About this file
This is Amendment 0002 to solicitation 36C26225R0004 issued by the VA Network Contracting Office 22 in Long Beach, CA for Community Based Outpatient Clinic (CBOC) services in El Centro. The amendment modifies Section B.3 of the Performance Work Statement regarding staffing qualifications and licensing requirements, specifying that contractor staff cannot begin work until background investigations are completed by OPM and credentialing requirements are met. Licenses must be provided as part of onboarding rather than with the proposal.
The amendment also answers four questions from potential offerors, clarifying that: 1) contractors can use the VA's after-hours call center for 24/7 telephone access, 2) copies of licenses are not required with proposal submissions, 3) individual employee CBOC management experience does not count as company experience for evaluation purposes, and 4) mental health services will be billed based on actual patients seen through warm hand-offs from primary care, with no pre-assigned patient roster. The original solicitation ID in Contract Opportunities is 36C26225R0004_1. The amendment has an effective date of December 18, 2024.

Alice McGruder Contracting Officer
1. The solicitation is amended as follows:
1. Section B.3 PERFORMANCE WORK STATEMENT, Paragraph 2. STAFFING AND QUALIFICATIONS, 2.8 License and Accreditation, is amended to read:
The contractor shall not permit any staff to begin work at an outpatient site of care prior to confirmation from the VA that the individual’s background investigation has been reviewed and released to the Office of Personnel Management (OPM), by the Security and Investigations Center (SIC), and that credentialing and privileging requirements have been met. A copy of licenses shall be provided by the awarded contractor as part of the onboarding procedures and will be updated annually. Any changes related to the providers' licensing or credentials will be reported immediately to the VA Credentialing Office. In accordance with FAR 52.212-4 Contract Terms and Conditions – Commercial Products and Commercial Services failure to comply with these terms and conditions may result in all rights and remedies provided by law.
2. The following are answers to questions received in response to the solicitation:
1. The RFP states, "Telephone Access to Clinical Care: The contractor shall make provisions for toll free telephone care, twenty-four (24) hours a day, seven (7) days a week, including evenings, weekends, and holidays, for all Veterans." Is it acceptable to the VA if the Contractor uses the VA's after hours call center to provide after-hours telephone access? The VA's response was no. In all of the VA CBOC contracts we operate, our normal process is to use the VA's after hours call center.
And, this same question was asked in the recent Escondido CBOC solicitation and the VA's response was yes the Contractor could use the VA's after hours call center to provide after-hours telephone access. Will the VA allow the Contractor to use the VA's after hours call center to provide after-hours telephone access?
Yes, the contractor can use the VA’s after hours call center to provide after-hours telephone access.
2. The RFP states, "A copy of licenses must be provided with offer and will be updated annually."
Nowhere in the instructions to offer does it mention providing a staffing plan or to provide any licenses. Is a staffing plan and copy of licenses required with the submission of the proposal? The VA's response was, "please see Solicitation Amendments above." However, there is no mention of the licenses in the Solicitation Amendments. Are copy of licenses to be provided with the offer?
No, copies of the licenses are not required to be provided with the offer. Please see solicitation amendment above.
3. Do you consider the experience of one of our employees with extensive CBOC management experience, as an experience for the company?
When evaluating proposals for this procurement, VA does not consider one employee’s experience in CBOC management to be a suitable substitute for an offeror’s experience as a company establishing and operating a CBOC providing Primary Care services to an adult population age 18. VA does not consider one employee’s experience with CBOC management to be relevant because it does not provide a sufficient basis to assess the company’s experience providing the services required by this procurement or to conclude that the offeror is likely to successfully perform these services if awarded a contract. The complex work to be accomplished under this procurement cannot be effectively executed by a single employee, so evaluating the experience of a single employee is not relevant for assessing the risk of a contract award to the offeror. One employee’s prior experience gained while working under the control of a different firm does not demonstrate the offeror’s ability to perform similar work successfully – a firm's corporate experience is different from its staffs' individual experience. VA has a need to assess the corporate experience of the vendor with whom VA might enter into a contract so that VA can properly assess the risk of making a contract award to that vendor. VA will have no contract with the individual employee who may leave the offeror’s employment at any time. As stated in the solicitation, when evaluating proposals for the Experience proposal evaluation factor, VA will consider the offeror’s experience establishing and operating a CBOC providing Primary Care services to an adult population age 18 and older, as well as the experience of proposed subcontractors, if any are proposed. As the solicitation instructs, this experience must be documented in the Reference Contract Worksheet(s) that are required to be submitted with proposals. VA does not consider the experience of an individual employed by the offeror to be the equivalent of experience that the company itself offers for this procurement.
4. “Given the current contract has no MH billable roster and therefore there is no MH rollover roster available; will the VA assign a roster of MH patients that could be billed starting in month 1 of the contract?”
No. The Contractor shall bill for the actual number of Veterans they provide MH services to each month. The MH patients they will be seeing are warm hand offs, whereas for example, a patient will come in to see their primary care provider and mentions they are feeling depressed or have other MH issues. The primary care provider will then “hand them off” to the PCMHI professional the same day. Any further mental health care required will be scheduled and provided by VA mental health staff.
