Questionnaire From Vendors – RFQ 45310019Q0016

1. This solicitation appears to be requesting “to obtain contractor services to develop and deliver…” two training courses, however the two course descriptions appear to be identical to the two courses announce in the Press Release dated 10-4-17, titled: EEOC Launches New Training Program On Respectful Workplaces, subtitled: Trainings Focus on Harassment Prevention and Creating Respectful Workplaces for All (https://www.eeoc.gov/eeoc/newsroom/release/10-4-17.cfm). In this press release the two courses are called “Leading for Respect (for supervisors) and Respect in the Workplace (for all employees)”. The press release also says, “The trainings were designed by Fran Sepler, of Sepler and Associates, under a contract with the EEOC.” As per this solicitation there is a specific statement assigning the copyright for the created courses to the Government, the question is does the EEOC own the copyright to the two original courses? NO.

2. The press release also says, “The trainings were designed by Fran Sepler, of Sepler and Associates, under a contract with the EEOC.” The question is since it appears that the EEOC already owns the two training courses and the milestones deliverables time line does not actually provide time for a supplier to develop two new courses is the expectation that the supplier will simply be required to give the EEOC the two training courses they already own?

NO, THE EEOC DOES NOT OWN THE PRIOR MODULES. If this is true then will the EEOC give the supplier the two training courses so that they can give it back? NO—NOT APPLICABLE. If these two courses requested are to be completely new courses will the EEOC provide copies of the current courses they own so that the supplier can make them align? NO, EEOC DOES NOT OWN CURRENT COURSES.

3. This solicitation appears to be requesting “to obtain contractor services to develop and deliver…” two training courses, however the two course descriptions appear to be identical to the two courses announced in the Press Release dated 10-4-17, titled: EEOC Launches New Training Program On Respectful Workplaces, subtitled: Trainings Focus on Harassment Prevention and Creating Respectful Workplaces for All (https://www.eeoc.gov/eeoc/newsroom/release/10-4-17.cfm). In this press release the two courses are called “Leading for Respect (for supervisors) and Respect in the Workplace (for all employees)”. The press release also says, “The trainings were designed by Fran Sepler, of Sepler and Associates, under a contract with the EEOC.” Also, on the EEOC internal training webpage that discusses “Harassment Prevention and Respectful Workplaces Training” https://www.eeoc.gov/eeoc/newsroom/release/10-4-17.cfm https://www.eeoc.gov/eeoc/newsroom/release/10-4-17.cfm

(https://eeotraining.eeoc.gov/profile/web/index.cfm?PKwebID=0x25479b9f&varPage=attendee) there are two course outlines. The question is can the supplier simply submit the two published outlines saying the that the course will follow this work and that the provided trainer(s) will teach the two courses that the EEOC already owns? NO. THE SUPPLIER MUST SUBMIT

THEIR OWN OUTLINES, ALONG WITH THE SUPPLIER’S COURSES. THE

REQUIREMENT REFERENCED IN THE PRESS RELEASE WAS FOR INTERNAL

TRAINERS TO CONDUCT SESSIONS AT OTHER AGENCIES AND ENTITIES,

EXTERNAL TO EEOC. THIS REQUIREMENT IS SPECIFICALLY TO PROVIDE

TRAINING INTERNALLY TO EEOC EMPLOYEES.

4. This solicitation appears to be requesting “to obtain contractor services to develop and deliver…” however under the scope of work, line “c) Provide technical assistance and material modifications to EEOC ‘internal trainers’ and other EEOC staff on the training modules for the duration of the performance period” seems to indicate that there will be EEOC internal personnel that will teach the courses. Does this mean that the courses will be taught by internal resources?

INTERNAL TRAINERS MAY TEACH SOME OF THE COURSES, BUT NOT ALL OF

THE COURSES.

5. In the introduction the EEOC states that they have approximately 2,200 employees.

Approximately how many of those employees have already been provided the training at the three locations discussed? 367. Approximately how many employees will be required to take the leaders level course? APPROXIMATELY 316 (Includes HQ Leaders) Approximately how many employees will be required to take the employee level course? APPROXIMATELY 830.

6. The leader level course is expected to include up to 20 employees. The number of course offerings requested is up to 12 sessions in each of the 12 districts which would amount to up to 144 classes which could accommodate 2,880 individuals which is more than the stated approximate number (2,200) of employees of the EEOC. This requirement also includes the wording, “or an agreed-upon number of consolidated sessions as determined by the EEOC and the contractor.” What is the actual requirement, to provide training to the actual number of leaders or to provide up to 144 leader level classes? THE REQUIREMENT IS TO OFFER A

LEADER SESSION FOR EACH OF THE IDENTIFIED 12 DISTRICTS, WHICH IS A

TOTAL OF 12 SESSIONS.

