About this file

This document is Addendum #2 to a Request for Proposals (RFP) issued by The Port Authority of NY & NJ for Designated Aviation Channeling (DAC) Services at four airports: John F. Kennedy International Airport, Newark Liberty International Airport, Laguardia Airport, and New York Stewart International Airport. The RFP due date has been extended from 8/20/2025 to 9/3/2025, with submissions required no later than 2:00 PM. The addendum includes modifications to the financial information section, clarifying that proposers must demonstrate financial capability to perform the contract, and provides responses to five questions from potential proposers regarding submission requirements, audit reports, and potential program name changes.

The addendum addresses several key technical and procedural details, including electronic submission requirements via the Bonfire platform, clarification on audit report submissions (SOC Type II or TSA-approved audit reports), and guidance on potential future changes to the aviation channeling program. The Port Authority indicates that if the program transitions from Designated Aviation Channeling (DAC) to Aviation Channeling and Data Management System (ACDMS), contractors will be expected to obtain necessary certifications at their own expense and comply with TSA requirements. The document maintains standard procurement language that limits the Port Authority's liability and provides contact information for further questions.

The Questions and Answers numbering sequence will be continued sequentially in any forthcoming Addenda that may be issued.

Question # 1

Reference RFP Section F Submission of Proposals, pages 8 and 9 of 129.

The RFP states the proposal shall be submitted electronically via the Bonfire platform. The instructions also state the Port Authority may also ask for printed, signed copy at any time after the due date. What is the purpose of submitting a paper copy if an electronic copy has been submitted and what will be the anticipated timing of this request?

Answer # 1

Submission of electronic copy via Bonfire platform is sufficient. This is standard language as backup if there are any non-curable issues with electronic submission.

Question # 2 Reference RFP Section 4 Financial Information, page 13 of 129 states, in part: “The Proposer shall submit, with its Proposal, the documents set forth in Section 7(O) below.” There does not appear to be a Section 7(O) in the RFP. Is the correct reference intended to be Section 7(N) Financials on page 20 of 129?

Answer # 2 See Changes/Modifications # 2 above.

Question # 3 The proposal checklist item 17 states “Include SOC Type II Audit Report.” Designated Aviation Channelers are audited and certified by TSA’s Information Assurance Division in accordance with applicable federal cyber security controls including FISMA as a prerequisite to receiving an Authority to Operate. SOC Type II audits are not sufficient to gain an Authority to Operate (ATO) from TSA. Will the PANYNJ confirm that proof of ATO is sufficient to satisfy this requirement?

Answer # 3 The Authority to Operate (ATO) proof is not sufficient to satisfy the requirement. In lieu of the SOC Type II Audit Report, the audit report that was approved by TSA can be submitted.

Question # 4 TSA intends to update the name of the program from Designated Aviation Channeling (DAC) to Aviation Channeling and Data Management System (ACDMS) as soon as in 2026. Can the PANYNJ confirm that the contract term will be honored during and after the program’s name change, assuming the successful offeror continues to maintain all requisite certifications to provide the services by TSA?

Answer # 4 Refer to last paragraph of Section B of Attachment G – Scope of Work, entitled ‘Introduction’, which states “In the event the Services required hereunder can no longer be performed by a DAC, and the Contractor must obtain an alternative/additional certification or Authority to Operate (ATO) from the TSA, or transition to an alternative system as required by the TSA, the Contractor agrees to obtain the required certifications/ATO to continue to perform the Services at the sole expense of the Contractor.

Contractor shall comply at no additional cost to the Port Authority at a mutually agreed timeframe approved by the PAPM.”

Question # 5 Can the Port Authority please extend the RFP due date by at least 2 weeks?

Answer # 5 See Changes/Modifications # 1 above.

This communication should be initialed by you and annexed to your Proposal upon submission.

In case any Proposer fails to conform to these instructions, its Proposal will nevertheless be construed as though this communication had been so physically annexed and initialed.
