About this file
This is a sample Bid Bond form issued by the City of Owensboro, Kentucky for mowing services. The bid bond serves as a guarantee that a bidder will enter into a contract if their bid is accepted and will provide the required performance and payment bonds. The form is designed to be completed with specific project details including the bid due date, project description, bond number, and penal sum amount. The bond requires execution by authorized representatives of both the bidder and the surety, with corporate seals affixed to the document.
The bid bond establishes that the bidder and surety are jointly and severally liable to the City of Owensboro for the penal sum if the bidder fails to deliver the executed agreement and required bonds within the time specified in the bidding documents. The bond obligates payment within 30 calendar days of written notice of default from the City. The obligation becomes null and void if the City accepts the bid and the bidder timely delivers the executed agreement with required bonds, if all bids are rejected, or if the City fails to issue a Notice of Award within the time specified in the bidding documents or any written extensions not exceeding 120 days without the surety's consent. No legal action may be commenced under the bond earlier than 30 days after notice of default or later than one year after the bid due date, and such action must be filed in a court of competent jurisdiction in Kentucky. The surety must provide a current Power of Attorney demonstrating authority to execute and bind the surety to the bond.
