BOP DB1, Phase One Design-Build Questionnaire Purpose

The Federal Bureau of Prisons (BOP) utilizes the Federal Acquisition Regulation (FAR) Two-Phase Design-Build Selection Procedures (FAR Subpart 36.3) to award firm, Fixed- Price Design-Build Contracts for the development of federal correctional and detention facilities throughout the United States. For this selection process, BOP issues two solicitations in sequence: 1) Phase One, and 2) Phase Two. The Phase One process is to determine which offerors demonstrate the highest qualifications to successfully deliver the facility. All responsible sources may submit a Phase One proposal; up to five (5) Offerors will be invited to submit competitive technical, revised Past Performance, and price proposals in Phase Two, and one Contract will be awarded using competitive negotiation.

The Phase One Solicitation provides Offerors with instructions regarding the submission of their complete proposals and the evaluation thereof. One component of the Offeror's Phase One Proposal is the completion of this questionnaire, BOP DB1, Phase One Design-Build Questionnaire; its purpose is to provide information regarding the qualification interested Offerors to undertake a specific BOP Design-Build project. Utilizing the format prescribed within, Offerors are to provide the requested information and demonstrate their capabilities. Responses shall be as complete and accurate as possible and present data relative to the specific project under consideration. Offerors should make every effort to present information clearly and concisely.

Definitions

"Architect-Engineer Services," as defined in FAR Part 36, means:

(1) Professional services of an architectural or engineering nature, as defined by State Law, if applicable, which are required to be performed or approved by a person licensed, registered, or certified to provide such services.

(2) Professional services of an architectural or engineering nature performed by contract that are associated with research, planning, development, design, construction, alteration, or repair of real property; and

(3) Such other professional services of an architectural or engineering nature, or incidental services, which members of the architectural and engineering professions (and individuals in their employ) may logically or justifiably perform, including studies, investigations, surveying and mapping, tests, evaluations, consultations, consultations, comprehensive planning, program management, conceptual designs, plans and specifications, value engineering, construction phase services, soils engineering, drawing reviews, preparation of operating and maintenance manuals, and other related services.

"Branch Office," as used in this questionnaire, is a satellite or subsidiary extension, of a main or headquarters office of a company, regardless of any differences in name of legal structure of such a branch due to local or state laws. "Branch offices" are normally subject to the management decisions, bookkeeping, and policies of the main or headquarters office.

"Construction," as defined in FAR Part 36, means construction, alteration, or repair (including dredging, excavating, and painting) of buildings, structures, or other real property.

For purposes of this definition, the terms "buildings, structures, or other real property" include but are not limited to improvements of all types, such as bridges, dams, plants, highways, parkways, streets, subways, tunnels, sewers, mains, power lines, cemeteries, pumping stations, railways, airport facilities, terminals, docks, piers, wharves, ways, lighthouses, buoys, jetties, breakwaters, levees, canals, and channels. Construction does not include the manufacture, production, furnishing, construction, alteration, repair, processing, or assembling of vessels, aircraft, or other kinds of persona property.

"Consultant," as used in this questionnaire, is a highly specialized individual or firm of an architectural or engineering nature having significant input and responsibility for certain aspects of a project and possessing unusual or unique capabilities for assuring success of the finished work.

"Contracting Officer," as defined by FAR Part 2, is the person who executes the contract on behalf of the United States. The Contracting Officer is the only official authorized to enter into, administer, and/or terminate the contract and make related determinations and findings. The Contracting Officer is registered with the Department of Justice and is the only individual on the project team who can obligate funds on behalf of the Government.

"Design," as defined in FAR Part 36, means defining the construction requirement (including the functional relationships and technical systems to be used, such as architectural, environmental, structural, electrical, mechanical, and fire protection), producing the technical specifications and drawings, and preparing the construction cost estimate.

"Design-Bid-Build," as defined in FAR Part 36, means the traditional delivery method where design and construction are sequential and contracted for separately with two

"Design-Build," as defined in FAR Part 36, means combining design and construction in a single contract with one contractor.

"Discipline," as used in this questionnaire, refers to the primary technological capability of individuals on the responding Offeror’s team. Possession of an academic degree, professional registration, certification, or extensive experience in a particular field of practice normally reflects an individual's primary technical discipline.

"Joint Venture," as used in this questionnaire, is a collaborative undertaking by two or more firms or individuals as either a corporation or partnership for which the participants are both jointly and individually responsible.

"Key Persons, Specialists, and Individual Consultants," as used in this questionnaire, refer to individuals who will have major project responsibility or will provide unusual or unique capabilities for the project under consideration.

"Major Subcontractor," as used in this questionnaire, includes the construction business entity(ies) that have, or will have, a direct contract with the Offeror to furnish labor and/or material for construction of the mechanical, plumbing, electrical, and security electronics aspects of the project.

"Parent Company," as used in this questionnaire, is that firm, company, corporation, association or conglomerate which is the major stockholder or highest tier owner of the Offeror entity completing this questionnaire (e.g., Firm A is owned by Firm B which is, in turn, a subsidiary of Corporation C; the "parent company" of Firm A is Corporation C).

"Prime," as used in this questionnaire, refers to that firm which may be coordinating the concerted and complementary inputs of several firms, individuals or related services to produce a completed study, design or facility. The "prime" would normally be regarded as having full responsibility and liability for quality of performance by itself as well as by consultants or subcontractors under its contractual control.

"Principals," as used in this questionnaire, are those individuals in a firm who possess legal responsibility for its management. They may be owners, partners, corporate officers, associates, administrators, etc. ꞏ

"Subcontractor," as used in this questionnaire, includes a business entity that has, or will have, a direct contract with the Offeror to furnish labor and material for construction of the project.

