1. Contract Administration: All contract administration matters will be handled by the following individuals:

B.2 SCOPE OF WORK (SOW)
1. General Requirements.
a. The contractor shall for provide labor, materials, and equipment for the procurement and installation of two (2) 5-Ton (or larger) Variable Refrigerant Flow (VRF) Air Condition Units for the hospitals main telephone room. A Variable Refrigerant Flow (VRF) Air Condition Unit consists of one indoor unit and one outer unit.
b. The contractor shall provide all personnel, services, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish this service. The contractor shall be familiar with all the terms, conditions, and requirement herein contained. All work must comply with federal, state, and local regulations.
2. Period of Performance.
a. The Contractor shall provide the delivery date of the Air Condition Units in the quote.
b. Installation shall take no longer than 30 days from start to finish.
3. Place of Performance: Central Texas Veterans Health Care Facility, 1901 Veterans
Memorial Drive, Temple, Texas 76504.
4. Warranty Period. Warranty Period. Contractor shall provide a minimum one (1) year warranty on parts and labor. Warranty period does not start until VA COR signs off on the project.
5. Project Requirements
a. The location for this installation is in building 163, Room BB111b.
b. The Contractor shall supply and install two (2) 5-Ton (or larger) Variable Refrigerant
Flow (VRF) Air Condition Units to include all ducting and electrical connections.
c. The Contractor is required to ensure the minimize the production of dust and debris and will be required to use High Efficiency Particulate Air (HEPA) filtration while working in the clean or sterile environments of the project.
d. The outdoor unit shall be placed on the roof with curbing.
e. The contractor shall perform start-up of new units, any test and balancing of new units and verify they are working properly.
f. The power source for these units is 3 phase 480V and approximately 80 feet away from the units to be installed.
g. The motor control room is 480 volts – 3 Phase – No neutral. MCB-RT is approximately
30 feet from the indoor units. There are two spare 50 amp and 2 spaces. Both indoor and outdoor units shall feed from MCB-RT
h. The line sets for these units are approximately 175 feet.
i. Curbing will be required for the condenser units on the roof.
j. AC line set and condenser electrical supply shall be run through a mechanical space from the interior air handlers to the outside condensers placed on the roof.
k. Existing temporary ducting in room will be removed and new units will be ducted into existing distribution ducts.
l. Units will be required to be connected into the building automation and monitoring system. The system is Johnson Controls / Metasys.
m. At the end of each workday, the Contractor shall ensure the work area is clean-up and not cause hazards.
n. A lead lag control is not required. One unit shall be designed to condition the space independently. The units will be manually alternated every other month.
o. The Contractor shall contact the VA COR or Alternative COR 72 hours prior to start of the work.
p. After all work is completed, the contractor will have a walkthrough with the VA COR or Alternative COR to ensure all work is completed and ready to receive payment.
6. Additional Information.
a. The units being replaced are already removed from the room. The Contractor is not required to remove and dispose of existing units.
b. Attending the site visit is highly encouraged prior to quoting this service to fully acquaint oneself with existing site conditions and Scope of Work.
c. It is Contractor’s responsibility to field verify all site conditions prior to quoting the job.
d. The Contractor shall be responsible for the verification of all requirements for this project and all field measurements/conditions.
e. Any discrepancies between field conditions, project documents, and this SOW shall be immediately brought to the Contracting Officer’s attention.
7. Program Office Points of Contact.

8. Work Schedule. The Contractor shall coordinate the work schedule with the Government POC. The installation will be done during normal work hours and in a manner that causes minimal disruption of the workflow of the office. The contractor’s supervisor shall always be available to address any needs, the VA COR/Alternative COR may have during the Period of Performance of installation, which is 30 days from start to finish. The Government Observes the following holidays:
a. The Government hereby provides notice and Contractor hereby acknowledges receipt that Government personnel observe the listed days as holidays:
New Year's Day January 1st Martin Luther King's Birthday Third Monday in January Washington’s Birthday Third Monday in February Memorial Day Last Monday in May Juneteenth June 19th Independence Day July 4th Labor Day First Monday in September Columbus Day Second Monday in October Veterans Day November 11th Thanksgiving Day Fourth Thursday in November Christmas December 25th
b. In addition to the days designated as holidays, the Government observes the following days:
1) Any other day designated by Federal Statute
2) Any other day designated by Executive Order

