About this file

This is a Use and Non-Disclosure Agreement (NDA) template for the USS Rafael Peralta (DDG 115) contract opportunity NAPL-009-27 under solicitation #N6817127QN006. The agreement governs the handling of restricted technical data provided to offerors during the proposal phase.

Recipients of restricted technical data must use the information solely for proposal support and may not disclose it to external parties without written permission from the Contracting Officer, except to subcontractors or prospective subcontractors who require the data and who submit their own NDAs. Recipients must implement physical security measures to prevent unauthorized disclosure and accept the data "as is" without warranties. The agreement requires that recipients have no debarred, suspended, or ineligible personnel with data access and have not violated U.S. export control laws. Non-U.S. companies must submit to U.S. laws, regulations, and jurisdiction. Successful offerors may use data only as permitted under DFARS 252.227-7025 and may be required to sign an additional NDA. Unsuccessful offerors must destroy all data copies within 30 days of non-selection notification and provide a destruction statement to the Contracting Officer. Recipients indemnify the Government for any misuse or unauthorized disclosure and remain liable for breaches even after agreement expiration. Enclosure 1 lists 22 restricted FDRMC references covering naval vessel design specifications, including general plans, piping systems, insulation requirements, HVAC systems, refrigeration plants, fire performance standards, and habitability criteria for DDG 51-class destroyers.
