend vertically at the base of the stairs, stopping short of the finish height of the new topping slab.
Question 26: Detail FLA08 on A-508.00 shows Fluid Applied WP applied to the vertical masonry surface and terminating on the face of the masonry. Should a reglet be cut into the masonry and counter flashing be installed?
Response 26: No reglet is necessary. The fluid applied flashing is self-terminating and this area is also enclosed/protected below the main stair.
Question 27: Currently the Bowling Green Entrance is closed off with metal barricades. Will this entrance remain closed during construction? And if so, can construction on the east and west be done simultaneously?
Response 27: These entrances are closed temporarily to the public. They will be open when the building is reopened to the public.
Question 28: Please provide Fire Alarm Vendor/ Provider on the Building.
Response 28: Fire Alarm Vendor is Siemens; however it is serviced and maintained through the Operations & Maintenance (O&M) Contractor Brooks Range Inc. Point of contact is included in the CMc SOW; refer to Section IV.B Building Coordination / ESPC Coordination.
Question 29: Specification section 015000 indicates office space requirements for the owner.
We presume that the owner will occupy space within the existing facility. Please confirm if the CMc should include cost for the fit up of an owner office.
Response 29: The GSA will not have site office allocation available for the CMc contractor, the CMc contractor should include site office within the construction zone to be provided by the contractor. The specifications are in draft form, they will be developed as the project moves though design.
Question 30: Is there space within the building for the CMc Office?
Response 30: See RFI Response No. 29 & RFI Response No. 8.

Question 51: Please confirm the ownership of the sidewalks around the Alexander Hamilton Building is federal and do not need to comply with City of NY DOB requirements. For pedestrian access.
Response 51: The sidewalks around the Alexander Hamilton Custom House are subjected to NYC DOB and DOT requirements.
Question 52: The CMC Statement of Work, Paragraph II B. Schedule Durations and Milestone Dates, indicates that CMC Design Review is scheduled to commence on 8-4-21, and that the 100 % CD Submission is to be completed by January 27, 2022. Construction NTP is scheduled to be issued on September 10, 2023; however the notes indicate that the Construction NTP is to be issued 11 weeks after the 100% CD submission. The date of September 10, 2023 is more than 11 weeks after 100% CD submission. The CMC Agreement paragraph 1C. b indicates that the Design Review Phase will be completed after all deliverables required for the Design Review Statement of Work are completed. Please clarify the following:
a. When are the CMC deliverables due after the issuance of each Design Review milestone submission (ie 75% CD’s, 90% CD’s, 100% CD’s)? The CMC is required to provide a schedule of CMC deliverables to the GSA as part of the Solicitation response.
Response 52.a: Please refer to SOW III.G Deliverables - “Each written deliverable from the CMc is due to the Contracting Officer within 10 working days from the CMc Contractor’s receipt of the A/E’s design-related submission.”
b. Please clarify the scheduled date of issuance for the Construction NTP, given the duration of time indicated between the completion of the 100% CD submission. Is the September 2023 date correct?
Response 52.b: September 2023 is the correct date for the NTP for the construction phase for this project. This date is based on the funding availability for the construction phase of this project.
c. If the September 2023 date is the estimated date for the issuance of the Construction NTP, should bidders assume that Design Review will extend from January 27, 2022 to September 10, 2023? This decision will impact pricing on this portion of the work.
Response 52.c: We intend to award NTP to CMc design phase in September 2021. The design phase review is scheduled to be completed in early 2022. There will be an approximate 1-1.5 year hiatus between completion of design and construction NTP.
Question 53: Would GSA please consider extending the page limitation from 50 to 60 pages in order to allow appropriate room for required information. If no, would GSA please consider NOT counting the schedule or key personnel resumes in the page count? With the number of key personnel resumes required in the RFP and number of phases within the schedule, the 50 page limit is becoming a very hard challenge to meet.
Response 53: The page limitation for the technical proposal is hereby increased to 60.
