This requirement is for the following: repair, replace, upgrade and modernize components to achieve the desired outcome of sustainability/operability and the fully functional performance for the elevators known as P1, P2, P3, P4, S5, S6, and S10. The elevators are arranged into two (2) groupings. The passenger elevators are arranged into a 2 by arrangement of four (4) elevators. The service elevators are arranged into a 1, 2 arrangements of (3) service elevators.

This Project will be located at the Audie L Murphy VA Medical Center 7400 Merton Minter Blvd., San Antonio, TX 78229

Contractor shall use US Department of Labor Wage Determinations TX20230231 in accordance with the Davis Bacon Act.

NAICS code for this project is 238290 with a small business size standard of $22 Million.

This is a total Service-Disabled Veteran Owned Small Business (SDVOSB) set-aside competitive procurement pursuant to Public Law 109-461 (38 USC 8127). The SDVOSB is required to perform a minimum of 15% of the construction work. The SDVOSB must be a small business under the relevant NAICS code.

STATEMENT OF WORK

Department of Veterans Affairs (VA) Audie L. Murphy Memorial (ALMM) VA Hospital Elevator Repair for Passenger Elevator P1, P2, P3 & P4 and Service Elevator S5, S6 & S10 Project Number: 671-24-200

1. GENERAL:

The awardee shall repair, replace, upgrade and modernize components to achieve the desired outcome of sustainability/operability and the fully functional performance for the elevators known as P1, P2, P3, P4, S5, S6, and S10. The elevators are arranged into two (2) groupings. The passenger elevators are arranged into a 2 by 2 arrangement of four (4) elevators. The service elevators are arranged into a 1, 2 arrangements of (3) service elevators.

In addition to achieving this objective, the elevator repair companies shall replace proprietary and/or obsolete components which shall comprise of motors, controllers, printed circuit boards (PCB) and not limited to solely electronic parts but also hydraulic and mechanical parts. Additionally, Fire Safety System components within the Elevator System shall be integrated and compatible with Fireworks and/or EST-3X/4.

The repair, replace, upgrade and modernize components to achieve the desired elevator modernization outcome shall not use proprietary parts.

The repair, replace, upgrade and modernize components to achieve the desired elevator modernization outcome shall strictly adhere to the Buy American Act.

The awardee shall use non-proprietary components along with providing all necessary services required for all parts being repaired, replaced, upgraded and modernized that shall work with the existing equipment. The projects primary work location is the Audie L. Murphy Memorial (ALMM) Veterans Affairs (VA) Hospital of STVHCS. The address is 7400 Merton Minter Blvd., San Antonio, Texas 78229.

The awardee shall replace the existing main controllers and all components/software. The replacement/upgrade shall include all components and parts that are not functioning properly nor are compatible with the new controllers. Also replace components that are at the End of Life (EOL). All operating equipment and components associated to the functionality and operation that contain any proprietary components or parts that are or soon to be discontinued shall be replaced. Additionally, it shall be the responsibility of the awardee to ensure that any replacement components/systems shall be compatible with the new elevator system. Awardee shall provide non-proprietary efficient, and reliable components that resist electrical interference from other components and elevators.

The awardee shall not propose and/or attempt to perform the repair(s), replacement(s), upgrade(s) and/or modernize components that would essentially render all the elevators unusable in accordance with (IAW) any safety codes, policies and/or standards that govern the operability of the elevators. The awardee shall propose the work to be phased so that no more than two (2) elevators in a grouping are down at any time. During the work, the awardee shall maintain the other elevators operability and serviceability to the respective grouping.

The awardee shall provide the maintenance service(s) for all the contracted elevators within the respective grouping for two (2) years after the work is completed on the last elevator in the grouping and accepted by the VA COR.

