Document Number: 36C78625Q50209 PROCESSED Page 9 of 52
Guards should be recognized solely as employees of the contractor and not as VA staff members. Any issues concerning personnel should be directed to the contractor rather than VA personnel.
14. Contractor Employment Criteria: The contractor is prohibited from hiring any individual for work under this contract who is known to pose a potential risk to the health, safety, security, overall welfare, or operational mission of the VA or those at facilities outlined in the Statement of Work. If a guard is accused of misconduct and such allegations reach the CO, said officer has authority to demand immediate suspension of the guard from contract duties pending further investigation by the NCA or local law enforcement agencies. Guards may only return to work upon receiving written clearance from the CO.
15. Conduct and Facility Usage: Contractors must ensure that while on federal property or any facility specified in the Statement of Work—whether on duty or off duty, and regardless whether the guard is in uniform or not—guards shall adhere to these standards:
15.1 Guards shall maintain professionalism in appearance and conduct at all times.
15.2 Guards are expected to display proper decorum, politeness, and respectfulness; any form of shouting, profanity, aggressive behavior, sleeping on duty, intoxication, reckless driving, or criminal activity will result in immediate expulsion from site.
15.3 The Government accepts no liability for loss or damage to Contractor's property;
no personal use telephone services will be provided for Contractor's staff. Contractors are responsible for cleanliness and maintenance within areas used by their employees.
15.4 Contractor staff must park personal vehicles in designated areas meant for general visitors.
16. Personnel Awareness: Contractor is responsible for ensuring its employees are fully informed about all aspects detailed in this contract concerning their responsibilities and behavior throughout its duration. Should an employee's conduct negatively impact regular VA operations, the Government retains authority to request removal by the contractor.
16.1 Contractor employees must receive adequate training relevant to their duties under this contract including adherence to OSHA safety standards; they should leave work areas clean and undamaged post-duty completion. All reasonable measures must be taken by contractors to safeguard government property within work vicinities.
17. Safety Measures: In executing duties under this contract, contractors are obligated to take necessary safety precautions conducive to protecting lives and well-being of individuals at assigned locations.
Guards must place appropriate warning indicators around any areas posing traffic disruptions or personal risks due to ongoing operations.
18. Security Screening Requirements:
18.1 Before guards are deployed by the contractor to engage in duties as per this contract, they must be vetted through a background check conducted by the contractor.
This is to affirm that there have been no arrests or convictions related to felonies or misdemeanors involving drugs, weapons, arson, theft, assault and battery, or any other violent offenses affecting individuals or property in the last decade. Additionally, guards are required to clear the National Agency Check with Written Inquiries (NACI) before commencing their contractual tasks.
18.2 The financial responsibility for conducting these background investigations rests with the contractor, whether it is paid upfront or as a reimbursement to the Government.
The Government will determine the sensitivity level based on the nature of access needed by personnel. This sensitivity level will dictate both the extent of the investigation and its associated costs. Current estimated expenses and types of investigations can be
Document Number: 36C78625Q50209 PROCESSED Page 10 of 52 referenced at https://nbib.opm.gov/hr-security-personnel/investigations-billing-rates-resources/billing-rates/, noting that these figures may alter over time and should only be considered approximations.
18.3 Information Submission for Background Checks: Contractor is obliged to provide all necessary personal details required for the background investigations, which may include but are not limited to, full names, residential addresses, and social security numbers of the contractor’s staff. The VA will supply comprehensive instructions and support for the submission of requisite documentation needed to conduct the background checks. As per VA Directive 0710, a Security Access Clearance (SAC) must be conducted as part of the initial screening process.
18.4 Pre-Work Clearance: Guards are prohibited from starting their duties until there is confirmation received by either the CO or COR that their background investigation has commenced. All expenses related to conducting these screenings for each contractor employee engaged in this contract shall be covered by the contractor. Continued work performance is contingent upon obtaining a favorable adjudication.
19. Annual Guard Training: The contractor bears responsibility for annual refresher training sessions covering:
19.1 Facility-specific rules and procedures.
19.2 Emergency response policies and procedures.
19.3 Handling security systems on-site effectively.
19.4 Correct use of fire-fighting equipment.
19.5 Traffic control and parking management protocols.
19.6 Supervisors must document provided trainings and report them to the COR.
19.7 Prior to commencing work on this contract—and prior to the exercise of each option period, Contractor must confirm that each guard has received appropriate training that satisfies or surpasses state requirements for unarmed guards.
19.8 For replacements hired during the term of the contract, orientation and training regarding cemetery policies must be carried out by the Program Manager.
19.9 Before any replacement guard begins working on-site—and as part of their yearly certification—Contractors must verify that each has been appropriately trained according to state standards for unarmed guards.
19.10 Any formal training should be conducted by an institution or government agency accredited in accordance with state regulations.
20. Quality Assurance Monitoring: The Government will conduct thorough inspections and assessments of the contractor's work to verify that the services provided align with the contract's stipulations.
Through onsite verification, the COR will ensure that actual performance adheres to the standards outlined in this Statement of Work (SOW). The COR may utilize either the contractor's proposed work schedule or an adjusted variant to document surveillance findings. These documented results will then constitute the official record of the contractor's performance levels. Should there be instances where performance fails to meet set thresholds or is not achieved, the CO or COR is mandated to initiate a

Contract Discrepancy Report (CDR). Subsequently, a Cure Notice will be dispatched by the CO. It is important to note that a Cure Notice can be issued by the CO whenever deemed necessary. If overall contractor performance is inadequate and responses to Cure Notices are unsatisfactory, this may lead to a Show Cause notice being served, which could potentially result in discussions regarding contract termination.
20.1 NCA/Contractor Consultations: To prevent disputes, regular meetings between contractors and/or the project manager with the COR will take place as deemed necessary by the COR to amicably resolve issues at an early stage.
20.2 Refer to Quality Assurance Surveillance Plan (attached) for detailed processes.
21. Property Care and Damages:
21.1 Contractors are accountable for any damage caused to Government property during contract execution.
21.2 Necessary measures must be taken to prevent public harm or damage to third-party property; "public" includes anyone not under direct employment by the contractor.
21.3 Compliance with health and safety regulations is solely under contractors' liability, indemnifying the Government against any ill-effects resulting from contractors' activities.
22. Insurance Obligations: Contractors are required to secure Workers Compensation and Public Liability

23. Observance of Federal Holidays: Recognized holidays falling on Sundays will result on Monday being given as a day off; similarly, when a holiday lands on Saturday, Friday is considered a holiday by U.S Government Agencies—alongside any day designated specifically by the President.
24. Work Schedule: Contractor is required to carry out services daily throughout the entire year, operating 24/7 from 6:00 am HST to 6:00 am HST the following day. Each shift must be staffed with at least one guard and should not exceed a duration of 12 consecutive hours within any given 24-hour timeframe.
25. Compensation for Extra Hours and Holidays: Contractor is responsible for managing their personnel's schedules in such a manner that avoids incurring overtime or holiday pay that would be billed to the Government. Any additional compensation for the contractor’s employees, including overtime and holiday pay, is solely the responsibility of the contractor and will not be eligible for reimbursement by the Government.
