37. Exposed Tamper Resistant Fasteners: Specification 10 28 00, paragraphs 2.17A.1 and 3.2I require tamper resistant fasteners in Mental Health and Behavioral Units. If any of the restrooms in this project are considered to be in Mental Health or Behavioral Units, please provide a complete list of these restrooms by amendment to all bidders.
Answer: None.
38. Soap Dispensers and Soap Reservoirs: Plumbing Fixtures Connection Schedule, Lavatories L-1H, L-2H and L-3H, under “Manufacturer” states “provide separate 120V 3A GFI-protected receptacle for sensor operation and soap dispenser. Provide soap reservoir to wall inside P-trap enclosure”. Specification 10 28 00-2.13B.3 indicates soap dispensers are to be battery operated. Electrical drawings only show one 20A 120V non- GFI circuit to each Wash and Dry faucet with hand dryer, as located on the Plumbing drawings. There is no separate GFI-protected receptacle indicated for other loads such as hands-free soap dispensers. The Toilet Accessory Schedules located on the Architectural drawings indicate Tag TA1 Soap Dispenser is “Contractor Supplied and Installed”. Where this item is shown on Architectural Interior Elevations, they appear to be wall mounted in different locations, depending on the restroom and lavatory layouts.
Are there supposed to be separate soap dispensers and reservoirs within each lavatory assembly, or is only a wall mounted dispenser to be furnished and installed?
Answer: Soap dispenser is only battery operated, no electrical.
39. At each Wash and Dry faucet with hand dryer location shown on the Electrical Power drawings, there is a symbol for a motor rated switch with thermal overload to be served by a dedicated 20A 120V non-GFI protected circuit from an existing panel. At some locations, this same circuit also serves a convenience receptacle in the restroom, located near the new lavatory. The specified faucet/hand dryer described on the Plumbing Fixture Connection Schedule for Lavatories L-1H, L-2H and L-3H seems to require a GFI-protected receptacle to be located below the lavatory assembly or within the P-trap enclosure for connection of power for the faucet auto-sensor. In addition, the specified faucet/hand dryer motor bucket is designed to be direct wired with either a cable or flexible conduit and wiring. If a toggle switch with lock out provision is still required for a local disconnect, would it still require thermal overload protection if the faucet/hand dryer is thermally protected? If GFI protection is required for the faucet/hand dryers, would it be better to install an additional non-usage GFCI device below each lavatory and connect to the motor bucket with flexible conduit, in addition to a motor rated toggle switch, in lieu of trying to install a GFCI circuit breaker for each new circuit in each different panel that is designated? Or, would it be preferable to install a GFI duplex receptacle below the lavatory and connect the motor bucket with a #12 AWG appliance cord, utilizing a cord and plug disconnecting means?
Answer: No thermal protection of disconnect is required. No GFCI is required for hand dryers.
40. Plan P601 specifies Acorn Meridian Edge 3801, 3802 and 3803 which appear to be solid surface, but specifications Call for vitreous china. What is required?
Answer: Solid surface
41. If electrical power is required to be provided to soap dispensers, please identify which soap dispensers and which existing circuit is to be utilized.
Answer: Refer to Question #46.
42. Are there going to be any state regulatory inspections for electrical work?
Answer: No
43. Does an emergency lighting circuit exist in each bathroom?
Answer: Yes, also in adjacent corridor
44. What will be required of the fire alarm panels and devices during demo and reconstruction?
Answer: At contractors’ option they can be salvaged and reused. Otherwise, devices for full coverage shall be new.
45. Will all fire alarm devices be reused?
Answer: See response to question #44
46. Besides the 120V/20A circuit for faucet/hand dryer, will there be power for soap dispensers? Not shown on electrical prints, if power is required could power be tapped off nearest plug?
Answer: Soap dispensers are touch free battery operated. Refer to specifications.
47. Will an environmental survey be provided? This survey needs to be filed with the State of Texas for an Asbestos Abatement Notification.
Answer: Survey in project areas doesn’t exist. To be assumed that all demo materials are asbestos containing and should be bid as such. Asbestos sub-contractor is responsible to follow all State laws and procedures.
48. What percentage of the bathrooms are expected to contain asbestos?Answer: 100%
49. Do the construction barriers need to go all the way up to the bottom of the interstitial decking above? (approx. 20’AFF?)
Answer: Construction barriers are to be fully enclosed and separated from the public.

