About this file

This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by Salt Lake City Corporation's Purchasing & Contracts Management Division. The form is designed for contractors or private providers to identify and potentially protect sensitive business records or information under Utah State Code § 63G-2-305. Specifically, the document allows businesses to claim confidentiality for trade secrets or commercial financial information that could be subject to potential public disclosure requests.

The form provides a structured method for businesses to submit a confidentiality claim, requiring details such as company information, contact details, and a specific explanation of why certain records should be protected from public disclosure. The form notes that making a confidentiality claim does not guarantee protection, as the government may still choose to release the information in response to a records request. Businesses are required to provide a concise statement supporting their confidentiality claim and can indicate whether a public (redacted) version of the records is also being submitted.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
