RFI Answer for site visit conducted on April 27, 2023, at 10:30 am CST and May 30, 2023 at 11:00 am CST.
1. Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please change the contract type to a Fixed-Price with Economics Price Adjustments pursuant to FAR 16.203.
Answer: Contract type will not change. This solicitation remains as a Firm Fix Price Sealed Bid.
Please refer to FAR 14.408-4 Economic price adjustment if you are still interested in bidding.
2. Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please reduce the price-hold period to 30 days.
Answer: Price hold period will not be reduced. Refer to question 1 for additional guidance.
3. Is this project exempt from taxes?
Answer: The answer to this RFI depends on too many variables outside of VA control. Generally speaking, VA is a department of the United States and the United States is an exempt agency under Texas Tax Code § 151.309 (Governmental Entities). It is extremely important that owners, contractors, and material suppliers understand (and consult with their tax advisors who understand) the various tax laws which are at play in the construction industry and in particular types of construction projects in Texas. It is particularly important that the parties recognize the tax implications arising from the different types of contracts (i.e. lump sum or cost-plus), as well as their tax responsibilities as Texas employers. VA recommends contractors consult with a qualified tax attorney for all tax-related questions.
4. SF1442 Item 13.a. states that sealed offers are due at the place specified in Item 8, which contains a physical address in Independence, OH. Paragraph A.9, "COVID-19 Bid Submission Instructions," states that only electronic bids will be accepted. Please clarify how the VA would like to receive bids.
Answer: 13.a. states, “Sealed offers in original and 0 copies…. Refer to section 10 of SF 1442, last paragraph “SUBMISSION OF BIDS:”, for instructions on submitting a bid.
5. Please provide an asbestos and lead paint report.
Answer: Asbestos abatement has already been conducted, but there is no subsequent study/report to provide. If the contractor identifies evidence of asbestos still within the building, coordination with the VA will be required to determine what additional actions are required. The current scope presumes no additional asbestos abatement.
Lead paint is present on window steel frames and possibly door casings. Lead-based paint must be handled and disposed of properly.

15. Is daily covid screening for entry still in place?
Answer: No longer a requirement
16. If daily screening is still required who is responsible for the cost VA or GC/Subcontractor?
Answer: Not applicable
17. The AHU schedule on sheet MH601 also calls out MERV 8 and MERV 13 pre-filters along with a MERV 14 final filter. The control diagram on sheet MI501 shows the location of both pre-filters that are coupled with differential pressure sensors but it does not show the MERV 14 final filter or any pressure sensors. Given this, we believe either the schedule has something extra or the diagram is missing something. In either case, our question is: Which is correct, the schedule or the diagram? And follow up question if the schedule is correct: where is the MERV 14 final filter located in the unit?
Answer: Clarification will be provided during construction as an RFI response.
18. Placing the final filter downstream of the fan will add length to our units so we also want to know: How much additional space would be available/allowed beyond the dimensions shown for the new AHUs?
Answer: This issue to be addressed during construction as a RFI response. Contractor shall bid on dimensions currently showing within the specifications and drawings.

Answer: No
21. If Tridium front end is not approved, please confirm that access to Metasys server will be provided to integrate new devices into Metasys?
Answer: Access will be provided per VA
22. If access to Metasys Server is not allowed, please confirm that JCI must breakout their cost for integrating new devices into their existing server.
Answer: Not applicable.
23. In the specification language, identified below, the specification stipulates that the entire BAS must be complete and seamlessly functional under a single platform. That platform is identified as “JCI METASYS.”
a. Can the contractor perform controller installation, while meeting the specification for field controllers and devices, and provide a Tridium Niagara 4 platform in lieu of the JCI METASYS, and integrate the existing JCI METASYS system into the Niagara 4 front end? If so, this would meet the performance requirement of having a single unified system.
Answer: No. Contractor to integrate B1 building automation system into existing campus building automation system.
b. If item a. (above) is not possible, then can the contractor provide and install all field controllers and devices, so long as they meet or exceed the performance requirements specified? If so, then can the bid be itemized to read the following:

iii. Bid for Division 25 providing the Advanced Utility Metering System scope of work.

Answer: Design was conducted using 3D BIM software. Awarded contractor can request those files at kickoff.
29. The single line diagram on sheet E902 is missing the keynotes and callouts. Please provide this information as soon as possible.
Answer: Additional information for E902 will be provided as a construction RFI response.
30. Is the Government able to provide a product list for the flooring? That is, instead of the general ‘vinyl plank’ or ‘sheet flooring’ or whatever type, can the Government provide the specific product names requested to ensure accurate pricing? Or is it up to the contractor to decide? We also do not see anything listed for floors 4, 5 and 6.

These two notes are conflicting as one indicates only excavation and backfill should be included in base bid. The later states that excavation, waterproofing, and backfill shall be included in base bid. Please clarify if waterproofing also needs to be included in base bid.