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.
9. Invoices and Payment.
a. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.
b. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.
c. The contractor shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.
d. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.
1) Time period being invoiced for.
2) Description of services performed.
3) Unit Cost billed.
4) Extended amount due.
5) Invoice number, date, and amount partial or full.
6) Contract and obligation numbers.
10. Codes and Standards.
a. The project shall be in accordance with the latest Uniform Building Code (UBC), National
Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.
b. The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004- 012 and all VA Center Policy Memorandums, including but not limited to the following:
1) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.
2) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.
3) Compliance with EPA and State environmental regulations.
11. Safety Requirements. Prior to performing any work, the contractor will be required to submit a safety plan in accordance with OSHA and VA Regulations. The safety plan shall include, but not limited to the following:
a. Safety and Health Policy (i.e. company policy)
b. Safety and Health Objectives (i.e. company goals, procedures, etc.)

c. Job Site Inspections (i.e. safety inspection/potential hazards/ mishap prevention, etc.)
d. Contractor Safety Administrator (i.e. competent person/safety officer)
e. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)
f. Safety Rules (i.e. rules applicable to the work/task being performed, equipment, ladders, confined spaces, open flame, etc.)
g. Job Safety Training (i.e. OSHA, safety meetings, etc.)
h. 30 Hour OSHA Construction Safety Course – competent person
i. 10 Hour OSHA Construction Safety Course – all others
j. Safety Discipline (i.e. correction of violations, etc.)
k. Emergency Procedures (i.e. responsibilities, procedures, etc.)
l. Lockout/Tagout procedures but be known by the technician
12. Safety Inspections. On a weekly basis, the VA will conduct a safety inspection of the work area. This inspection includes, but is not limited to the following:
a. Means of Egress
• Fire/Smoke Doors unlocked, free of obstructions.
• Means of Egress (includes Exits) free of obstructions and clearly marked.
b. Housekeeping and Traffic Control
• Trash and debris are removed promptly and transported outside the construction area.
• Floor mats and dust tack mats are located at the entrance to construction area.
• Tools and equipment are properly stored.
• Signs installed to restrict patient access (doors locked as needed).
• Dust control measures are in place.
• Barriers are in place and properly sealed.
c. Clothing
• PPE is available and properly worn.
• Clothing is relatively dust free with the construction area and patient areas.
13. Site Conditions.
a. The work covered by these specifications are mostly buildings that are occupied some way fashion or form.
b. All work must be coordinated with the VA COR.
c. The contractor shall leave no area unsecured or unsafe at the end of the day.
d. The contractor shall always keep the premises as clean as possible and free from an accumulation of waste materials and rubbish.
e. It shall be the contractor’s responsibility to field verify all existing conditions and dimensions prior to bid.
f. All materials removed shall be disposed of offsite by the contractor.
g. Proper PPE must be worn when working in these conditions.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.
C.4 VAAR 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED
SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023)
(DEVIATION)
(a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;
(iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and
(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certification Program at 13 CFR parts 121, 125, and 128.
(2) The term ‘‘Service-disabled Veteran’’ means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
(3) The term ‘‘small business concern’’ has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).
(4) The term ‘‘small business concern owned and controlled by Veterans with service-connected disabilities’’ has the meaning given the term ‘‘small business concern owned and controlled by service-disabled veterans’’ under section 3(q)(2) of the Small Business Act (15 U.S.C. 632(q)(2)).
(5) The term “SDVOSB participant” or certified SDVOSB means a small business that has been certified in the SBA Veteran Small Business Certification Program and listed in the SBA certification database (see 13 CFR 128.102).
(b) General. In order for a concern to submit an offer and be eligible for the award of an SDVOSB set-aside or sole source contract, the concern must qualify as a small business concern under the size standard corresponding to the NAICS code assigned to the contract and be listed as an SDVOSB participant in the SBA certification database as set forth in 13 CFR 128.

(1) Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.

(c) Representation. Pursuant to 38 U.S.C. 8127(e), only certified SDVOSBs listed in the SBA certification database are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible and certified SDVOSB as defined in this clause, 13 CFR 121, 125, and 128, and VAAR subpart 819.70.
(d) Agreement/LOS certification. When awarded a contract action, including orders under multipleaward contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certified SDVOSBs listed in the SBA certification database (including independent contractors) shall be considered eligible and/or ‘‘similarly situated’’ (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required LOS certification requirements in this solicitation (see 852.219–75 or 852.219–76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/ VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products.
(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CFR 125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not certified SDVOSBs listed in the SBA certification database.
(5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certified and listed in the SBA certification database to count as similarly situated. Any work that a first tier SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13
CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[] By the end of the base term of the contract or order, and then by the end of each subsequent option period; or
[X] By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certification Program and the VA Veterans First Contracting Program.
(h) Misrepresentation. Pursuant to 38 U.S.C. 8127(g), any business concern, including all its principals, that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB status is subject to debarment from contracting with the Department for a period of not less than five years (see VAAR 809.406–2 Causes for Debarment).