All adjustments, repairs and modifications, must conform to the manufacturer guidelines and/or the following industry standards, as applicable, whichever is more stringent:

· ASME A17.1 Safety Code for Elevators and Escalators, latest edition

· ASME A17.2 Inspectors’ Manual for Elevators and Escalators, latest edition

· ASME A17.3 Safety Code for Existing Elevators and Escalators, latest edition

· ANSI/NPA 70 National Electric Code, latest edition

· PG 18-10 – Elevator Design Manual

· Manufacturer’s requirements and specifications on inspection, maintenance, and operation of each elevator model

2. General Requirements:

A. Phasing

a) The awardee shall provide a phasing plan that minimizes impact on medical center operations. Phasing plan shall be approved by COR before any work is done at the facility.

b) Contractor shall not work on more than two elevators at a time while other elevators are still operational. Depending on demand, the COR may allow more than one elevator for modernization if it is deemed adequate. Temporary controls shall be put in place to allow newly modernized elevator to operate while other elevators are being modernized.

B. Demolition

a) Contractor shall remove all existing elevator system components that will be replaced during modernization project. This includes but not limited to existing drive system, transformers, circuit breakers, ropes, counterweights, elevator machine, electrical cables, conduits, cart interiors, touch panel on carts, communication system on cart, etc.

b) All removed materials and debris shall be discarded per VA Master Specs unless noted to retain by VA COR. http://www.cfm.va.gov/til/spec.asp.

C. Modernizations for Elevators

a) General

i. Contractor shall install a full-scale modernization package to the following elevators: Passenger Elevator P1, P2, P3 & P4 and Service Elevator S5, S6 & S10

ii. Contractor shall install all necessary equipment and labor to bring elevator system into compliance of VA Elevator design manual, International Building Code (IBC), American Society of Mechanical Engineers (ASME) Safety Codes for Elevators: Passenger Elevator P1, P2, P3 & P4 and Service Elevator S5, S6 & S10. Standards for the Qualification of Elevator Inspectors - ASME QEI-1 Guide for Inspection of Elevators - A17.2, American Society of Safety Engineers (ASSE) – Personnel Hoists and Employee Elevators on Construction and Demolition Operations A10.4, National Fire Protection Association (NFPA) - 13, 70, 72, 101, 252 and VA Barrier Free Design Guide - PG-18-13

b) System Controls

i. New Drive System

· The present motor drive system will be changed to a Solid-State Direct Motor Drive.

ii. New Operation

· The present control system will be changed to new microprocessor control.

iii. New Controller

· A microcomputer-based control system shall be provided to perform all of the functions of elevator motion and elevator door control. This shall include all the hardware required to connect, transfer and interrupt power, and protect the motor against overloading. The system shall also perform car operational control.

· Controller: Motion Control Engineering, Motion 4000, hospital service or equal. System shall be non-proprietary.

c) Machine Room Equipment

i. New Drive System

· The present motor drive system will be changed to a Solid-State Direct Motor Drive.

ii. New Machine

· The existing machine will be replaced including motor and ropes for a complete replacement. Attachment shall be compliant with elevator code for attachment to building structure.

d) System Operating Features

i. New Automatic Self-Leveling

· The elevator shall be provided with automatic self-leveling that shall typically bring the elevator car level with the floor landings + ¼” regardless of load or direction of travel. The automatic self-leveling shall correct for over travel or under travel and rope stretch.

ii. New Inspection Operation

· For inspection purposes, an enabling key switch shall be provided in the car operating panel to permit operation of the elevator from on top of the car and to make car and hall buttons inoperative.

· An operating fixture shall be provided on top of the car containing continuous pressure “UP” and “DOWN” buttons, an emergency stop button, and a toggle switch. This toggle switch makes the fixture operable and, at the same time, makes the door operator and car and hall buttons inoperable.

iii. Hoist way Access Switches

· An enabling key switch shall be provided in the car operating panel to render all car and hall buttons inoperative and to permit operation of the elevator by means of an access key switch adjacent to the hoistway entrance at the access landing. The movement of the car away from the access landing, other than the lower terminal, by means of the access key switch at the landing shall be limited in travel and direction to that as specified for the upper landing in the latest applicable revision of the ASME/ANSI A17.1 Code.

iv. Hoistway Safety Device

· Furnish and install all the necessary components, circuitry and wiring for a new Hoistway safety device system, which will operate on the elevator car top and pit. Hoistway safety device system shall be installed so the elevator can be controlled in a safe manner when an authorized person accesses the elevator hoistway.

v. New Remote Elevator Monitoring Maintenance

· A microprocessor system that continuously monitors the Unit(s) on a 24-hour per day, year-round basis will be provided. The system will notify a dispatching center that the elevator is inoperative by sending a message via telephone line.

