June 12, 2024
RLP Amendment No. 6 is hereby issued to amend the RLP to allow for speculative construction offers without the requirement of a building envelope prior to award and to update the prevailing wage rates. In order to be considered for award, offers conforming to the requirements of the RLP shall be submitted through RSAP no later than Monday, July 8, 2024, by 4:00pm CT.
Request for Lease Proposals No. 3IN0254 is hereby amended as follows:
Request for Lease Proposal (R100)
1. EXHIBIT L - Is hereby deleted in its entirety and replaced with Attachment A – DOL Wage Determination (published 6/7/24) to this amendment.
2. SECTION 1.04, UNIQUE REQUIRMENTS (OCT 2021) – MODIFIED is hereby deleted in its entirety and replaced with the following:
In order to be technically acceptable, offers must meet the following minimum requirements:
A. The space will be used by the Department of Commerce, US Census Bureau to meet its constitutional obligation to complete the 2030 Decennial Census. Award to an offeror may not result in a federal undertaking giving rise to obligations under the National Environmental Policy Act, and Section 106 of the National Historic Preservation Act because compliance with these obligations is categorically deemed to cause unacceptable risk of delays to occupancy. In order for an offer not to be considered a federal undertaking, the offered building/location must be existing (including all required parking) or an offer for speculative construction, as defined in conditions 1 and 2 below. Offers for new construction, including offers to construct an annex or addition to an existing building, will not be accepted, with the following exception: A Building not completed as of issuance of this RLP may be deemed to be speculative construction and therefore treated as an existing building if it meets the following conditions:
1) Plans to build the offered building and required parking (not just plans to construct sitework) have been submitted to the permitting authority for obtaining a construction permit prior to the RLP issuance date of January 8, 2024.
2) Modifications to building design requiring additional permitting subsequent to RLP issuance do not nullify satisfaction of Condition 1 if the unmodified design meets RLP requirements. Such modifications will be deemed to be the lessor’s undertaking for its own convenience and/or efficient performance.
B. If the property on which the offered building is located has or had Recognized Environmental Conditions (RECs) for which environmental regulating agencies have required remediation, evidence of completion of such remediation by letter or certificate from the regulating authority must be submitted no later than the final proposal revision due date. Such offers shall also be required to submit with their offers a copy of the Phase I Environmental Study identifying such RECs.
C. Offered space must be able to meet the occupancy date of no later than July 1, 2026. In addition, offered space may not be encumbered by existing tenants or leases, unless the Offeror can demonstrate, to the satisfaction of the LCO, that the offered space can be made available within a timeframe to meet the post award schedule.
D. Subleases will not be considered.
E. Space adaptable to efficient layout and workflow
F. The Government requires 24 hours a day, 7 days a week access to the space.
G. If multiple floors are offered, the offered space must be on consecutive floors. Warehouse and Production Area space must be located on the ground floor and must be adjacent. Up to 30,000 ABOA sf of the office component can be located above grade (i.e. on the second story).
H. The Production Area space requires a ceiling clearance of at least 20 feet.
I. The Warehouse space requires a ceiling clearance of at least 30 feet.
3. SECTION 3.02 RECEIPT OF LEASE PROPOSALS (OCT 2023) is hereby deleted in its entirety and replaced with the following:
A. Online method - Submission through the Requirement Specific Acquisition Platform (RSAP):
1. Unless otherwise authorized by the LCO or his/her designated representative, offers may only be submitted electronically to GSA using the Requirement Specific Acquisition Platform (RSAP) located at leasing.gsa.gov. RSAP enables Offerors to electronically offer space for lease to the Federal Government. The offer submission process is web-enabled, allowing all registered participants to submit and update offers to lease space to the Government in response to a single RLP for a specific space requirement.
2. In order to be considered for award, offers conforming to the requirements of the RLP shall be submitted through RSAP no later than July 8, 4:00 pm CST.
3. Offerors must submit all documentation identified in this RLP using RSAP. The RSAP generates the Lessor's Annual
Cost Statement (GSA Form 1217) and Proposal to Lease Space (GSA Form 1364) based on the entered data.
These auto-populated forms are available for review at the end of the RSAP workflow and should be uploaded by the Offeror as part of his/her offer; there is no need for the Offeror to manually complete the attached blank version of these two forms. Any subsequent revisions to offer documents must be submitted through RSAP. There is no paper-based submission process under this RLP and paper submissions will not be considered, unless otherwise authorized by the LCO.
B. There will be no public opening of offers, and all offers will be confidential until the Lease has been awarded. However, the Government may release proposals outside the Government such as to support contractors to assist in the evaluation of offers. Such Government contractors shall be required to protect the data from unauthorized disclosure.
All respondents to this RLP shall acknowledge receipt of this Amendment No. 6 by signing in the space provided below. The acknowledged copy must be received as part of your offer. Please submit a copy with your revised offer by Monday, July 8, 2024, 4:00 pm CST along with the revised offer submittals and uploaded to the RSAP portal.
