Questions and Answers II
1. Fair and Reasonable Pricing – Total Contract Value
According to open-source Government records (FPDS), the incumbent’s award of $5,477,276.00 for contract VA786-17-C-0013 in October 2016 for 58-months, eventually resulted in total obligations of $6,486,924.00 over a period of 64-months. The 8-month extension to the period of performance does not fully account for the 18% increase in cost.
Q – Can you please provide the total OY-4 contract obligations against the respective 2016 CLINs and specify/quantify any modifications or changes to the 2016 CLINs or scope of work to account for the increased obligated funds vice initial awarded funds?
Ans – OY4 Contract Obligations are as follows:
· Continuous Resolution (CR) I = $346,806.00; POP: 10/01/2020 – 11/30/2020
· Continuous Resolution (CR) II = $86,753.00; POP: 12/01/2020 – 2/26/2021
· Continuous Resolution (CR) III = $836,885.00; POP: 2/27/2021 – 9/30/2021
· Total FY21 De-obligations = $45,301.00 + $10,128.00 = $55,429.00
· Total Awarded after De-Obligations = $1,270,444.00 - $55,429.00 = $1,215,015.00
· Total Negotiated Value of Option Year IV = $1,192,708.00
· Difference between Awarded Modifications and Negotiated OY IV = $1,215,015.00 - $1,192,708.00 = $22,307.00.
Part II Ans – Extension of six (6) months was granted to the incumbent. As it relates to wanting specific CLIN information, CLIN information is considered to be proprietary information and that information will not be disclosed.
2. Fair and Reasonable Pricing – Contract Value and Tree Trimming Government records (FPDS) indicate two additional contracts for tree trimming during the principle grounds contract (VA78617C0013) period of performance. Issued as Purchase Orders (POs) 36C78618P0744 in July 2018 and 36C78621P0315 in July 2021, the two efforts totaled approximately $137,330. Further, VA78617C0013, Modification 00029 for $492,563.00 was described as, “The purpose of this MOD is to fund the Tree Trimming and Removal services from to the Long Island National Cemetery. PoP is 10/01/2021 thru 11/30/2021.”
Q - Were the two POs in addition to the 300-Hours (CLINs X05) during the respective Option Ans – Because a specific CLIN has been identified, it is an indication of proprietary information.
Q- Did the Government utilize all 300-Hours in CLINs X05 during the Base, and Option Years 1 thru 4?
Ans – Because a specific CLIN has been identified, it is an indication of proprietary information.
Q - Can you please clarify the level of effort and scope of work for Mod 00029?
Ans – The incumbent was granted a six-month extension of services, while the government resolicit for new services. The scope of work matches the services performed by the Contractor, per the contract, during that time of the year. Disclosing the specific CLINs executed, and their quantities is considered to be proprietary information.
Q - Did the Government subsequently deobligate any VA78617C003 CLINs X05 (Tree Pruning / Trimming / Removal) funding due to the above similar services short-term POs and the price-significant Mod 0029?
Ans – Because a specific CLIN has been identified, it is an indication of proprietary information.
3. Fair and Reasonable Pricing – Contract Value and Debris Cleanup
Government records indicate a definitive contract for Emergency Storm Cleanup between 14 Aug 2020 and 13 Oct 2020 - during the principle grounds contract (VA78617C0013) period of performance. The contract appears to be sole-sourced to the incumbent grounds contract service provider for a total of $221,430. Neither the 2016 (A.4.3) nor the 2022 (B.6.6) Work Statements address emergency clean-ups. The 2016 CLINs X03 were for 33 jobs, while the 2022 CLINs are for 52 (weekly) jobs.
Q - Did the Government subsequently deobligate funds to the principle grounds contract (VA78617C0013) due to any work-stoppage or inability to perform work as a result of the damage caused by Tropical Storm Isaias?
Ans – This information sort is considered to be confidential and therefore Not Releasable.
Q - If funds were obligated, can you please specify the CLIN and respective amount?
Ans – No. This information sort is considered to be confidential and Proprietary Information.
Q – Can we expect the 2022 Work Statement to be modified to include capability to respond to emergency tree care and/or storm cleanup?
Ans - This question is too speculative to provide an immediate answer. In the event of an emergency, the cemetery will then submit to the Contracting Department an iPR (funding document) for specific services to remedy the emergency.