· The monitoring system will collect data on the equipment condition whether the operation of a Unit has been interrupted.

e) Door Equipment

i. New Door Operator

· A new door operator shall be installed.

· Doors shall be power operated by means of a quality operator mounted on top of the car. The motor shall have positive control over door movement for smooth operation. Each car door shall be provided with a protective device.

· Door operation shall be automatic at each landing with door opening being initiated as the car arrives at the landing and closing taking place after expiration of a time interval. An electric car door contact shall prevent the elevator from operating unless the car door is in the closed position.

· Door operation (notification, open, close, hold-open time) shall be arranged to meet ANSI code.

· Doors will be provided with evacuation deterrent devices on each hoistway door as required by code.

· The time interval for which the elevator doors remain open when a car stops at a landing shall be independently adjustable for response to car calls and response to hall calls.

ii. New Advanced Door Opening

· The door operator control system is designed to begin advanced door opening of the car and hoistway doors when the elevator is within the allowed distance from landing and is being automatically stopped or leveled.

iii. New Limited Door Reversal

· If a person or object enters the zone of detection after the doors start to close, the doors shall stop and reopen to clear the detection zone. Once the opening is cleared, the doors shall resume closing at the preset speed.

iv. New Interlocks

· New interlocks shall be installed. The interlocks shall prevent operation of the elevator unless all doors for that elevator are closed and shall maintain the doors in their closed position while the elevator is away from the landing. Emergency access to the hoistway s required by governing codes shall be provided.

v. New Door-Protection Device

· The door protection system shall use infrared emitters and detectors to create an invisible safety net across the elevator entrance. The system continuously scans for interrupted beams. If any beam in the curtain is interrupted, the system will reopen the elevator door instantly.

· The system shall detect objects approaching, reducing potential damage to elevator doors caused by mail carts, stretchers or other moving equipment.

vi. Car Door Tracks and Hangers

· The present car door tracks and hanger assembly shall be replaced with new ones. Existing rollers shall be retained dependent on their present condition.

· Cart doors shall be replaced.

vii. Hoistway Entrances

· The present hoistway entrances shall be retained.

viii. Hoistway Door Tracks and Hangers

· The present hoistway door tracks and hanger assembly shall be replaced with new ones. New rollers shall be furnished and installed.

· Lobby doors shall be replaced.

ix. Hoistway Door Restrictors

· New folding hoistway door restrictors shall be installed.

f) Hoistway Equipment

i. Toe Guards

· A new code compliant toe guards shall be installed.

ii. Top Of Car Inspection Station

· A new top of car inspection station shall be installed.

iii. Unlocking Devices

· New unlocking devices shall be installed.

iv. Hoistway Operating Devices

· Terminal stopping devices shall be provided to slow or automatically stop the car at the terminal landings and to automatically cut off the power and apply the brake, should the car travel beyond the terminal landings.

v. Car Guides

· New rubber-tired roller guides shall be installed on the top and bottom of the car frame to engage the guide rails.

vi. Counterweight Guides

· New rubber-tired roller counterweight guides shall be installed on the top and bottom of the counterweight frame to engage the guide rails.

vii. Car Frame and Safety

· The existing car safety device, designed to stop the car if it attains a descending speed in excess of the preset contract speed, shall be retained.

viii. Replace Ropes

· The existing hoist ropes shall be replaced.

ix. Platform

· The car platform will be retained and reused in place.

x. Pit Switch

· A new emergency stop switch shall be located in the pit and accessible from the pit access door.

xi. Buffers

· The existing buffers shall be retained.

g) Hall Fixtures

i. Hall Buttons

· New hall buttons shall be installed at each landing. An up button and a down button at each intermediate landing and a single button at each terminal landing shall be installed.

· A call shall be registered by momentary pressure of a landing button. The button shall become illuminated and remain illuminated until the call is answered.

· All buttons, when applicable, to be long life LED illumination.