Allow one week for the background check and process. GC is responsible for all workers badges to be current. A one day temporary badge can be requested but must be approved by the
VA COR.
61. Are company employees required to be on identifiable uniform? Are uniforms color coded by trade?
Answer: GC is responsible for proper PPE.
62. There are multiple specs that do not align or may not be relevant to this job, will plans supersede specs? (I.e. professional photographer, dedicated scheduler, exterior fences) Will a recycling plan will be required?
Answer: See sheet G10.3, General Project Notes – Coordination - #2
63. Will the CPM/Schedule will be required in specific file format or a third party format can be provided (i.e. Procore, Builder Trend, Smart Sheets) Answer: VA Firewall doesn’t allow software to be used like Procore, etc. Schedule can be sent in pdf through email for review.
64. Application for payment will be through AIA certification or Tungsten invoicing?
Answer: Tungsten Invoicing
65. IC Training will be required to be outsource by GC or it will be provided by VA Personnel?
Answer: IC training is provided by the VA in room E002 every Tuesday from 10:00 am to 10:30 am. Training is required annually. Workers are required to have the Tuberculosis Test results at the time of the training. The VA Infection Control Nurse conducts the training along with the VA Safety Dept.
66. Please clarify if Countertops Specs. Details call SS-1 Solid Surface for the wainscot but does not define anything for countertops.
Answer: No countertop specs.
67. What will; be the Licensing/Permitting requirements? (i.e. M,E,P & Fire) Answer: see answer #7 and follow the specs.
68. Will it be any recycling requirement?
Answer: No recycling
69. Has any vendor been identified as a sole provider? (i.e. required to use a specific waste management co, has to use a specific third party inspector) Answer: see answer number #7.
70. Has asbestos testing ever been performed in the areas that will be worked in? If so, can the results be provided?
Answer: No
71. Has asbestos testing ever been performed in the building? If so, can the results be provided? Answer: No. Not in the area of this project.
72. If no asbestos tests have been performed, can this be performed?
Answer: see answer #47 and #22
73. What all is suspect of Asbestos.
Answer: see answer #47 and #22
74. The restrooms will closed during construction. How many restrooms per floor will we be able to work on at one time?
Answer: Recommended Phasing:
First Floor (Phase 1): see sheet A2.0 Second Floor (Phase 1): see sheet A3.0 Third Floor (Phase 1): see sheet A4.0
All of Phase 1 to be completed and turned over to the VA before starting Phase 2.
First Floor (Phase 2): see sheet A2.0 Second Floor (Phase 2): see sheet A3.0 Third Floor (Phase 2): see sheet A4.0
The VA COR can change the above phasing if the GC is having trouble managing the infection control or safety at multiple locations. GC can submit an alternate phasing plan for approval, but it must minimize the impact to Veterans and VA Employees. GC is required to provide directional signage (mounted to the Temporary Construction Wall) for Veterans/Employees indicating the nearest restroom while under construction.

(2) Any award resulting from this solicitation shall be made to a VIP-listed SDVOSB who is eligible at the time of submission of offer(s) and at the time of award.
(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.
(c) Representation. Pursuant to 38 U.S.C. 8127(e), only VIP-listed SDVOSBs are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible SDVOSB as defined in this clause, 38 CFR part 74, and VAAR subpart 819.70.
(d) Agreement. When awarded a contract action, including orders under multiple-award contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting requirements in 13 CFR 121.406(b) and 13 CFR 125.6. Unless otherwise stated in this clause, a requirement in 13 CFR parts 121 and 125 that applies to an SDVO SBC, is to be construed to also apply to a VIP-listed SDVOSB. For the purpose of limitations on subcontracting, only VIP-listed SDVOSBs (including independent contractors) shall be considered eligible and/or “similarly situated” (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required certification requirements in this solicitation (see 852.219-75 or 852.219-76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not VIP-listed SDVOSBs (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products. (i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not VIP-listed SDVOSBs. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CRF 125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not VIP-listed SDVOSBs.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not VIP-listed SDVOSBs.
(5) Subcontracting. An SDVOSB must meet the NAICS size standard assigned by the prime contractor and be listed in VIP to count as similarly situated. Any work that a first tier VIP-listed SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13 CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[Contracting Officer check as appropriate.]
____ By the end of the base term of the contract or order, and then by the end of each subsequent option period; or
____ By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture is listed in VIP and complies with the requirements in 13 CFR 125.18(b), provided that any requirement therein that applies to an SDVO SBC is to be construed to apply to a VIP-listed SDVOSB. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Program for SDVO SBCs, and the VA Veterans First Contracting Program.
(h) Misrepresentation. Pursuant to 38 USC 8127(g), any business concern, including all its principals, that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB status is subject to debarment from contracting with the Department for a period of not less than five years (see VAAR 809.406-2 Causes for Debarment).

FAR 19.102.]
(i) □ Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219-73 or VOSBs as set forth in 852.219-74. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded.
Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13
CFR 125.6.
(ii) □ General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219-73 or VOSBs as set forth in 852.219-74. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded.
Cost of materials are excluded and not considered to be subcontracted.
(iii) □ Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219-73 or VOSBs as set forth in 852.219-74. (2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
(3) If VA determines that an SDVOSB/VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:
(i) Referral to the VA Suspension and Debarment Committee;
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C.

(iii) Prosecution for violating section 1001 of title 18.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer.
Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed and returned with the offeror’s bid, quotation, or proposal. Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the
EO
is available at https://www.dol.gov/agencies/whd/government-contracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
