19. GOV Response: Confirmed.

20. Does the contract includes liquidated damages? If the owner temporarily shuts down or suspends the project (i.e. for noise), will extended general conditions cost and time be added to the contract?

20. GOV Response: See Section F.2 52.211-12 LIQUIDATED DAMAGES – CONSTRUCTION (SEPT 2000) (pg 9 of 66) of the solicitation.

21. We anticipate certain construction activities to generate high levels of noise. Please confirm that only the Contracting Officer can suspend work via written notification to the Contractor.

21. GOV Response: Confirmed.

22. Can the owner confirm that the General Contractor is to not include any Asbestos or Lead Removal?

22. GOV Response: Asbestos and lead abatement is not anticipated as part of the scope of work.

23. Has the work area been checked for asbestos, lead based materials and/or other hazardous materials? Is there a report available?

23. GOV Response: See response to question 22.

24. What is the Governments’ policy if asbestos products are encountered during construction?

24. GOV Response: It is the responsibility of the Contractor to notify the Contracting Officer promptly and before such conditions are disturbed of the possible presence of asbestos pursuant to the Differing Site Conditions clause. A laboratory analysis of suspected material will be completed at the direction of the Contracting Officer at Government expense. If the test proves to be positive, the Contractor may be required to hire a Certified Industrial Hygienist at Government expense. He will determine how and the cost to remove the asbestos. The Contractor will then submit a cost proposal to the Contracting Officer based on the findings of the Certified Industrial Hygienist.

25. Is a bond required? What is the % required?

25. GOV Response: A bid guarantee is required and is 20% or $2 million, whichever is less. See far

26. Please confirm that only the original sealed bid is required.

28. GOV Response: Yes.

29. Attachment 5, Contractor Cost Estimate Worksheet. Can we use our own breakdown format?

29. GOV Response: No.

30. Is SWPPP plan submitted and approved by government and applied to this site? Whereas, contractor does not have to register with NPDES/Indiana and apply for a SWPPP.

30. GOV Response: The NPDES permit shall be applied for by the Contractor. Indiana does not require a NPDES certified installer to implement the requirements of the NPDES permit. It is the responsibility of the Contractor to adhere to requirements of the NPDES permit and keep the SWPPP on site and up to date to changing site conditions.

31. Drawings state contractor to obtain permits for project. What permits are required? Is there a building permit with city of Marion required?

31. GOV Response: Contractor shall be required to obtain all permits applicable to the project including but not limited to NPDES permit, land disturbance permit, and drainage permit.

32. Have the SWPPP fees been paid to the local and state NPDES registration? Ie. Contractor does not need to include SWPP state registration fees.

32. GOV Response: Contractor is responsible for applicable fees to obtain NPDES permit and other permits as required for project work.

33. Drawing CG-103 chain of responsibility says Owner and contractor are co-permitees for the North Dakota Pollutant discharge system (NDPDES) construction permit. Is there a reason for North Dakota SWPPP plan? How does North Dakota vary from the State of Indiana compliance?

33. GOV Response: NDPDES is noted in error. Chain of responsibility is to NPDES.

34. Granite section markers, as shown on 8/LC-503 show frost depth as not defined. Please provide actual length dimension required for frost line from Architect/Engineer of record.

34. GOV Response: Frost dept is 3’-0” per geotechnical report. See sheet SS000 (sheet 32 of 46) for further information.

35. Bid Date submission is set for 10AM Monday August 23. Will the VA please consider moving bid date and time to another day than Monday? Typically, Mondays limit subcontractor, vendor, and suppliers timely submission of required pricing. This limits contractor competitiveness for the government.

35. GOV Response: Bid due date extended until Wednesday, September 1st.

Virtual Bid Opening: (872) 701-0185, Conference ID 223 969 067#.

36. The POP for this project is 270 days (aprx 9 months). This POP duration seems too tight considering the amount of earthwork needed for preparation of site for crypt installation.

36. GOV Response: The period of performance is 270 calendar days.

37. The POP for this project is 270 days (aprx 9 months). This POP duration seems too tight when also considering time for submittal, purchase, manufacturing, delivery, and installation of crypts in earth, after earthwork preparation.