· Button arrangement shall match existing.

ii. Hall Lanterns

· New direction lanterns shall be provided at all hoistway entrances, with “UP” and “DOWN” indicators at intermediate landings and single indicators at terminal landings. When a car is stopping at a landing, the lantern indicating the direction that the car is traveling shall become illuminated prior to arrival of the car. A chime shall sound once for the “UP” direction and twice for the “DOWN” direction to announce the impending arrival of the associated elevator car.

iii. Wiring / Coaxial Cable

· All new wiring and electrical interconnections shall comply with governing codes. Insulated wiring shall have flame-retardant and moisture-proof outer covering and shall be run in conduit, flexible tubing or electrical wireways. Traveling cables shall be flexible and suitably suspended to relieve strain on individual conductors. New coaxial cable shall be installed.

h) Engineering Design

i. All new non-proprietary material furnished will be specifically designed to operate with original elevator equipment being retained, thus assuring maximum performance and eliminating any divided responsibility.

ii. Permits And Inspections: The contractor shall furnish all licenses and permits and shall arrange for and make all required inspections and tests for all new modernized elevators.

iii. Code: The non-proprietary elevator equipment shall be furnished and installed in accordance with the latest additions of the ASME/ANSI A17.1 Safety Code for Elevators and Escalators, An American National Standard, including the latest Supplement, the Americans with Disabilities Act and all applicable VA Design Manual, specifications and VA Barrier Free Design Guide - PG- 18-13.

3. Drawings

i. Contractor shall be provided the following:

· AE Survey and Modernization of Passenger and Service Elevators for the South Texas Veterans Health Care System

· Specifications: Appendix C 14 21 00

· AE Drawings: Project 671-24-200 100% Construction Documents Final

3.1 SUBMITTALS

Within 10 calendar days of the Notice to Proceed, the Contractor shall submit to the CO and COR the following:

Elevator Modernization Phasing Plan: The awardee shall provide a phasing plan that minimizes impact on medical center operations. Phasing plan shall be approved by COR before any work is done at the facility.

Within 15 calendar days of the Notice to Proceed, the Contractor shall submit to the CO and COR the following:

Quality Control Plan. Contractor shall establish a quality control plan for all work, including that of his subcontractors, to assure compliance with the contract provisions. Contractor shall submit a copy of his quality control plan concurrently with the quote and schematic submission. Quality control measures shall include, but not be limited to:

· Permits, licenses and insurance.

· Performing all required inspections and tests.

· Listing all subcontractors and services they will perform.

· Submittal approval.

· Inspection schedule.

· Compliance with applicable Federal, state and local codes and regulations related to executing the contract.

· Correction of unsatisfactory work.

Prior to construction the contractor shall submit all plans including, but not limited to:

· Waste Management Plan

· Environmental Protection Plan

The VA will verify the schedules, descriptive literature and samples, testing labor- laboratory reports, field test data and review the color, texture and suitability of materials for conformity with the RFP Documents and construction documents. All submittals shall be in electronic format and include a VACT Submittal Cover sheet for return as annotated.

4.0 CODE REQUIREMENTS

The VA will obtain the necessary local agency approvals, as required.

All work performed under this contract shall be in accordance with the VA Master Specifications (http://www.cfm.va.gov/til/spec.asp) and the specifications attached.

All work shall comply with all local, state, and federal rules and regulations. In the event of a code discrepancy the stricter of the ordinances shall prevail.

5.0 WARRANTIES

One year warranty is required from the date of project substantial completion as formally determined by the CO.

6.0 PROPOSED SCHEDULE:

Mobilization will only occur after all plans, submittals, phasing and equipment are approved by the COR. Contractor shall plan as necessary to ensure all parts and equipment is readily available to maintain the approved schedule.

When no longer needed, the temporary materials shall be removed and any disturbances to the grounds shall be restored to their prior condition.

7.0 WORK LOCATION AND RESTRICTIONS:

The work site location is:

Audie L. Murphy Memorial (ALMM) Veterans Affairs (VA) Hospital of STVHCS.

The address is 7400 Merton Minter Blvd., San Antonio, Texas 78229.

All work shall be performed during normal working hours Monday through Friday 7:30am thru 4:00pm. When the contractor’s work interferes with hospital functions, such as when work produces excessive noise, odors, dust, utility service interruptions, or other interferences with normal hospital operations that cannot be contained within the area of work, the contractor shall schedule said work at other than normal hours and as directed by the COR.

