About this file
This is a Privacy and Security Agreement document issued by the San Francisco Department of Public Health (SFDPH) Office of Compliance and Privacy Affairs (OCPA) effective June 7, 2017. The document establishes mandatory privacy and data security attestation requirements for all contractors and partners who receive or have access to health or medical information or electronic health record systems maintained by SFDPH. Contractors must complete two attestation forms—a Privacy Attestation Form and a Data Security Attestation Form—and retain completed attestations for seven years. The agreement applies to all contractors and extends additional requirements to those who serve patients or clients with direct access to SFDPH Protected Health Information (PHI). Key requirements include maintaining formal HIPAA-compliant privacy policies, designating a Privacy Officer and Data Security Officer, implementing mandatory privacy and data security training upon hire and annually thereafter, executing Business Associate Agreements with applicable subcontractors, maintaining encrypted devices approved by SFDPH Information Security staff, and ensuring employee access is deprovisioned within specified timeframes upon termination.
The attestation forms require contractors to demonstrate compliance through documented evidence including security assessments or audits conducted at least every two years, formal data security awareness programs, data flow diagrams for SFDPH information between the contractor and subcontractors or vendors, and proper documentation of employee acknowledgments of training. All contractors must attest under penalty of perjury that the information provided is true and accurate. Any "No" or "Not Applicable" responses to attestation questions require consultation with and approval from OCPA at 1-855-729-6040 or compliance.privacy@sfdph.org. The OCPA reserves the right to request submission of completed attestations along with supporting evidence to verify ongoing compliance with HIPAA, HITECH, and SFDPH requirements.
