SECTION A: GENERAL INFORMATION AND BACKGROUND

The U.S. General Services Administration (GSA) issued a synopsis on March 20, 2024 for this solicitation for commercial products in accordance with the Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Products and Commercial Services, as supplemented with additional information included in this notice.

The GSA is requesting quotes for up to a total amount of approximately 47,500 MWh of unbundled Energy Attribute Certificates (EACs) from generation resources that deliver to certain Balancing Authorities more fully described below and qualify as carbon pollution-free electricity (CFE) in order to meet Federal environmental goals laid out in Section 203 of Executive Order (E.O.) 14057, Catalyzing Clean Energy Industries and Jobs Through Federal Sustainability (December 8, 2021) and its associated White House Council on Environmental Quality Implementing Instructions. The quantity of 47,500 EACs is an estimate; the GSA may elect to purchase more/less than 47,500 depending on pricing and quantity of EACs offered.

GSA anticipates awarding a single or multiple, one-time award of a Firm-Fixed Price Purchase Order as the result of the solicitation. This solicitation is being issued as 100% small business set aside. The applicable North American Industrial Classification Code System (NAICS) code is 221122, Electric Power Distribution.

The Small Business Size Standard is 1,100 employees. Any supplier with the number of employees exceeding this standard for three continuous calendar years is considered a large business for the purposes of this procurement. Additionally, this solicitation will utilize the Indian Energy Purchase Preference. As established in 25 U.S.C. § 3502(d), organizations, the majority of the interest in which is owned and controlled by one or more Indian tribes, will receive an evaluation preference over non-such organizations in the award of any purchase order(s) resulting from this solicitation.

Tribal Majority-Owned Business Organizations are defined as an enterprise, partnership, consortium, corporation or other type of business organization in which the majority of the interest is owned and controlled by one or more Indian Tribes (25 U.S.C. §3502(d)(1)).

SECTION B: STATEMENT OF REQUIREMENT

B.1 QUALIFYING EACS

The GSA is requesting quotes for up to a total amount of approximately 47,500 MWhs of unbundled EACs from generation resources that deliver to certain Balancing Authorities more fully described below and qualify as CFE. The EACs may come from one (1) Balancing Authority or a combination of the listed Balancing Authorities to sum up to approximately 47,500 MWh. The quantity of 47,500 EACs is an estimate; the GSA may elect to purchase more/less than 47,500 depending on pricing and quantity of EACs offered. EACs are instruments that convey information (attributes) about a unit of energy, including the resource used to create it, and the emissions associated with its production and use. A Renewable Energy Certificate (REC) is a type of EAC. Each type of EAC certifies that one (1) megawatt-hour (MWh) of energy has been generated, and fed into the grid, from a particular source such as a solar or wind power plant. For the purposes of this solicitation, the terms REC, EAC, Tradable Renewable Certificates, renewable power, or Green Tags are equivalent terms.

These instruments may fulfill the requirement to provide an EAC, so long as all other terms and conditions are met. Unbundled EACs are sold separately from the physical electricity.

In order to qualify for award the EACs must meet the following four requirements:

Renewable Resource Type: EACs shall only come from resources that generate no carbon emissions, including marine energy, solar, wind, hydrokinetic (including tidal, wave, current, and thermal), geothermal, hydroelectric, nuclear, renewably sourced hydrogen, and electrical energy generation from fossil resources to the extent there is active capture and storage of carbon dioxide emissions that meets Environmental Protection Agency (EPA) requirements. EACs from any other sources do not qualify under this contract and therefore will not be accepted.

Generation Resource Commercial Operation Date (COD): all EACs delivered under this purchase order must be generated from CFE resources that were placed in service on or after October 1, 2021, either as a new resource or as new capacity at an existing resource modified to increase output. If a quoter intends to supply EACs from a resource “modified to increase output” after October 1, 2021, the quoter shall submit detailed information1 on this resource to GSA no later than five (5) calendar days prior to date the solicitation closes, so the Government can verify that the resource EACs meet this requirement.

Note: For the purposes of this requirement, modifications to increase output must result in new resource capacity additions. Modifications that result in increased power output from existing capacity or that reestablish an existing generating resource’s placed-in-service date do not qualify as new resource capacity additions.

EAC Vintage: EACs must be generated between April 1, 2023 through December 31, 2024.

Renewable Resource Balancing Authority: EACs must be sourced from generation resources that deliver to one the Balancing Authorities listed below.

A Balancing Authority, also known as Control Area, is an electric power system or combination of electric power systems bounded by interconnection metering and telemetry to which a common generation control scheme is applied. These Balancing Authorities manage the operation of the electric system within a specific geographic area. There are more than 60 Balancing Authorities in the U.S., and they are typically either utilities, Power Marketing Administrations (PMAs), or a group of utilities that have formed regional entities called regional transmission organizations (RTOs) and independent system operators (ISOs). The Government is looking for EACs in the following Balancing Authorities:

B.2 PAYMENT AND BILLING

All quoters must be registered in the System for Award Management at www.SAM.gov. The Contractor shall invoice for the total amount of EACs delivered to GSA. The Contractor's bill shall encompass ALL applicable charges. Payment shall be in accordance with FAR 32.9 (Prompt Payment), see incorporated clause 52.232-25. If payment is to be made by electronic funds transfer, the provisions of FAR 32.11 (Electronic Funds Transfer), the incorporated clause 52.232-33 shall apply. Before an invoice may be paid, the Contractor must submit Attachments 1 - 4 for approval via electronic mail to the Contracting Officer at Bonnie.Bueter@gsa.gov. Upon approval, invoices will be submitted electronically to: pfsutilities@mettel.net, METTEL General Services Administration c/o MetTel Bruin Team New York, NY 10008.

B.3 RECORD KEEPING

The Government reserves the right to validate source and transaction history as indicated above and to ensure the EACs adhere to the requirements herein. The Contractor must meet all applicable local, state and federal documentation requirements necessary to successfully complete any contract. These records shall be made available upon request to the Government or to any party designated by the Government as authorized to request this data.

B.4 DELIVERY

EACs shall be retired on the Government’s behalf. The Contractor shall complete the Attestation Forms found at Attachments 1 - 4, which shall affirm delivery and retirement of EACs no later than 60 days after the generation date of the EACs. If final attestation forms cannot be submitted by December 31, 2024, draft attestation forms for the contracted EACs shall be submitted no later than December 31, 2024, and final attestation forms shall be submitted no later than 60 days after the generation date of the EACs.

B.5 ANTI-DEFICIENCY

In accordance with the Anti-Deficiency Act (31 U.S.C. 1341(a)(1)), nothing contained herein shall be construed as binding the Government to expend, in any one fiscal year, any sum in excess of the appropriation made by Congress for that fiscal year in furtherance of the subject matter of the contract or to involve the Government in an obligation for the future expenditure of moneys before an appropriation is made.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