8. PARKING:

Parking is rigidly controlled throughout the Medical Center. Contractor parking is only allowed in authorized areas. Contractor shall abide by all VA police requirements. Parking in designated patient parking areas is strictly prohibited. Parking for equipment necessary to perform the work will be authorized in advance of starting the project and must be coordinated with the COR.

9. STORAGE OF EQUIPMENT & MATERIALS:

The contractor shall arrange with the COR for allocation of required workspace and for the storage of equipment and material to be used for this project. Storage space is very limited. There are no exclusive areas within the campus that can be given to the contractor for their storage needs.

10. DEBRIS REMOVAL

The Contractor shall be required to remove waste materials and debris daily from the campus. All waste material and debris shall be removed off site by the contractor and shall be disposed of in accordance with applicable State and Federal regulations. All recyclable materials shall be recycled, and weight tickets provided to the COR.

11. SITE UTILITIES:

The Contractor should note this scope of work does not detail all existing structures, utilities, or components that may potentially interfere with the contract work required or require modifications. The contractor shall field verify any obstruction, utility, or condition that may hinder or interfere with their work prior to award. All proposed utility relocations, re-allocations, and shutdowns shall be approved by the COR prior to commencing such work. The contractor shall field verify all existing utility installations and take appropriate action prior to working around any potential utility installation.

In the event a shutdown, restriction, or interruption of any utility services is required, a written request must be submitted (at least two weeks in advance) and approved by the COR. All utility shutdowns must be reviewed and approved by the VA.

12. PROJECT SAFETY:

Contractor shall comply with the following and keep a copy of the attached on-site at all times:

a. OSHA

b. Interim Life Safety Measure Assessment

c. Infection Control Risk Assessment

d. Hot work Permits required as needed.

e. Confined Space Permits required as needed.

13. PENETRATIONS OF FIRE AND SMOKE BARRIERS:

Prior to any installation of equipment, cables, power connections, conduit, piping or other work that penetrates a smoke or fire barrier, all such work must be approved by the COR.

A penetration permit must be secured prior to disturbing the integrity of the barrier. The permit must be available for inspection at the project location. After the work is complete, the penetration must be repaired (sealed) according to accepted practice and utilizing materials.

(Including UL/FM-listed through penetration fire stopping materials) that meet the original barrier construction requirements in order to restore the designed specifications for smoke and fire compartmentalization. All penetrations and miscellaneous openings must be protected according to NFPA 101, Chapter 8. Upon completion of any penetration repair, a visual inspection for approval must be requested from, and completed by the COR.

14. INTERIM LIFE SAFETY AND INFECTION CONTROL PROTECTION MEASURES:

Contractor shall comply with SECTION 01 35 26 SAFETY REQUIREMENTS of VA Master Specifications including following requirements of an interim life safety measures and fire protection plan.

a. Maintain the construction area to minimize the potential for fire or safety hazards resulting from storage of construction material, construction waste and debris during construction operations.

b. Install and maintain temporary construction partitions to provide smoke-tight separations between construction areas, the areas that are described in phasing requirements, and adjoining areas. Construct partitions of gypsum board or treated plywood (flame spread rating of 25 or less in accordance with ASTM E84) on both sides of fire-retardant treated wood or metal steel studs. Extend the partitions through suspended ceilings to floor slab deck or roof. Seal joints and penetrations. At door openings, install Class C, ¾ hour fire/smoke rated doors with self-closing devices.

15. PREVENTION OF FALSE FIRE ALARMS

Contractor shall comply with the requirements to prevent false fire alarms. Contractor shall provide a fire watch when impairment of the fire alarm system exceeds 4 hours in a 24-hour period.

16. MATERIAL & WORKMANSHIP QUALITY:

All materials and workmanship shall comply with all codes, standards, and recommendations of all Authorities Having Jurisdiction (AHJ). All work shall be done in a first-class manner according to the best trade practices and to the satisfaction of the COR.

The Contractor shall provide VA personnel with the necessary training to properly operate all provided equipment and systems. Additionally, the Contractor shall provide complete maintenance service support during the warranty period. All maintenance service shall be performed by factory trained, English speaking, technically qualified servicemen and shall be responsible for recording all work actions in the customer’s maintenance log book. Contractor’s warranty maintenance service support shall include all parts, service, labor, travel time, and expense to perform both preventive and corrective maintenance on the new turnkey installation.

