Q: I know you say splotchy gras but be honest have you seen Ft. Sam Cemetery’s grass? I do a lot and it is all over the place dead spots, weeds, different colors of grass, and different grasses. 99% of it is Bermuda grass but there are differences, I do not think you are getting registered grass or have been getting registered grass for a long while.
Do you intend of the contractor to provide certificates of registered grass with each delivery?
A: A certificate is only required with the first delivery from a supplier. Subsequent deliveries from the same supplier do not require a certificate. If the supplier changes or the supplier’s certification status changes, a new certificate would be required.
Q: Please provide the actual square footage ordered under the prior contract (36C78622D0021) for each year, split by installation and delivery-only.
A: Cemetery used approximately all quantities available in both CLINs (install and delivery) during OY3 and OY4.
| Q: | Will sod purchased from a supplier be treated as materials and excluded from the 50% services limitation? |
| A: | Sod is considered a direct cost but not the principal purpose of the contract and can therefore be excluded from the 50% threshold. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6. | Q: | Is a certificate of receipt of registered grass required with each shipment received at the facility? |
| A: | A certificate is only required with the first delivery from a supplier. Subsequent deliveries from the same supplier do not require a certificate. If the supplier changes or the supplier’s certification status changes, a new certificate would be required. |
| Q: | Factor 2 (Past Performance): If the offeror proposes a subcontractor to perform the sod delivery and installation, may the subcontractor's past performance projects satisfy the 3-project requirement? If the offeror has no past performance of its own, is a "Neutral" rating considered technically acceptable under the LPTA evaluation? |
| A: | Subcontractor’s past performance cannot be used to satisfy the 3-project requirement. A neutral rating is considered technically acceptable. |
| Q: | Limitations on Subcontracting (VAAR 852.219-75 / FAR 52.219-14): For this requirement, may the cost of the sod itself, purchased from a grower, be excluded from the 50% limitation as the cost of materials? Or does the full amount paid to the grower count as subcontracted services? |
| A: | Sod is considered a direct cost but not the principal purpose of the contract and can therefore be excluded from the 50% threshold.
