About this file

This is a Contractor Residency Statement form required by the Texas Government Code section 2252.002 for the Construction of Woodland West Aquatic Center project issued by the City of Arlington, Texas. The form must be completed by all bidders to establish their residency status. Texas resident bidders must initial the appropriate section, while non-resident bidders (those whose corporate office or principal place of business is located outside Texas) must identify their home state and acknowledge the percentage by which their bid must be lower than Texas resident bids to be considered for award. The form requires bidders to provide company name, address, city, state, zip code, and title of the authorized representative signing the document. Bidders must certify that their principal place of business meets the state's definition, which requires at least one permanent office in Texas from which business activities other than bid submissions are conducted and at least one employee working in that Texas office.

Non-resident contractors whose bids do not include a completed residency statement will be automatically disqualified. The Texas Comptroller publishes an annual list detailing each state's requirements for awarding governmental contracts to bidders whose principal place of business is outside that state, available at comptroller.texas.gov. This residency requirement does not apply to contracts involving federal funds. Bidders must submit bids electronically through the City of Arlington's Euna Procurement system; paper bids submitted outside this system may be incomplete or non-compliant, and the City accepts no responsibility for such submissions.

CONTRACTOR RESIDENCY STATEMENT

The Texas Government Code section 2252.002 governs the awarding of contracts to non-resident bidders. This law provides that, in order to be awarded a contract as low bidder, a non-resident bidder (out-of-state contractor whose corporate office or principal place of business is outside the State of Texas) bid projects in Texas at an amount lower than the lowest Texas resident bidder by the same amount that a Texas resident bidder would be required to underbid a non-resident bidder in order to obtain a comparable contract in the state in which the non-resident's principal place of business is located. The appropriate blanks in the following statement must be filled out by all out-of-state or non-resident bidders in order for those bids to meet specifications.

The failure of out-of-state or non-resident contractors to do so will automatically disqualify that bidder. This does not apply to contracts involving Federal Funds.
