About this file
This is a Questions and Answers document issued by the Department of Veterans Affairs (VA) Network Contracting Office 23 (NCO 23) addressing inquiries from offerors regarding RFQ 36C26326Q0278. The document, dated 08 April 2026, was issued by Mr. Emanuel Nevarez, Contracting Officer for Service Supply Team 2 (SST 2).
The Q&A addresses two primary concerns raised by industry regarding chiller maintenance and repair services. In response to the first question regarding establishment of a not-to-exceed (NTE) amount for as-needed repairs affecting CLINs 0002-4002 and 0004-4004, the government declined to establish a stand-alone NTE for open-ended use, citing concerns about funding control, price reasonableness, and contract administration. Regarding the second concern about the SOW structure requiring contractors to absorb repair, parts, and rental equipment costs under a fixed threshold of $25,000 for specialized York YMC2 magnetic bearing chillers, the government clarified that referenced paragraphs requiring such absorption have been removed in the latest amendment and that repair and replacement actions may be performed on a case-by-case basis with Contracting Officer approval based on contractor-provided findings and cost estimates. The government also granted an additional one-day extension beyond the original three-day extension to allow offerors time to incorporate any clarifications or amendments into their responses.

Date: 08 April 2026
From: Mr. Emanuel Nevarez, Contracting Officer, Service Supply Team 2 (SST 2)
Subj: RFQ 36C26326Q0278 Questions and Answers From Offerors / Bidders
Purpose: Respond to questions and clarify verbiage regarding RFQ 36C26326Q0278.
1. Due to the unpredictable nature of chiller component failures and the wide cost range associated with parts, refrigerant recovery/recharge, major component replacements, and temporary rental equipment, it would be extremely difficult to provide an accurate estimate for all potential repairs. Would the VA be open to a not to exceed amount (NTE) to be utilized on an as-needed basis each year? This will affect both CLIN 0002-4002 and CLIN 0004-4004.
Unfortunately, the government does not intent to establish a stand-alone not to exceed Amount for open-ended or as needed use, as this approach may limit the VA’s ability to ensure proper funding control, price reasonableness, and contract administration.
2. Based on industry feedback, we respectfully highlight a concern regarding the current structure of the SOW—specifically the requirement for the contractor to absorb repair, parts, and rental equipment costs under a fixed threshold (e.g., $25,000).
For highly specialized equipment such as York YMC2 magnetic bearing chillers, this structure introduces a level of financial and operational risk that may limit participation from qualified OEM providers. As a result, this may unintentionally reduce competition and restrict the Government’s access to the most experienced service teams for this equipment. To support full and open competition among qualified SDVOSB primes and their OEM partners, we respectfully request consideration of the following:
Clarification or modification of the SOW to separate preventive maintenance services from repair and replacement work.
Referenced paragraphs have been removed in latest amendment.
Allowance for repair and replacement actions to be performed on a case-by-case basis with Contracting Officer approval, based on contractor-provided findings and cost estimates.
This is already part of the SoW.
