About this file

This document contains required affidavits for bidders, offerors, and contractors participating in the City of Owensboro's mowing services contract opportunity in Kentucky. The affidavits establish compliance requirements for two distinct bidder statuses: qualified bidder status and resident bidder status. Bidders claiming qualified bidder status must certify that they are a nonprofit corporation furthering the purposes of KRS Chapter 163 or a qualified nonprofit agency for individuals with severe disabilities that employs individuals with severe disabilities for at least seventy-five percent of direct labor hours. Bidders claiming resident bidder status must attest that they are authorized to transact business in Kentucky, have filed Kentucky income taxes for one year prior to advertisement, have made payments to the Kentucky unemployment insurance fund, and maintained a Kentucky workers' compensation policy in effect during that period.

The bidding agency reserves the right to request documentation supporting any claimed qualified bidder or resident bidder status, with failure to provide such documentation resulting in bidder disqualification or contract termination. All affidavits must be sworn and notarized, with the affiant identifying their name, title, company name, and address. These preference laws are designed to encourage participation from Kentucky-based businesses and nonprofit organizations serving individuals with disabilities, establishing eligibility criteria that bidders must meet and maintain throughout the contract term.