37. GOV Response: See response to question 36.

38. Drawing O-100 Note 12 calls for site fencing and shown on drawing D-101. There are no details, sections, or information on required makeup of this temp fencing. Please provide temporary fencing for bid pricing.

38. GOV Response: See specifications section 01 00 02 GENERAL REQUIREMENTS – 1.5 OPERATIONS AND STORAGE AREAS – 1 for construction fencing requirements. In addition to the chain link construction fence, screening shall be provided with a minimum of 90% blockage.

39. Spec section 02 21 00 Site Surveys requests contractor to provide perform a site survey of land, public documents, title searches, easements, possession, ownership, topographic survey, layout of all buildings, markers, boundaries, utilities, etc. Additionally, spec section requires contractor professional land surveyor to work with the government's architect to produce CADD files, vicinity maps, plats, surveys, contour maps, survey boundaries, etc. All of this information has been provided by the governments Architect/Civil Engineer of Record in the solicitation drawings as shown on the site civil drawings CS-101 -CS-107.

We assume that it is not the intent for the contractor to re-create civil drawings, design, layout, plats, etc as required in spec section 02 21 00 as that information has already been provided to the contractor.

39. GOV Response: Specification section 02 21 00 refers to any additional survey work required if existing conditions differ from the signed PDF drawings.

40. Granite Section markers, as shown on 8/LC-503 do not have required color or material type provided in spec section 09 06 00 Schedule. Please provide granite type and color.

40. GOV Response: See sheet LC-503, Detail 8. New section markers shall match existing granite color and type. Shop drawings and samples will be required to be provided by the Contractor for review/approval.

41. Boring Logs on BL-101 water level observation note (at bottom of log) show water was not observed at the time of boring and at boring completion; however, water level observations are shown on the table in depth below existing grade. The borings were made in dry season (July 2020). The site observation / boring / soils reports are not included in RFP to draw conclusion based on the professional engineer’s observations. Please provide by amendment, copy of the site observation/boring/soils report completed in July 2020 along with the professional engineer’s final report.

41. GOV Response: Geotechnical report will be provided as an addendum.

42. Spec section 31 23 19 dewatering included with RFP. Boring Logs on BL-101 show water level observations are lower that subgrade for the crypts. It is unclear with this spec section was included in the RFP for wellpoint type dewatering requirements. However, conclusions for proposals cannot be made without reviewing the professional engineer’s report along with the site observation/boring/soils report conclusions. Please provide copy, by amendment, the site observation/boring/soils report along with the professional engineer’s report conclusion.

42. GOV Response: Section 31 23 19 Dewatering is included as an option should site conditions require dewatering due to unusually high precipitation and infiltration. It is not anticipated that dewatering will be required due to groundwater.

43. Spec section 31 23 19 dewatering requires professional design with sealed engineered drawings for dewatering systems. However, the drawings and civil design do not show or indicate locations/requirements for any dewatering systems. Please provide locations and requirements for dewatering on the civil plan by amendment.

43. GOV Response: See response to question 42.

44. The RFP POP is 270 calendar days. It appears that project could be awarded by end of fiscal year FY 2021 / Sept 30th. NTP stated at 10 days after award. Has weather and winter season been factored with the RFP to account for typical weather days within the 270 days? Weather day historical data has not been included in the RFP for Marion, IN. If work proceeds accordingly to stated days in this RFI, the work will begin and proceed during the fall and winter months. It seems that 270 calendar days is not realistic due to amount of earthwork to be performed over the winter season. Has weather/winter been factored in the government’s 270 POP for the project?

44. GOV Response: Yes.

45. There will be significant soils removal in the earthwork operation for the crypt area of work. A significant amount of topsoil and backfill will need to be stockpiled for the completion phase of the crypt installation for coverup. There is a limited space/area for stockpiling with this site/cemetery. Drawing O-100 operations drawing does not show or indicate area(s) for soils stockpiling. Please indicate location where soils can be stockpiled.

45. GOV Response: Sheet O-100 indicates a staging area. This area can also be used for stockpiling of soils as needed, provided that permission is obtained from the Cemetery Director and VA Medical Center staff. Additionally, the area demarked as “Future PPC Section 15” on Site Plan sheet CS-101 (pg 7 of 46) can be used for stockpiling of soils and staging area.