Instructions (numbers below correspond to block numbers contained in the questionnaire)

1. Give name and location of the project for which this questionnaire is being submitted. Provide appropriate data from the announcement on the General Services

Administration’s System for Award Management web site, http://www.sam.gov, identifying the particular project for which this questionnaire is being filed: BOP Solicitation or RFP number as provided in the www.sam.gov notice.

2. Type accurate and complete name of Offeror and mailing/delivery address.

3. List up to ten (10) projects worked on in the past five (5) years which demonstrate the Offeror's competence to perform work similar to that likely to be required on this project. The more recent such projects, the better. Prime consideration will be given to projects which illustrate respondent's capability for performing work similar to that being sought. For the "Role of Firm" item indicate: (a) whether Offeror was "P," the prime professional, or "C," a consultant, or "JV," part of a joint venture on that particular project, or "IE" for "Individual Experience" as opposed to firm experience if Offeror is a new firm (in existence less than five (5) years). State the year work on that particular project was, or will be, commenced and completed. Show the estimated construction cost (or other applicable cost) for that portion of the project for which the Offeror was primarily responsible.

4. Provide brief resumes for the Project Executive/Principal-in-Charge, Design Team Leader, Construction Project Manager and Construction Superintendent (a total of four

(4) resumes) expected to participate on this project. If individual has more than one highest degree, such as two Ph.D.'s, list both. If individual is registered as a design professional, show only the field of registration, the year that such registration was first acquired and indicate whether or not the individual is registered in state where the project is located. If an individual is registered in several fields show all fields; if registered in several states, do not list states. Indicate the project size (construction cost), delivery approach for the project (design-bid-build or design-build), and the individual's position/responsibility on the project. Present a synopsis of the individual's experience, training, or other qualities which reflect potential contribution to this project. Include such data as: familiarity with Government or BOP procedures, similar type of work performed in the past, management abilities, familiarity with the geographic area, etc. Please limit synopsis of experience to directly relevant information.

5. Through narrative discussion addressing the evaluation factor, Technical Qualifications, indicate reasons why the Offeror believes it is especially qualified to undertake the project. Offerors may say anything they wish in support of their qualifications or to demonstrate capabilities of the team proposed for this project. This item shall not exceed the two (2) pages provided in the questionnaire. Additional data, brochures, photos, etc. should not accompany the questionnaire.

6. Type accurate and complete name of Offeror and mailing/delivery address.

7. Legal Structure Information - In order to be eligible for this project, Offeror organizations must legally exist prior to the time of Contract award. If the Offeror's organization legally exists or has been formed for this project, identify the nature of the entity or other arrangement. If the Offeror has not yet been formed, provide a brief description of the proposed legal structure.

8. If Offeror intends to use outside key consultants or subcontractors, provide names and addresses to the extent possible at this Phase, as well as their particular areas of technical/professional expertise as it relates to this project. Existence of previous working relationships should be noted. Offerors are encouraged to name consultants and subcontractors anticipated to have significant portions of the work or are of a critical importance to the function of the facility, e.g., security hardware, fire protection/life safety engineer, geotechnical engineer, mechanical, plumbing (if different entity from mechanical subcontractor), electrical, and security electronics. Attach an additional sheet containing requested information if more than seven (7) outside consultants or subcontractors are identified.

9. Prepare an organizational chart identifying individuals and their associated firms responsible for major functions to be performed relative to designing and building the project.

The chart shall identify a single point of contact for the Proposal and the Design-Build process.

10. Identify the individual of the Offeror's organization or team that will provide the primary design services as the Architect/Engineer (A/E) of Record. The Architect/Engineer (A/E) of Record shall also be a Designer of Record for one or more specific design disciplines. The chart shall also indicate, to the extent possible at this Phase, the individuals acting as the Designer of Record for one or more specific design disciplines.

11. For the Offeror and key consultants/subcontractors noted previously, insert the firm information requested. Describe the primary line of business and the categories of work that the Offeror normally performs with its own forces. Insert the personnel by discipline as listed or otherwise non-administrative or overhead-based personnel identified. List each person only once by primary function. Write in any additional disciplines (e.g., quality control specialists) regarded as necessary for the project and the number of current personnel in each, in the blank spaces. While some personnel may be qualified in several disciplines, each person should be counted only once in accord with his or her primary function. For each of the firms provide a one-page listing of a maximum of five (5) projects which demonstrate the firm's competence to perform work similar to that likely to be required on this project. Identify the delivery method of the listed project (design-build, design-bid-build, other).

12. Using the design-build volume, construction volume and professional services fee range charts provided, insert the appropriate index number. For the Offeror and each of the key consultants/subcontractors previously identified, state the average annual work under contract by firm for the current calendar year (projections are allowed) and last four

(4) calendar years, as well as the average annual amount over the five (5) years. The current year should be indicated first, and the last four (4) years should be indicated in descending order (e.g. 2020, 2019, 2018, 2017 and 2016).

13. Through narrative discussion addressing the evaluation factor Technical Approach, indicate reasons why the Offeror believes it is especially qualified to undertake the project. Offerors may say anything they wish in support of their qualifications or to demonstrate capabilities of the team proposed for this project. This item shall not exceed the three (3) pages provided in the questionnaire. Additional data. brochures, photos, etc. should not accompany the questionnaire.

14. Completed forms should be signed and dated by a corporate officer or principal of the Offeror, preferably the chief executive officer.
