About this file
This is a Truth in Negotiation Certification document issued by the Florida Department of Transportation (FDOT) required for professional services contracts exceeding the Category Four threshold established in Florida Statutes Section 287.017. The certification applies to the City of Fort Myers' Electrical Vehicle Charging Station (EVCS) project, which seeks a qualified contractor to fully fund, design, install, operate, maintain, market, and potentially remove charging stations on publicly owned properties. The City is soliciting comprehensive turnkey proposals released on July 2, 2025, with submissions due by August 5, 2025. A pre-submittal meeting is scheduled for July 11, 2025, and City Council contract approval is anticipated on September 2, 2025. The contract will have an initial seven-year term with three one-year renewal options. The evaluation methodology allocates 50% of points to the firm's experience and qualifications, 40% to project approach, and 10% to pricing, with contractors required to demonstrate at least five years of experience with turnkey EVCS installations in the U.S. market.
The certification requires that the consulting contractor warrant the accuracy, completeness, and currency of wage rates and other factual unit costs supporting the compensation agreement at the time of contracting. The contractor agrees that the original agreement price and any additions shall be adjusted to exclude any significant sums by which the Department determines the price was increased due to inaccurate, incomplete, or noncurrent wage rates and factual unit costs. All such adjustments must be made within one year following the end of the contract, with the contract end date defined as the date of final billing or acceptance of work by the Department, whichever is later. The procurement emphasizes participation from Disadvantaged Business Enterprises (DBE) and Minority Business Enterprises (MBE), with FDOT maintaining a race-neutral DBE program with a 10.54% overall DBE goal. Contractors must comply with E-Verify employment verification, Build America, Buy America (BABA) provisions for domestic products, and various federal and state certifications including debarment, human trafficking prevention, and foreign entity restrictions.
