Please see attached Vendor Questions Set 2. Additionally, attached is the updated SOW which reflects changes due to questions posed.

Supplemental information has been added to the solicitation which provides more information on the elevators to be tested and inspected.

FAR Clause 52.237-3 has been added to address concerns about damage to government property while performing the elevator testing.

Questions concerning Solicitation:

36C26322Q0964: Elevator Testing & Inspections St. Cloud, MN VA Medical Clinic

1. Will you provide a template for the Semi-Annual Testing Checklist, if different than A17.2 Appendix E Checklist and Report for Inspection of Hydraulic Elevators?

A: The State of Minnesota provides a checklist to be completed during testing and inspection services. The Minnesota testing checklist for both traction and hydraulic elevators is included with this amendment. The SOW has been updated to reflect these changes. The COR on the contract will deconflict any checklist inconsistencies with the ASME and/or any further questions surrounding checklists or reporting.

2. Does ASME code 8.6.5.16.5 apply? If so, the code states the valve must be tested with a written procedure by the valve manufacturer or the person or firm maintaining. Provide at least the valve manufacturer for each unit in the “Elevators to be inspected and tested” listing. Overspeed valve test to performed A17.1-2016 8.6.5.16.5 and does require full load testing.

A: The facility is gathering the Make, Model and Size of each elevator and possibly getting a testing procedure by the manufacturer. The facility is looking into the valve specific information and the manufacturer procedure. Attached is the information for one such valve in the facility. It is a Maxton, Model UC4MR, size STD. Attached is some information by Maxton and also the overspeed valve testing and adjustments sheet. It is believed most of the elevators will have the same valve, but won’t be known until all are assessed.

3. Is a 3rd party QEI certified sub-contractor required for the test witnessing and code inspections?

A: This solicitation is for testing and inspection services as outlined in the SOW. Anything in excess of that will not be covered. If items need to be adjusted within the SOW it will be carried out by a bilateral modification to the contract through the Contracting Officer.

4. Elevator listing – more information is needed. Should add install/manufacturer year, controller model, piston type (hydros only), machine room location (adjacent/remote/overhead), capacity, indication as to if any elevators are simplex or grouped together.

A: See attached Elevator Information sheet for all information currently collected.

5. Is there a specific schedule that must be accommodated for the annual testing in Option year 1? For maximum efficiency, we would suggest completing half of the annuals in June and the remaining half in October. This would allow the 3rd part QEI witnessing of the testing along with the requested QEI code inspection to happen at the same time. Would that be acceptable?

A: The contractor must be able to meet the testing schedule as outlined within the SOW. Refinements to the schedule will only be considered through discussion with the facility POCs after the contract award.

6. Safety testing stress tests the elevator and thus subjects it along with the building to extreme forces to test the safety of the elevator systems. We will take reasonable care in performing this test; however, it is common that components of elevator can fail during testing which can cause damages to it and/or the building. It is understood and agreed that the “Contractor” does not assume any responsibility for any damage to the building structure, damage to any equipment or any injury to any person or persons except for those directly employed by the contractor resulting from the performance of this test.

A: As confirmed through Department of Veterans Affairs Legal Department it is neither agreed nor understood that all responsibility for damage to the building structure, damage to equipment, or injury to any person or persons is lifted from the vendor on this contract. The vendor should use all reasonable care to prevent the damage to VA structures and equipment. FAR Clause 52.237-3: Protection of Government Buildings, Equipment, and Vegetation has been added to the solicitation. Information has also been added to the SOW outlining that while damage due testing may occur. Reasonable care must be exercised to minimize damage to the greatest extent possible. Damage to government buildings and/or equipment due to failure to use reasonable care will be handled in accordance with the FAR Clause.

