About this file

This is a Prison Rape Elimination Act (PREA) Contractor Acknowledgement form issued by the Nevada Division of Child and Family Services (DCFS) in compliance with the U.S. Department of Justice's Prison Rape Elimination Act of 2003. The document establishes mandatory acknowledgement and compliance requirements for all employees, volunteers, contractors, vendors, and interns who may have contact with youth under DCFS supervision. All individuals must acknowledge their understanding of DCFS's zero-tolerance policy regarding sexual abuse and sexual harassment, including youth-on-youth and staff-on-youth incidents. The form requires signing parties to confirm they will immediately report any disclosed or suspected incidents of sexual abuse or sexual harassment to appropriate supervisory or facility staff and understand that all such reports are legally mandated and will trigger further investigation and action.

The acknowledgement further mandates that any employee or contractor with direct contact with DCFS youth must complete PREA training as determined and provided by DCFS. Signatories must confirm their comprehension of these requirements by checking the acknowledgement box and providing their printed name, signature, date, and title. The document serves as a binding agreement that contractors understand sexual contact or abuse involving youth is always considered non-consensual and illegal regardless of circumstances, and that timely reporting of incidents is critical to institutional safety and compliance.

ATTACHMENT A

PRISON RAPE ELIMINATION ACT CONTRACTOR ACKNOWLEDGEMENT

Print Name of Individual/Entity:__________________________________________________

By singing this form, you are stating that you are aware of all policies and procedures governed by the Division of Child and Family Services (DCFS) and the Unites States Department of Justice (DOJ) Prison Rape Elimination Act (PREA) of 2003.

In accordance with the Prison Rape Elimination Act of 2003 (PREA), the Division of Child and Family Services (DCFS) has a zero-tolerance policy for sexual abuse or sexual harassment and staff on youth sexual abuse or sexual harassment. This includes youth on youth sexual abuse or sexual harassment and staff on youth sexual abuse or sexual harassment. DCFS will have all reported incidents of sexual abuse and sexual harassment investigated, will address the safety and treatment needs of all youth involved in sexual abuse or sexual harassment, and will discipline and prosecute those who violate this policy.

ANY employee, volunteer, contractor, vendor, or intern must accept any information from a youth regarding sexual abuse or sexual harassment. Employees will immediately report the information to their supervisor and follow first responder procedures. Volunteers, contractors, vendors, or interns will immediately report the information to any facility staff. All individuals are legally bound to immediately report the information for further actions, which can include criminal and/or administrative investigation, medical and/or mental health treatment, separation of the alleged victim and the alleged perpetrator, collection of evidence, and other necessary protocols. Time is of the essence in reporting sexual abuse and sexual harassment.

The definition of sexual abuse includes engaging in, or attempting to engage in, a sexual act with a youth or the intentional touching of a youth’s genitalia, anus, groin, breast, inner thigh, or buttocks, with the intent to abuse, humiliate, degrade, arouse, or gratify the sexual desire of any person. Sexual acts or contacts between a youth and youth or staff member and a youth, even when no objections are raised, is always illegal, by law, considered non-consensual.

Also, by signing this form, I acknowledge that ANY employee under this contract that has contact with DCFS youth must undergo PREA training. The level of training is to be determined by and provided by DCFS.
