A4. Cost Range

The anticipated cost range for this project is between $4,769,000 and $5,614,000.

A5. Pre-Proposal Conference

A pre-proposal conference will be conducted for Phase II of the Design-Build process. The most highly qualified firms selected to proceed to Phase II will be invited to attend the pre-proposal site visit. The Contracting Officer will establish the date, time, and location, and will notify the Phase II offerors in writing. See Federal Acquisition Regulation (FAR) Clause 52.236-27 of this solicitation.

A6. Proposal Evaluation

A. This is a two-phase procurement. The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal represents the best value after evaluation in accordance with the factors in the Two-Phase Design-Build solicitation. Responsibility determination will be made in accordance with FAR 9.1, Responsible Prospective Contractors.

00 11 21-3

B. In Phase I, the Offerors will submit a Phase I proposal in accordance with the three (3) evaluation factors listed in C3. Upon receipt of the Phase I proposals, the VA team will evaluate and determine the highest qualified Offerors based on their Phase I proposal submissions. The Phase I proposals will only be evaluated on the three (3) evaluation factors listed.

C. In Phase II of the two-phase selection procedure, the short-listed offerors will submit Phase II proposals in accordance with the evaluation factors listed in D3. The Government may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals, considering price and technical merit.

D. The Government intends to evaluate all complete and conforming proposals received and award the contract without conducting discussions; therefore, your initial proposal shall conform to the solicitation requirements and should contain the best offer. However, the Government reserves the right to clarify certain aspects of the proposals, or may conduct discussions if it is deemed necessary to obtain the best value for the Government. If discussions are deemed necessary to maximize the Government’s ability to obtain the best value, discussions will be held only with those Offerors within the competitive range.

E. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

F. Exceptions to Solicitation Requirements. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award.

Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Provide rationale in support of the exception and fully explain its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation. This information shall be provided in the format and content of the below example Table 1. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being removed from consideration for award.

A7. Basis of Award

A. Upon receipt of offers, the Government will conduct a preliminary review of all offers to determine whether the proposal contains sufficient information, as required in the OFFEROR INSTRUCTIONS/SUBMISSION, to allow the Government to perform a meaningful evaluation. If the results of the preliminary review indicate the offer lacks sufficient information to allow a meaningful evaluation to be conducted, the Government may eliminate the proposal from further evaluation and consideration for award. As one part of the preliminary review, the Government will determine whether the offeror is a SDVOSB in the Vendor Information Pages (VIP) at www.vip.vetbiz.gov. An offeror that that is not verified in VIP at the time of proposal submission will not be evaluated and will not be considered for award. An offeror with less than 220 days for acceptance will not be evaluated and will not be considered for award (refer to Instructions to Offerors).

B. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract(s); to negotiate with offerors in the competitive range; and to award the contract(s) to the offeror(s) submitting the proposal(s) determined to represent the best value—the proposal(s) most advantageous to the Government, price and other factors considered.

C. This is a competitive RFP that represents the best value to the Government conducted under FAR Part 15 101-1, Tradeoff Process. In accordance with FAR 15.101-1, all evaluation factors, other than cost or price, when combined, are approximately equal to cost or price. Thus, award will be made to the firm whose Phase I proposal was initially evaluated as most highly rated and who now offers a Phase II proposal, which based on both its technical and pricing proposals, offers the overall best value to the Government. This may result in award being made to a higher-rated, higher priced offeror where the Contracting Officer determines that the technical capability and past performance of the higher-priced offer outweighs the cost difference.

B. PART II – RESPONSIBILITIES.

B1. VA Team

A. The VA team is comprised of VA VISN 21 Capital Asset Management located in Mare Island, CA, a Contracting Officer Representative who will be located at the construction site, and VA medical center staff. The Contracting Officer will maintain overall authority https://nam12.safelinks.protection.outlook.com/?url=http%3A%2F%2Fwww.vip.vetbiz.gov%2F&data=01%7C01%7Cthower%40concoursefederal.com%7C72c347564af24ae4397708d81c7522d3%7C9cc4232ae0cb4fb891a3529e75355180%7C0&sdata=aKwDPJSOh0zLVRcl4VfKGdPZN0ilU18mdXCZ5wMPfhc%3D&reserved=0

3. Offerors without relevant PPIRS/CPARS records can provide references for their past performance by providing a minimum of two past performance questionnaires for relevant and recent projects. Offerors shall use the included questionnaire form in Attachment B - Past Performance Questionnaire, for this purpose.

C4. Evaluation of Offers (Phase I):

A. Phase I evaluations will be conducted in accordance with the Two-Phase Design-Build Evaluation process and the methodologies outlined below. For evaluation purposes, each technical factor and sub-factor is equal in importance.

1. Factor 1, Technical Approach: Will be evaluated based on the Offeror’s proposed technical approach for this design-build project as defined in the solicitation submittal requirements.

The assessment of the offeror’s method to manage the project shall be used as a means of evaluating the offeror’s ability to successfully meet the requirements of the solicitation.

2. Factor 2, Technical Qualifications: Will be evaluated on the Offeror’s specialized experience and competence and capability to perform. Specialized experience and competence be evaluated by narrative provided by the Offeror and relevant and recent experience of design-build and/or design-bid-build contracts of comparable size, complexity and scope within the last five (5) years. Capability to perform will be evaluated based on whether the Offeror has adequate total bonding capacity and available bonding capacity to accommodate the design and construction of the project.
