3.1.2 VOLUME I - Factor 2, Past Performance
The Government will evaluate the offeror's past performance to determine the level of confidence that the contractor will successfully perform the current requirement. The Government will rate an offeror's Past Performance for projects identified in their Offer under Factor 1, Technical Expertise, offeror provided past performance meeting the requirements of this section, and other related experience the Government obtains. The Government may evaluate present and past performance information by using data independently obtained from other Government or commercial sources, including, but not limited to: Government databases; personal business experience with the offeror; and information provided in the Project Information Sheet for Contractors, (EXHIBIT A); Past Performance Reference Forms, (EXHIBIT B). Past Performance will be evaluated utilizing a Performance Risk Rating (see 3.6.4 Past Performance Risk Rating Table below) considering all potential evaluation criteria identified in this section.
- For all projects listed under Factor 1a that have CPARS data available, the offeror shall provide a print out of the final CPARS for each project.
- Past Performance References – REQUIRED – For all projects listed under Factor 1a that do not have CPARS data available, the offeror shall complete and submit a Past Performance Reference Form, (EXHIBIT B).
- If the offeror has any other past performance evaluation/questionnaire available that is not CPARS, they may provide that in addition to Exhibit B for consideration at the Governments discretion.
Offerors lacking relevant Past Performance experience may submit information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement if such information is relevant to this acquisition. Such information shall, as a minimum, include Name(s) of Predecessor Company/Subcontractor and/or Key Personnel and include Complete Address and Point of Contact; Telephone, Fax Number and email address; and a brief synopsis of the experience (a resume may be submitted for "Key Personnel") and relevancy to this project.
Other Past Performance Information The Past Performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated. The Government may contact references and contact parties other than those identified by the offeror, and information received may be used in the evaluation of the offeror’s Past Performance. The evaluation may take into account Past Performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. If multiple subcontractors are provided for the same discipline, the government will use the lowest rated subcontractor in the evaluation. The Government reserves the right to obtain and evaluate Past Performance information from any source it deems appropriate. Evaluation will include the past performance of offerors in complying with subcontracting plan goals for small disadvantaged business (SDB) concerns. For offerors that are joint ventures, the evaluation will take into account past performance of the joint venture. If the joint venture does not demonstrate past performance for award, the contracting officer will consider the past performance of each party to the joint venture.
Past Performance Definitions
- Recency is defined as projects submitted shall be completed within the past five (5) years of the date of issuance of this RFP.
- Relevancy is defined as performance of work on projects that are similar in scope and magnitude of effort and complexities to the type of project anticipated under the resultant contract. Common aspects of relevancy include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.
Past Performance Risk Rating Table To conduct the overall performance risk assessment, the Government may evaluate present and past performance including but not limited to, information using questionnaires completed by the offeror's references; use of Government-wide databases, in part on information from CPARS, data independently obtained from other Government or commercial sources, personal business experience with the offeror, and any performance related information available regardless of relevancy in the development of performance confidence assessments. The evaluation may also consider information provided relative to corrective actions taken to resolve problems on past or existing contracts and trends in performance. The Government may contact references provided by the offeror, as well as any other source it identifies, and information received may be used in the evaluation of the offeror’s Past Performance. The burden of providing current, accurate and complete Past Performance information rests with the offeror. Past Performance information on contracts not listed by the offeror, or that of planned subcontractors, may also be evaluated. Offerors shall be given an opportunity to discuss adverse past performance information if the offeror has not had a previous opportunity to comment on the information. The contracting officer may review recent contracts to ensure that corrective measures raised in discussions have been implemented. If no relevant information on past performance is available for an offeror, the offeror will not be evaluated favorably or unfavorably on past performance. The Government reserves the rights to obtain and evaluate Past Performance information from any source it deems appropriate.
The Government will conduct a performance risk assessment based upon the Past Performance of the offeror as it relates to the probability of successful accomplishment of the work required by the solicitation. Ratings will consider the offeror's Past Performance considering currency, relevancy, sources, context, and trends, using descriptive adjectives that most accurately define the offeror's performance risk considering all potential evaluation criteria identified in this factor. Relevance will be considered in the overall Past Performance rating. An adjectival rating for past performance will be assigned based on the confidence of success on this project, based on recency and relevancy of projects submitted, CPARS evaluations, and personal knowledge.
Past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. It considers each offerors demonstrated recent and relevant record of performance in supplying products and services that met the contract requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the offeror's recent past performance, focusing on performance that is relevant to the contract requirements. (See FAR 15.305).
PAST PERFORMANCE CONFIDENCE ASSESSMENT RATINGS: The SST will use the following ratings and related definitions that will be used to define the performance risk in accordance with the Past Performance Evaluation Sheet (excel) to be provided to voting board members.
