About this file
This is a FERPA Agreement between Gwinnett County Public Schools (GCPS) and a contractor providing on-demand IT professional services in Georgia. The agreement establishes the contractor's obligations regarding the handling of educational records and student data protected under the Family Educational Rights and Privacy Act (FERPA) and Georgia's Student Data Privacy, Accessibility, and Transparency Act. The contractor is authorized to access personally identifiable information including student names, parent contact information, social security numbers, student identification numbers, biometric records, dates of birth, and medical information solely for the purpose of providing IT professional services as an agent of GCPS. The contractor must maintain strict confidentiality of all transferred data and comply with access controls, user authentication, and data security protocols established by the district.
The contractor is prohibited from disclosing student data without prior written parental consent, except when required by judicial order or lawfully issued subpoena, in which case the district and affected parents must be notified. The contractor may not use transferred data for commercial purposes, targeted advertising, or data sales without express parental consent and must refrain from tracking online behavior of users under age 13. The contractor must implement commercially reasonable security methods to limit data access to authorized personnel, provide annual confidentiality training to all staff with data access, and maintain audit trails for district inspection. The contractor assumes full liability for any improper disclosures or unauthorized access, including indemnification of the district for all associated costs and potential fines. A material breach involving improper data disclosure may result in contract termination and a five-year prohibition on providing personally identifiable information to the contractor.
