Government is authorized to examine any records of the recipient and its subawards or contracts to the extent necessary to ensure that funds, including supplies and services, available under this grant or cooperative agreement are not provided, directly or indirectly, to a person or entity that is actively opposing United States or coalition forces involved in a contingency operation in which members of the Armed Forces are actively engaged in hostilities, except for awards awarded by the Department of Defense on or before Dec 19, 2017 that will be performed in the United States Central Command (USCENTCOM) theater of operations.
D. Payment to Contractor:
1. General: Payment to the Contractor for Work performed under this Contract shall be made by the City in accordance with the terms and conditions set forth herein and in the primary Contract Documents. The City's funding for this project includes federal financial assistance from the Bureau of Reclamation, which imposes specific requirements on the City as the Grantee.
2. Invoicing and Progress Payments: The Contractor shall submit applications for payment to the City at intervals specified in the Contract Documents (e.g., monthly). Each application shall detail the Work completed, materials stored on-site, and other eligible costs, supported by appropriate documentation. The City will review and verify the Work completed and costs incurred before approving payment.
3. Timely Payment: The City shall make timely payments to the Contractor for approved invoices, consistent with its obligations under the federal award to minimize the time elapsed between the transfer of federal funds to the City and the disbursement to its contractors.
4. No Payment for lo Amounts: The City is prohibited by federal regulations (2 CFR 200.305(b)(6)(iv)) from making payment to the Contractor for amounts that the Contractor withholds from its subcontractors or suppliers to assure satisfactory completion of work. Payment for such withheld amounts will only be made when the Contractor actually disburses the withheld funds to its subcontractors/suppliers or to escrow accounts established for satisfactory completion of work.
5. Final Payment: Final payment, constituting the entire unpaid balance of the Contract Sum, shall be made by the City to the Contractor when the Work has been fully completed in accordance with the Contract Documents, the Contractor has fulfilled all obligations under the Contract, and a final Application for Payment has been submitted and approved.
E. Project Performance and Reporting
1. Construction Performance Reports (2 CFR 200.306(c)): The Contractor shall cooperate with the City in providing necessary data for performance reports, particularly related to onsite technical inspections and certified percentage of completion data, as required by the Federal awarding agency to monitor progress.
2. Significant Developments (2 CFR 200.306(d)): The Contractor shall inform the City immediately of any problems, delays, or adverse conditions which will materially impair the ability to meet the objective of the project. This disclosure must include proposed actions to resolve the situation and any assistance needed. Similarly, favorable developments that enable meeting schedules or objectives sooner, or at less cost, should also be reported.
F. Miscellaneous Provisions
1. Inspection (Section 6 of Grant Agreement): The Contractor shall allow the
City, the Bureau of Reclamation, and their authorized representatives the right to inspect and evaluate the work performed or being performed under this Contract, and the premises where the work is being performed, at all reasonable times.
The Contractor shall furnish all reasonable facilities and assistance for the safe and convenient performance of these duties.
2. Supplies (2 CFR 200.314) See also 200.453 Materials and supplies costs, including costs of computing devices.
1. (a) Title to supplies will vest in the City upon acquisition. If there is a residual inventory of unused supplies exceeding $5,000 in total aggregate value upon termination or completion of the project or program and the supplies are not needed for any other Federal award, the City must retain the supplies for use on other activities or sell them, but must, in either case, compensate the Federal Government for its share. The amount of compensation must be computed in the same manner as for equipment.
See 200.313 Equipment, paragraph (e)(2) for the calculation methodology.
3. (b) As long as the Federal Government retains an interest in the supplies, the non-Federal entity must not use supplies acquired under a Federal award to provide services to other organizations for a fee that is less than private companies charge for equivalent services, unless specifically authorized by Federal statute.
4. Equipment (2 CFR 200.313):
1. Title and Use: Title to equipment acquired under this Contract, whether purchased directly by the Contractor and reimbursed by the City using federal funds or purchased directly by the City for the Contractor's use on the project, shall vest conditionally in the City upon acquisition. The Contractor shall use such equipment solely for the authorized purposes of this project during the period of performance. The Contractor shall not encumber the equipment without prior written approval from the City.
2. Management: The Contractor shall implement and maintain adequate procedures for managing equipment used in the performance of the Work, including maintaining property records (description, serial number, funding source, acquisition date/cost, location, use, condition), conducting physical inventories at least every two years, establishing control systems to prevent loss/damage/theft (and investigating any such incidents), and developing maintenance procedures to keep the property in good condition. Such records shall be made available to the City, federal agencies, and auditors upon request.
3. Disposition: Upon completion of the Work or termination of this Contract, or when the equipment is no longer needed for the project, the Contractor shall return all such equipment to the City, unless otherwise directed in writing by the City. The City will be responsible for final disposition in accordance with 2 CFR 200.313.
5. BONDING – Bonding for bid, performance, and payment bonds shall comply with
2 CFR 200.326 and State of Texas Local Government Code § 2253
By submitting a bid/proposal, the Bidder acknowledges and agrees to these Supplemental General Conditions.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
8/12/25, 3:59 PM SAM.gov https://sam.gov/wage-determination/TX20250023/0 3/5
Survey Rate Identifiers
The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.