3.1.2.5 Past Performance Risk Rating Table
| Rating |
| Description |
| Substantial Confidence |
| Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort. |
| Satisfactory Confidence |
| Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort. |
| Limited Confidence |
| Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort. |
| No Confidence |
| Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort. |
Unknown Confidence (Neutral) No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
3.2 VOLUME II – PRICE EVALUATION: Price – Is NOT the only factor for this requirement. Price will be evaluated on the basis of its fair and reasonableness to the Government. “Best Value” means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. A firm fixed price award will be made to the highest technically rated qualified construction contractor at a fair and reasonable price whose offer conforms to the solicitation, and which results in the best value to the Government, all factors considered.
Offerors shall complete in its entirety, the “Offeror” portion of the Standard Form (SF) 1442. An official having the authority to contractually bind your company must sign the SF 1442 in accordance with FAR 4.102. One copy of the SF 1442 is required to have an original signature. Valid electronic signatures are acceptable.
Offerors shall provide all price information necessary to provide a meaningful basis for Government's analysis and evaluation of price for the project. The Government is not and does not intend to request certified pricing data. Offerors may be required, during the evaluation process to provide sufficient price information that will enable the Government to perform an accurate evaluation.
The Government will evaluate the total price identified in the Price Schedule for Line ITEM 0001.
The intent is to award CLIN 0001, Item I (Construction of Sewage and Waste facilities). The VA reserves the right to enter into discussions with those Offerors who are determined to be within the competitive range, if a competitive range is determined in the interest of the VA, otherwise discussions will be with all Offerors.
If following the initial Non-Price and Price evaluations and/or receipt of Final Proposal Revisions, an offeror’s total evaluated price still exceeds the VA's funding limitation, the VA will no longer consider the offeror to be eligible for award.
Prices will be evaluated for reasonableness utilizing one or more of the price analysis techniques set forth in FAR 15.305 (a) (1) and (a) (4).
Please note that all references to Resident Engineer or RE in the Drawings and Specifications shall be replaced with Contracting Officer’s Representative or COR.
| 3.2.1 | Volume II Price Information Submission Requirements |
| 3.2.1.1 | Offerors shall complete in its entirety the “Offeror” portion of the Standard Form (SF) 1442. An official having the authority to contractually bind your company must sign the SF 1442 in accordance with FAR 4.102. One copy of the SF 1442 is required to have an original signature. Valid electronic signatures are acceptable. |
| 3.2.1.2 | Offerors shall provide all price information necessary to provide a meaningful basis for Government's analysis and evaluation of price for the project. The Government is not and does not intend to request certified pricing data. Offerors may be required, during the evaluation process to provide sufficient price information that will enable the Government to perform an accurate evaluation. |
| 3.2.2 | The Government will evaluate the total price identified in Line ITEM 0001. The intent is to award CLIN 0001, Item I (General Construction). |
| 3.2.3 | Prices will be evaluated for reasonableness utilizing one or more of the price analysis techniques set forth in FAR 15.305 (a) (1) and (a) (4). |
| 3.2.4 | Prompt payment discounts will not be considered in the evaluation of offers. |
| 3.2.5 | If no Offerors are within the available funding limitation, the VA reserves the right to enter into discussions with those Offerors who are determined to be within the competitive range, if a competitive range is determined in the interest of the VA, otherwise discussions will be with all Offerors. |
| 3.2.6 | If following the initial Non-Price and Price evaluations and/or receipt of Final Proposal Revisions, an offeror’s total evaluated price still exceeds the VA's funding limitation, the VA will no longer consider the offeror to be eligible for award. |
3.3 SDVOSB or VOSB Evaluation Preference.
In accordance with VAAR 852.215-70 Service-Disabled Veteran-Owned Small Business Evaluation Factors (DEC 2009), credit will be assigned as follows:
| • | Full credit for a registered and verified SDVOSB means a reduction of 10% of total price. |
| • | Partial credit for a registered and verified VOSB means a reduction of 5% of total price. |
| • | Partial credit for Offerors proposing to subcontract with a registered and verified SDVOSB or VOSB means a reduction of 2.5% of total price. |
For example, if an offeror is a registered and verified SDVOSB contractor, and their total price is $1,000,000.00, for the purposes of price evaluation, a 10% reduction (which is $100,000.00) would result in an “adjusted price” of $900,000.00. The “adjusted price” of $900,000.00 would be the price used for price evaluation purposes. The same process would apply to a registered and verified VOSB contractor and to non-Veteran contractors proposing to subcontract with an SDVOSB or VOSB contractor, but the reduction percentage would be at the amount listed above (again, for price evaluation purposes).
The actual prices proposed by contractor and awarded in the contract, however, will be the actual prices paid to the contractor (not the “adjusted price”).