Statement of Work

Semi-Annual Elevator Inspection and Annual Safety Testing

General Statement: Contractor shall provide all labor, supervision, equipment and tools required to perform Independent Elevator Testing and Inspection Services for the vertical transportation systems located on the campus at the VISN 23 St. Cloud VA Health Care Campus, 4801 Veterans Drive, St. Cloud, MN 56303, in accordance with the Statement of Work. It is the responsibility of the vendor to determine if the equipment is in safe operating condition, that it has not been altered except in conformity to the applicable codes or regulations, and that each elevator (vertical transportation system) will perform in accordance with all applicable inspection requirements. In the performance of this contract the contractor shall take such safety precautions as St. Cloud VA Medical center/Safety and Engineering departments determine to be reasonably necessary to protect the lives and health of occupants of the building.

Testing: The Code, ASME A17.1, requires periodic testing of elevators which is witnessed by a Qualified Elevator Inspector (as defined by ASME QEI-1).

1. Semi-Annual Testing:

a. Conducted in December.

b. During the base year 22 elevators are to be tested.

c. During option year one (if exercised) 25 elevators will be tested in December.

d. During option year two through four (if exercised) 26 elevators are to be tested.

2. Annual Category 1 Testing:

a. Performed for the electric, (traction), and hydraulic elevators conducted in June.

b. During the base year 22 elevators are to be tested.

c. During option years one through four 26 elevators are to be tested.

3. Category 5 Testing:

a. Conducted on two traction elevators in June.

b. Testing required during the base year only.

4. Over Speed Rupture Valve Testing:

a. Conducted during the full load testing period on hydraulic elevators in June for 20 elevators.

b. Testing and adjustments (as needed) required during the base year only.

c. See attached for valve information. Additional information will be provided by the facility.

5. Please Note: If the contractor cannot perform both testing and inspection services the contractor shall be responsible to hire any sub-contractor that maybe needed to complete these services. The prime vendor is responsible in ensuring the applicable FAR clauses concerning subcontracting are followed, clauses can be found below.

Additional Elevators: Four (4) elevators are currently under construction. All additional elevators are hydraulic type. The additional elevators listed below are anticipated to be on the first option year schedule and the remaining option years.

Scheduling: Contractor shall perform annual testing and inspections in the month of June and the semi-annual testing and inspections in the month of December. The vendor shall coordinate all testing and inspections with the elevator maintenance company and the St. Cloud VA Medical Center Contracting Officer Representative (COR) assigned to this service contract. All testing and inspections shall be coordinated a minimum of thirty days prior to testing and inspection dates. Testing and/or inspections that may severely impact elevator service, or incapacitate a bank of elevators, shall be performed after normal working hours and approved in advance by the COR, all other testing and inspections shall be accomplished during normal business hours (7:00AM to 4:30PM Monday through Friday except federal government holidays).

St. Cloud VA Contractor badge shall be worn by all Contractor employees while working on VA premises.

Due to covid protocols, Contractor shall follow VA guidelines as appropriate, currently required to wear a medical grade face mask, which is provided by the door entrance.

Testing and Inspections: Testing and inspections are performed to determine whether the existing equipment conforms to the latest code within the American Society of Mechanical Engineers ASME and conform to any additional standards, rules, regulations, and laws.

It is understood that during testing of the elevators mechanical failures may occur resulting in damage to government property. The vendor must use reasonable care to prevent undue damage to government property and injury to VA visitors and personnel to the most reasonable extent possible. Failure to use reasonable care may result in liability on behalf of the vendor as outlined in FAR Clause 52.237-3.

Qualifications: Testing and inspections must be conducted by licensed personnel in accordance with ASME guidance and Minnesota statutes (found within the MN Department of Labor and Industry website). Testing of the elevators must be witnessed by a Qualified Elevator Inspector (as defined by ASME QEI-1). Additionally, personnel conducting testing must have an OSHA 10 license.

Contracted Payments: This is a one-year base period, with 4 option periods to be paid out as work is completed semi-annually.

Reports: Contractor shall supply a full report, in duplicate, to Facilities Management. The report shall include such things as, suggested adjustments, repairs or replacements needed; as well as a comprehensive check list that follows the ASME code. The State of Minnesota provides a checklist to be completed during testing and inspection services. The Minnesota testing checklist for both traction and hydraulic elevators are attached.

A.1 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