7. The employee level course is expected to include up to 35 employees. The number of course offerings requested is up to 17 sessions in each of the 12 districts which would amount to up to 204 classes which could accommodate 7,140 individuals which is more than the stated approximate number (2,200) of employees of the EEOC. This requirement also includes the wording, “or an agreed-upon number of consolidated sessions as determined by the EEOC and the contractor.” What is the actual requirement, to provide training to the actual number of employees or to provide up to 204 employee classes? THE REQUIREMENT IS TO OFFER

A TOTAL OF 17 SESSIONS FOR ALL OF THE IDENTIFIED 12 DISTRICTS

COMBINED.

8. The solicitation requests “up to a total of 15 days for employees and supervisors in each of the main District Offices”. This would be up to 180 days of facilitation time which would provide up https://eeotraining.eeoc.gov/profile/web/index.cfm?PKwebID=0x25479b9f&varPage=attendee to 360 possible classes being provided. Based on the two classes sized (20 & 35) this would provide between 7,200 and 12,600 employees with training which is more than the stated approximate number (2,200) of employees of the EEOC. This requirement also includes the wording, “or an agreed-upon number of consolidated sessions as determined by the EEOC and the contractor.” What is the actual requirement, to provide training to the actual number of employees and supervisors or to provide up to 180 days of classes? THE REQUIREMENT IS

TO OFFER A TOTAL OF 15 DAYS OF CLASSES FOR ALL OF THE IDENTIFIED 12

DISTRICTS COMBINED. MULTIPLE SESSIONS WILL BE HELD ON EACH DAY IN

ORDER TO COMPLETE THE TRAINING IN 15 DAYS.

9. What is the approximate head count for employees at each of the 12 district locations: Atlanta, Birmingham, Charlotte, Dallas, Houston, Indianapolis, Los Angeles, Memphis, New York, Phoenix, San Francisco, and St. Louis?

• Atlanta (73), Birmingham (48), Charlotte (79), Dallas (74), Houston (70), Indianapolis (96), Los Angeles (74), Memphis (58), New York (77), Phoenix (67), San Francisco (59), and St. Louis (55)

10. What is the approximate head count for leaders at each of the 12 district locations: Atlanta, Birmingham, Charlotte, Dallas, Houston, Indianapolis, Los Angeles, Memphis, New York, Phoenix, San Francisco, and St. Louis?

11. The solicitation indicates that it says, “EEOC will reimburse allowable travel expenses in accordance with the Federal Travel Regulation (FTR)…”. Does this mean that the quote should not include travel costs? THE QUOTE SHOULD INCLUDE TRAVEL COSTS.

12. A page total is given for “sample outlines and materials from previous contracts” to not exceed 10 pages. What is the page limit for Factor 1 – Technical Capability, Factor 2 – Management Approach, and Factor 3 – Past Performance? THE PAGE TOTAL FOR YOUR

SUBMISSION IS NOT TO EXCEED 25 PAGES.

13. When we submit our cost, should we include the cost of the travel to the various training locations? If so, should we include that cost as an ODC line item? YES, THE COST OF

TRAVEL SHOULD BE INCLUDED AS PART OF THE COST ESTIMATE. (SEE

RESPONSE TO QUESTION #9 AND #10 FOR LOCATIONS AND HEADCOUNT)

14. Could you please tell me if this is a new requirement, or if there is a current or previous contractor who has performed similar services? THIS IS A NEW REQUIREMENT.

HOWEVER, ANOTHER CONTRACTOR PERFORMED SIMILAR SERVICES ON A

SMALLER SCALE LAST YEAR.

15. If available, can you please send along the incumbent contract or task order number? THE

PREVIOUS CONTRACT WAS FOR SIMILAR SERVICES, BUT ON A MUCH

SMALLER SCALE. AS SUCH, THIS SOLICITATION DESCRIBES A NEW

REQUIREMENT FOR AGENCY-WIDE TRAINING.

16. Under Factor 3- Past Performance- the RFQ states "Quoter must provide sample outlines and materials from these contracts, not to exceed ten pages in total." Is this limit regarding the past performance section, a single past performance example, or the entire RFQ submission? THE

LIMIT IS REGARDING THE PAST PERFORMANCE SECTION.

[Clarification from vendor, 03/13/2019- I would like to know if you prefer the FAR representations section as a separate volume, or included within the technical or price volumes, or shared in another way.] VENDOR

SHALL INCLUDE THE FAR REPRESENTATIONS WITH THE PRICE VOLUME.

26. Is it possible to get an outline or overview of the respectful workplace training that the 3 districts have already received? NO, THE EEOC DOES NOT HAVE THE RIGHTS TO

THE PRIOR TRAINING.