17. SAFETY AND SECURITY

Contract workers under this project may require a VA issued identification card before the start of construction work at the San Antonio VAMC. There is no charge for the badges; however, multiple trips to VAMC facility maybe required.

Contract employees, including all subcontractor employees, must be TB tested and receive a flu shot (each year under the contract performance) if they will work within the VA Hospital Building. A letter from the prime contractor shall be submitted to the CO prior to work commencing that all staff members are TB negative, and the flu shot was received.

All contract personnel are subject to inspection of personal effects when entering or leaving the project site.

Contractor shall abide by VAMC’s policy for measures to prevent the spread of COVID. Policies may change during contract performance. COR and/or CO will provide updates as they are issued by the Facility Director. Contractor shall follow the protocols found here: Safer Federal Workforce.

18. PROJECT MEETINGS

Each week the contractor shall hold a progress meeting to review progress to date and to resolve all questions for the upcoming week. The progress meeting shall include at a minimum, the Project Manager and the Superintendent representing the Contractor, and the COR representing the Government. Technical supervisor (foreman), sub-contractors, suppliers, etc. shall attend when requested by the Contracting Officer. The meeting shall be same day, time, and place each week.

During construction, each day in the morning the crew and site supervisor shall hold toolbox talk, the activities for the day, ICRA and safety shall be discussed during the toolbox talk.

Meeting Minutes - The contractor shall take minutes of all meetings held relative to this project. The format must be acceptable to the Contracting Officer (CO). Minutes must include the meeting date and time; agenda; meeting location; list of participants with their affiliations, and telephone numbers; be fully descriptive of issues, problems and decisions made; and action items with names of responsible parties and deadlines. In addition, the minutes must include, as attachments, all exhibits and references distributed as handout materials, unless the materials are part of a formal submission. The contractor shall provide, via e-mail, complete copies of all minutes to all attendees within 72 hours of the meeting. All challenges to the minutes will be reflected in a revised version prepared by the contractor and CO along with the contractor and COR shall sign/initial the minutes. In the event of any disputes or challenges that can’t be resolved, the Contracting Officer shall render a final decision. Copies of updated minutes shall be distributed to the all attendees within 48 hours after change notice.

In addition to the days designated as holidays, the Government observes the following days:

a. Any other day designated by Federal Statute

b. Any other day designated by Executive Order

c. Any other day designated by the President’s Proclamation It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

20. ADDITIONAL REQUIREMENTS

A. Housekeeping – Accumulation of trash, paper, wood and metal shavings, sawdust, boxes and other packing materials shall be cleaned up as often as necessary and at the end of each work day. No items are to remain on site overnight.

B. False Alarms – Fire Department response fees for false alarms caused by the contractor shall be paid by the contractor.

C. Fire Watch – Provide fire watch for impairments more than 8 hours in a 24-hour period. Request for interruptions shall be coordinated with the facility safety officer and COR.

D. Smoking – is strictly prohibited in all Government facilities, near flammable liquids, highly combustible materials.

E. Tuberculosis (TB) – Contractor is responsible for ensuring that contracted worker(s) have been screened for TB. The contractor shall provide written certification, within 24 hours upon receiving notice to proceed to the COR that all contract employees assigned to the work site have had a pre-placement tuberculin screening prior to assignment to the work site and been found to be free of active TB. Testing results shall be less than one year old.

F. Safety – Safety and personal protective equipment (PPE) shall be provided for each Contractor employee by the Contractor.

G. Seasonal Influenza Vaccination – VHA Directive 1192.01 establishes policy and provides guidance for the prevention of seasonal influenza in VHA facilities, through the vaccination of health care personnel (HCP). HCP are individuals who, during the influenza season, work in VHA locations or who come into contact with VA patients or other HCP as part of their duties. HCP include all VA contractors who are expected to perform any or all of their work at VA facilities. COs shall ensure the flu vaccination requirements outlined in this directive are expected in all HCP contracts. VA COs is responsible for on-site HCP contract and shall inform the contractors about this directive and its requirements.

