About this file

This document is a Responses to Questions/RFI/Clarifications for Solicitation Number 36C26327Q0019, a federal contract opportunity for replacing operating room flooring at a VA facility.

The project involves replacing flooring in Operating Room 5 (600 square feet) with heat-welded sheet flooring that must closely match existing vinyl flooring. Key clarifications include: asbestos abatement, if found during required surveying, will be handled by contract modification rather than included in the base firm-fixed price; the superintendent may serve as the Site Safety and Health Officer; all subfloor material must be removed down to the structural deck due to undetermined composition; and heat-welded sheet flooring is required per SOW section 17.2. The contractor must complete all work, including grinding and subfloor removal, during approved hours specified in SOW section 10 (Monday-Friday 1400-2100 hours and Saturday-Sunday 0800-1900 hours); tools transmitting vibration and noise during these approved times are acceptable. The new flooring must be domestic construction materials in accordance with Buy American requirements; foreign-manufactured products will not be considered regardless of equivalency. This is a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside classified as special trade construction under VAAR 852.219-75, requiring that no more than 75 percent of amounts paid by the Government, excluding material costs, go to non-certified SDVOSB/VOSB firms; amounts paid to certified SDVOSB/VOSB subcontractors are excluded from this limitation. If the quote exceeds $35,000, the awardee must provide either a payment bond or irrevocable letter of credit within 10 days after award. Davis-Bacon wage determination IA20260071 does not contain a resilient floor layer classification; offerors must submit SF-1444 to the Department of Labor following award to request authorization of the required classification and rate.

Solicitation Number: 36C26327Q0019 Project Name: Replace Operating Room 5 Flooring

Responses to Questions/RFI/Clarifications

Q: Abatement. The SOW requires an asbestos survey (2.1.1.5), and Specs 02 82 11 and 02 82 13.19 are included. If the survey finds asbestos in the flooring, mastic or subfloor, is abatement part of the base firm-fixed price, or will it be handled by modification? If it is in the base price, please give the assumed quantity and material type.

A: It will be handled by modification. Surveying, per the SOW, is all that is currently part of the statement of work (SOW section 2.1.1.5).

Q: SF. Attachment B measures about 507 SF; SOW 18.2.1 estimates 600 SF. Which should offerors price?

A: 600 square feet as stated in the revised SOW (SOW section 18.2.1).

Q: Room 4211. Please confirm the subfloor makeup and depth to the deck, or share any prior survey, test reports or as-builts for Room 4211.

A: The subfloor composition is undetermined. For this reason, the statement of work specifies removal of all existing material down to the structural deck (SOW section 2.1.1.6).

Q: SSHO. Does 01 35 26 1.9 require a dedicated, full-time SSHO separate from the superintendent for a project of this size, or may the superintendent serve as SSHO?

A: The superintendent may service as the SSHO (SOW section 4.1.5.2).

Q: WD. Wage Determination IA20260071 has no resilient floor layer classification. Which classification should offerors use for pricing?

A: When a wage determination incorporated into a Davis-Bacon covered contract does not contain a classification needed for work the contract requires, the classification and wage rate must be added through the conformance process set forth at 29 CFR 5.5(a)(1)(ii)-(iii). This requires formal submission to and approval by the Department of Labor's Wage and Hour Division (WHD). The SF-1444 (Request for Authorization of Additional Classification and Rate) will need to be completed following award.

This form can be located at the U.S. Department of Labor's website: Davis-Bacon and Related Acts | U.S. Department of Labor.

Q: Heat-weld. Section 09 65 16 includes both chemically welded (2.3) and heat-welded (2.4) sheet flooring. SOW 17.2 mentions heat-weld seams. Please confirm heat-welded sheet flooring (WSF) is required.

A: Heat-welded sheet flooring is required (SOW section 17.2).

Q: Mockup. May the 100 SF mockup (09 65 16 1.5.B) be part of the OR installation once the COR approves it?

A: Yes.

Q: Hours for grinding and subfloor removal. Ref: SOW 2.1.1.6 and 10.1–10.2; Spec 01 00 00, 1.6.G; Spec 01 57 19, 1.5 (Reduction of Noise). SOW 10 limits contractor work to Mon–Fri 1400–2100 and Sat–Sun 0800–1900. Spec 01 57 19 allows repetitive high-level impact noise only from 8:00 a.m. to 3:30 p.m.

Will the VA permit grinding and removal of the existing subfloor during the SOW 10 approved hours, or must this work be scheduled in other specific hours (for example, weekends or after OR cases end) to minimize disruption to facility operations?

A: As specificized in the SOW, the contractor shall complete all work under this contract during the times identified by the SOW. Tools that transmit vibration and noise during approved construction times are acceptable (SOW section 10).

Q: Existing flooring specifications. Ref: Spec 09 65 16, 2.3.A.4–5; SOW 2.2.1.1. The specification requires the new flooring color, pattern and finish to closely match the existing flooring, with samples submitted for COR approval before procurement. Can the VA provide the manufacturer, product name or number, and color of the existing flooring to help identify a suitable match for pricing?

A: See attachment titled “Existing Operating Room 5 Vinyl Flooring Images” for existing flooring visual.

Other documentation pertaining to manufacturer, product name or number are unavailable.

Q: Flooring from manufacturers outside the United States. Ref: RFQ 2.4 (FAR 52.225-10, Notice of Buy American Requirement—Construction Materials) and 4.3 (FAR 52.225-9, Buy American—Construction Materials); Spec 09 65 16, 2.3–2.4. Would the VA consider equivalent flooring products from manufacturers outside the United States, provided they meet all solicitation requirements, technical specifications, and quality standards? If so, should offerors submit the 52.225-9(c) and (d) information with the quote, and will the 20 percent evaluation factor under 52.225-9(b)(3)(i) be applied?

A: No. The Government will not consider foreign-manufactured flooring solely because it is equivalent to the specified domestic product or otherwise meets the solicitation’s technical and quality requirements. In accordance with FAR subpart 25.2 and FAR 52.225-9, construction materials must be domestic construction materials unless an exception to the Buy American statute applies.

Q: The solicitation includes the VAAR 852.219-75 Certificate of Compliance with the special trade construction limitation indicated (no more than 75% of the amount paid by the Government, cost of materials excluded, to firms that are not certified SDVOSBs/VOSBs). Please confirm that the special trade construction prong governs this requirement.

A: The requirement is classified as special trade construction for purposes of VAAR 852.219-75.

Accordingly, the special trade construction limitation applies. The contractor may not pay more than 75 percent of the amount paid by the Government, excluding the cost of materials, to firms that are not certified SDVOSBs or VOSBs, consistent with the terms of the clause.

Q: If we team with a performing subcontractor that is itself an SBA-certified SDVOSB (a similarly situated entity), please confirm that amounts paid to that subcontractor are not counted toward the 75% limitation.

A: Amounts paid to a subcontractor that is a certified SDVOSB or VOSB will not be counted toward the 75-percent limitation, provided the subcontractor meets the applicable certification and eligibility requirements and the arrangement complies with all other terms of the solicitation and VAAR 852.219-75.

Q: Please confirm the payment protection required if our quote exceeds $35,000 (payment bond or irrevocable letter of credit), and the timeframe and address for furnishing it after award.

A: If a quote is over $35,000, the quoter will be required to provide one of the two alternate payment protections within 10 days after award.

• A payment bond

• An irrevocable letter of credit (ILC)
