A. BASIS FOR AWARD
The source selection process for 36C25725R0048 will be completed as a past performance, price tradeoff (PPTO), where there is a tradeoff between past performance and price factors and will allow the Government to accept other than the lowest priced proposal. Past Performance is significantly more important than price.
The Highest Past Performance, Lowest Price Rated Offeror will determine the best value basis for contract awards.
The Highest Past Performance Rated, Lowest Price approach will best achieve the objective of awarding a contract for Bldg. 60 VAV Box Replacement.
The Government will issue one award to a contractor that obtain a substantial confidence rating for the past performance factor and whose price is the lowest among substantial confidence offerors.
The Government will strictly enforce all the proposal submission requirements outlined in the solicitation. Failure to comply with these requirements will result in an Offeror’s proposal being rejected as being incomplete or non-conforming to solicitation requirements.
The Government intends to award contracts without discussions. Initial proposals must contain the best offer. The Government may conduct clarifications, as described in FAR mailto:Miguel.Gonzalez@va.gov mailto:Horacio.Fernandez@va.gov
15.306(a). The Government reserves the right to conduct discussions if it determines discussions to be necessary.
B. FACTORS TO BE EVALUATED
1. TECHNICAL ACCEPTABILITY (Bonding)
2. PAST PERFORMANCE
3. PRICE
C. EVALUATION APPROACH - All proposals shall be subject to evaluation by a team of Government personnel. The Government reserves the right to award without discussions based upon the initial evaluation of proposals. The proposal will be evaluated strictly in accordance with its written content. Proposals which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, will be deemed incomplete and not considered. Offerors who fail to meet the minimum requirements of the solicitation will be rated Unacceptable and thus, ineligible for award.
All Offerors are advised that, in the interest of efficiency, the Government reserves the right to conduct the evaluation in the most effective manner. The Government will first conduct a technical acceptability review of all Offerors, ensuring that all Offerors are verified at https://dsbs.sba.gov/search/dsp_dsbs.cfm as an SDVOSB under the applicable NAICS Code 238220 – Plumbing, Heating, and Air-Conditioning Contractors with a $19M small business size standard. Then Offerors will be verified as being able to meet the Bonding requirement of $1,000,000.00. Any Offeror who receives a rating of Unacceptable in any part of the technical acceptability review will be eliminated from consideration for award. After the technical acceptability review, the Government will evaluate the total proposed price of the Seed Project of all Offerors. Thereafter, the Government will evaluate the Past Performance proposal of the first five (5) lowest priced Offerors only. If the lowest priced Offerors’ Past Performance proposals are determined to be rated as Substantial Confidence, the Government may make award to this Offeror without further evaluation of the remaining Offeror’s Past Performance Proposals. If any of these five (5) lowest priced Offerors’ Past Performance Proposals are determined to be rated other than Substantial Confidence, then the Government may evaluate the next lowest priced Past Performance Proposal, and so forth and so on, until the Government reaches a contractor lowest priced Past Performance Proposal that are determined to be rated as Substantial Confidence. However, the Government reserves the right to evaluate all Offerors’ Past Performance Proposals to determine whether to conduct discussions, or otherwise determines the past performance as received, to be in the Government’s best interest.
1. Factor 1: TECHNICAL Acceptability (Acceptable/Unacceptable).

https://dsbs.sba.gov/search/dsp_dsbs.cfm https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html
2. Factor 2: PAST PERFORMANCE.
The Past Performance evaluation will assess the relative risks associated with an Offeror's likelihood of success in fulfilling the solicitation's requirements as indicated by that Offeror's record of past performance. In this context, “Offeror” refers to the proposed prime contractor and all proposed major subcontractor(s). A major subcontractor is defined as one whose subcontract is for more than 25% of the total proposed price. In either case, the prime contractor and proposed major subcontractor(s) will be assessed individually and the results will then be assessed in their totality to derive the Offeror’s Past Performance rating. A joint venture will be assessed on the combined performance of each or as a team of the joint venture offerors.
2.1 Sub-Factor 1 – Recent Successful Past Performance: Offerors are required to demonstrate recent successful performance under contracts that demonstrate that they have successfully performed construction and two-phase design-build services as a prime contractor within the last three (3) years (calculated from the solicitation issue date).
a. Provide a detailed summary of the most recent two (2) projects of at least $500,000.00 in value that include:

vi. Project Performance Period (Initial/Actual, schedule impacts and efficiencies)
vii. Owner POC (Name, Title, Telephone Number, Email)
viii. Subcontractors (Roles, Responsibilities, Percent of work)
In addition, for each project submitted, Offerors shall provide a narrative that describes recent successful performance and demonstrates experience working on a healthcare installation. Information should include details on complexity, magnitude, challenges, and degree of success. Offeror is encouraged to include supporting documents such as photographs that support the narrative.
Furthermore, for each project submitted, Offerors shall provide a narrative that describes if any of the projects were non-typical due to complexity, schedule, unforeseen site conditions, or other unusual factors, and provide details on how the offeror overcame those challenges. If none of the projects submitted were non-typical as described above, Offeror shall state such in their proposal.
Finally, “A.9 PAST PERFORMANCE EVALUATION QUESTIONNAIRE” shall be provided for each of the two (2) projects submitted for evaluation.
2.2 Sub-Factor 2 – Experience Modification Rating (EMR): The Offeror shall provide their current EMR. Any EMR older than 12 months, at the time of proposal submittal shall be deemed unacceptable and cause the offeror to be removed from competition. An EMR less than or equal to 0.90 is considered Substantial Confidence. An EMR equal to 0.91, greater than 0.91, and equal to
1.0 is considered Satisfactory Confidence. An EMR equal to 1.01, greater than 1.01, and equal to 1.10 is considered Limited Confidence. An EMR equal to 1.11 and greater than 1.11 is considered No Confidence.
*The Offeror shall provide their EMR or verifiable equivalent, from their insurance company or from their state, based off the offeror’s state of incorporation’s EMR requirements. The EMR, or equivalent shall be newer than 12 months, at time of proposal receipt.

Offerors are cautioned that the Government will review available past performance data available in the Contractor Performance Assessment Reporting System (CPARS). The Government reserves the right to obtain past performance information from any available source and may contact customers other than those identified by the Offeror when evaluating past performance. Since the Government may not necessarily interview all the sources provided by the Offerors, it is incumbent upon the Offerors to explain the relevance of the data provided. Offerors are reminded that the burden of proving low performance risk rests with the Offerors.
The Government will review aspects of cost, schedule, and performance. Areas to be evaluated may include but are not limited to quality of Construction service, timeliness of performance or adherence to performance schedules, controlling project cost, and/or effectiveness in program management (to include use and control of subcontractors).
In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror may not be evaluated favorably or unfavorably on past performance.