H. Infectious Control (IC) and Safety – All Contractors, construction workers and COR’s shall attend the Infection Prevention training annually. (Ten-minute DVD). All construction workers shall have a current IC training sticker attached to their badges at all times. If this requirement is not met, workers shall be removed from construction site.

1. All contractors shall have proof of positive or negative result purified protein derivative (PPD’s) PRIOR to starting work.

2. The Infection Prevention office shall be notified of all preconstruction meetings.

3. The Infection Control Risk Assessment (ICRA) shall be written into the contract and specifications for all projects to prevent cost discrepancies.

4. Infection Prevention office needs to be notified if the Heating Ventilation & Air Conditioning (HVAC) AHU shall be interrupted in areas that affect patient care.

5. Construction sign and copy of IC permit shall be posted at project site at all times. All IC and dust control measures shall be implemented at all times.

6. Wear DuPont Tyvek coveralls or equivalent over clothing and shoe covers in moderate to high dust areas to prevent contamination of employee clothes and tracking dust and dirt into the facility. Remove coveralls and shoe covers before leaving the area.

7. Alterations: Infection Prevention Office shall be notified of any work changes in areas of the building for anticipated routes of access.

8. All construction and installation work shall comply with VA specifications for material and workmanship, NEC, NFPA, all applicable city, county, state, federal regulations, codes and OSHA standards. Refer to construction drawings and specs for requirements.

9. A HEPA filtered vacuum shall be used on site for small clean-ups in patient care areas that have an ICRA 2.0.

10. When using the elevators patients shall be given first priority, please exit off the elevator for the patient.

11. NEVER ride in the elevator with patients in beds and/or food service delivering carts/trays.

12. Conduct work to interfere as least as possible with facility operations. All coordination for utilities shutdown shall be coordinated at least three (3) business days prior to event with the Project COR. For major utility system shutdowns, coordination shall be done at least one (1) week in advance.

21. ACCESS AND RECORDS

Information Systems Officer, Information Protection:

The contractor shall not have access to VA Desktop computers, nor shall they have access to online resources belonging to the government while conducting services. If removal of equipment from the VA is required, for replacing and/or upgrading equipment such as, any memory storage devices, servers, hard drives, solid state drives, non-volatile memory units and any integrated closed-sourcing software shall remain in VA control and shall not be removed from VA custody.

Privacy Officer:

The contractor shall not have access to protected Patient Health Information (PHI) nor shall they have the capability of accessing patient information during the services provided to the VA and if removal of equipment from the VA is required, any memory storage devices, such as hard drives, solid state drives and non-volatile memory units shall remain in VA control and shall not be removed from VA custody. All research data available for Contractor analyses is de-identified.

Records Manager:

1. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C.552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.

2. IAW 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and shall be managed and scheduled for disposition only as permitted by statute or regulation.

3. IAW 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government shall be managed IAW Federal law. Electronic records and associated metadata shall be accompanied by sufficient technical documentation to permit understanding and use of the records and data.

4. STVHCS and its contractors shall be responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records shall not be removed from the legal custody of STVHCS or destroyed except for IAW the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor shall report to STVHCS. The agency shall report promptly to NARA IAW 36 CFR 1230.

5. The Contractor shall immediately notify the appropriate CO upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government’s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to STVHCS control or the Contractor shall hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the CO or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless IAW Paragraph (4).

6. The Contractor shall be required to obtain the CO's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts. The Contractor (and any sub-contractor) shall be required to abide by Government and STVHCS guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.

7. The Contractor shall only use Government Furnished Equipment (GFE) IT equipment for purposes specifically tied to or authorized by the contract and IAW STVHCS policy.

8. The Contractor shall not create or maintain any records containing any non-public STVHCS information that are not specifically tied to or authorized by the contract.

9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.

10. The STVHCS shall own the rights to all codebase data and records produced as part of this contract. All deliverables under the contract are the property of the U.S. Government for which STVHCS shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Any Contractor rights in the data or deliverables shall be identified as required by FAR 52.227-11 through FAR 52.227-20.

11. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records shall be required to take VHA-provided records management training, Talent Management System (TMS) Item #10176, Privacy and Information Security, Rules of Behavior. The Contractor shall be responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.
