This is a Questions and Responses document for Solicitation 36C78626Q50227 concerning Underground Storage Tank (UST) compliance services at Miramar National Cemetery.
The solicitation requires comprehensive UST compliance testing and maintenance services for a single split tank system with 600-gallon diesel and 400-gallon gasoline capacity, equipped with vapor recovery systems. The contractor must perform annual Phase I and Phase II Enhanced Vapor Recovery (EVR) equipment testing, triennial Overfill Prevention Equipment (OPE) inspections billed in the year conducted, and full California UST compliance testing under CCR Title 23, Division 3, Chapter 16, including annual/triennial cathodic protection testing, line leak detector testing, and spill/overfill equipment functional testing. The contractor must hold a California Tank Tester License and California-specific ICC UST Service Technician/Installer certification recognized by the County of San Diego DEH (CUPA). Testing shutdowns may occur Monday through Friday between 8:00 a.m. and 4:00 p.m. with five days' written notice, and must be restored prior to end of workday. All San Diego Air Pollution Control District permits and fees are the contractor's responsibility. Repairs identified during testing are awarded separately via service order or contract modification, with the contractor providing quotes to the Contracting Officer Representative. The most recent system testing was conducted on August 4, 2020. The Permit to Operate will be provided to the awardee post-award and is not disclosed in the solicitation.

Questions/Responses Solicitation 36C78626Q50227
1. Section 4 of the Past Performance Questionnaire (PPQ) attachment references 'Elko National Cemetery Grounds Maintenance requirements' rather than the Miramar National Cemetery UST compliance requirements. Could the Government please clarify if oƯerors should submit this PPQ as-is, or if a revised PPQ will be issued specifically for the Miramar National Cemetery solicitation?
Response: The PPQ has been updated and uploaded to SAM.gov
2. Triennials overfill prevention equipment (OPE) inspections are required under the scope of work, but the pricing schedule utilizes identical annual CLINs (CLIN X0002 - Testing and Certifications) for the Base Year and all four Option Years. Should the cost of the triennial testing be priced entirely within the specific year it is scheduled to occur (e.g., Base Year), or should it be amortized across all five years of the contract?
Response: PWS 2.2.1. The triennial OPE inspection is once every three years the cemetery expects it to be done as required and billed in the year conducted. See test dates below.
3. If routine testing or inspections identify deficiencies or equipment failures (e.g., a failed spill bucket, faulty line leak detector, or defective overfill valve), is the contractor responsible for the cost of parts and labor for repairs under this Firm-Fixed-Price contract, or will repairs be handled via a separate service order or contract modification?
Response: PWS 2.2.1.g. The contractor shall report any deficiencies or failures to the COR along with a quote for repairs. Repairs will be awarded separately from this contract.
4. To ensure accurate pricing and staƯing plans, could the Government provide the specific details of the UST system at Miramar National Cemetery, including the number of tanks, their capacities, the products stored (e.g., unleaded gasoline, diesel), and the manufacturer/model of the automatic tank gauging (ATG) monitoring system?
Response: See PWS 2.2. The underground storage tank consists of one (1) split tank located at Miramar National Cemetery Maintenance Yard. The tank has a capacity of six hundred (600) gallons diesel and four hundred (400) gallons gasoline. The system is configured with a vapor recovery system as per PWS 2.2. ATG is unknown.
5. The scope of work requires coordination and testing with the San Diego Air Pollution Control District (SDAPCD). Are any SDAPCD permits, filing, or witness fees to be paid directly by the Government, or must the contractor include these regulatory fees within their FFP CLIN pricing?
Response: All permits and fees shall be paid by the contractor.
6. Will the contractor be permitted to temporarily shut down fueling operations during testing (such as during Phase I/II Enhanced Vapor Recovery and line leak testing), and are there specific hours or days of the week when this testing must be performed to minimize disruption to cemetery operations?
Response: PWS 2.2.2. Yes. The contractor may shut down fuel operations as long as it doesn’t interfere with cemetery operations and after giving five (5) days’ written notice that the system will be shut down. This will allow cemetery staƯ to fuel vehicles ahead of any shutdowns. Shutdowns can occur Monday through Friday between the hours of 8:00am and 4:00pm. Shut downs must be restored prior to the end of the work day.
7. The solicitation states that Phase I and Phase II Enhanced Vapor Recovery (EVR) equipment testing (pre-test and final test) must be conducted within 12 months. Please clarify if this EVR testing is required annually for every year of contract performance, or if it is a one-time requirement during the Base Year.
Response: PWS 2.2.2. The Phase 1 and Phase II Enhanced Vapor Recovery (EVR) equipment is an annual test and shall be conducted every year of contract performance and in accordance with State, County, and City guidelines.
8. Tank Tester License Requirement
PWS requires the contractor to hold a California Tank Tester License. We would like clarification regarding the basis for this requirement. The existing system is described as a split tank with secondary containment, and the scope includes inspections, testing, certifications, and regulatory compliance activities.
Could the Government please clarify which specific testing, inspection, or compliance activities under this solicitation require a California Tank Tester License? If the license is not required for the identified scope, would the Government consider removing this requirement?
Response: PWS 3.3 states licensing requirements. The Government will not remove these requirements.
9. Secondary Containment Testing
What is the most recent date that Secondary Containment Testing was performed on the UST system?
Response: The last test was conducted on 8/4/20206.
10. Overfill Prevention Equipment Inspection
What is the most recent date of the Overfill Prevention Equipment (OPE) Inspection?
11. Monitoring System Certification
What is the date of the most recent Monitoring System Certification?
12. APCD Testing / Permit to Operate
What is the date of the most recent Air Pollution Control District (APCD) testing performed on the system?
13. Could the Government provide a copy of the current Permit to Operate (PTO)?
Response: The Permit will be provided to the awardee and will not be disclosed in the solicitation.
14. Most recent dates for:
Release Detection Equipment Testing (Monitor Certification) & Spill Bucket Testing Response: The last test was conducted on 8/4/20206.
Vapor Recovery Testing Response: The last test was conducted on 8/4/20206.
SB989 Secondary Containment Testing Response: The last test was conducted on 8/4/20206.
Overfill Prevention Testing Response: The last test was conducted on 8/4/20206.
Designated Operator Inspection
15. What is the current UST inventory at Miramar National Cemetery (number of tanks, capacity, stored product, tank/piping material, and installation date), and what leak-detection and monitoring equipment (e.g., ATG, interstitial sensors) is already installed?
This directly drives the level of effort for tightness testing, cathodic protection survey needs, and monitoring-certification method.
Response: The underground storage tank consists of one (1) split tank located at Miramar National Cemetery Maintenance Yard. The tank has a capacity of six hundred (600) gallons diesel and four hundred (400) gallons gasoline. The system is configured with a vapor recovery system as per PWS 2.2.
16. Beyond "leak monitoring certification, overfill prevention, and training," does the scope require the full suite of California UST compliance testing under CCR Title 23, Div. 3, Ch. 16 (e.g., annual/triennial cathodic protection testing, line leak detector testing, spill/overfill equipment functional testing), and must the performing technician hold California-specific ICC UST Service Technician/Installer certification recognized by the County of San Diego
DEH (CUPA)?
Response: Yes.
