DESCRIPTION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and

Solicitation for Commercial Items,” in conjunction with FAR Part 13.5 for Certain Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a quote is being requested, and a written solicitation document will not be issued.

This solicitation is issued as a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2024-

03 (eff. 2/23/2024), VAAR Update 2008-37 (eff. 07/28/2023), Acquisition Policy Flash 23-15 (eff.

B.2 STATEMENT OF WORK

Dishwasher Preventive Maintenance and Repair

GENERAL REQUIREMENT

Contractor shall develop and provide a comprehensive preventive maintenance service plan and furnish all skilled labor provided by technician certified to work on the equipment therein, materials, wear parts, equipment, tools, travel, and supervision for providing preventive maintenance, inspections and wear part repairs for one Hobart dishwasher, model FT1000 and one Hobert dishwasher, model

FT1000S, located at the Michael E. DeBakey VA Medical Center, 2002 Holcombe Boulevard, Houston, Texas. The services under this contract shall also include the removal and disposal of replaced parts, waste and/or articles in accordance with applicable guidelines stated herein.

OPTION TO EXTEND

This contract may be extended up to four additional (4), one-year periods at the option of the

Government in accordance with FAR 52.217-9, Option to Extend the Term of the Contract, subject to the availability of funds. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Exercise of the option will be based on whatever is the most advantageous to the Government. Evaluation of options shall not obligate the Government to exercise the option.

SPECIFIC CONTRACT WORK REQUIREMENTS

For the base contract year, the FT 1000 and FT 1000s will be covered from July 24, 2024 to July 23, 2025.

In the event the dishmachine is replaced, there will be an opt out period for 12 months upon replacement of the machine. After the twelve-month opt-out period, the maintenance agreement will cover the replacement machine for the remainder of the contract duration.

1. Preventive Maintenance Inspections (PMI)

The preventive maintenance procedures, completed at the frequency recommended by manufacturers, shall consist of visual and functional inspections and maintenance of the entire instrument with the instrument being cleaned and worn or defective parts being replaced when necessary, in accordance with the manufacturer’s recommendation/specifications. This should be a minimum of two maintenance inspections and two preventative maintenance visits, including replacement of wearparts.

2. Services Included:

During the Term, the contractor shall provide the following services at no additional cost:

- Basic Coverage - Monday through Sunday, 24 hours, labor, travel, parts, standard shipping, second trip or call backs.

- Emergency Coverage for After Hours and Weekends - Emergency calls received by contractor on holidays, or Monday through Sunday, 24 hours.

- Unlimited number of calls per term.

- Response Time Levels by Call type as provided:

- Emergency Call: Upon receipt of message , Hobart will respond within thirty (30) minutes and dispatch a qualified technician to arrive on site within four (4) hours.

- Non-Emergency Call: Upon receipt of message l, contractor will respond within thirty

(30) minutes and dispatch a qualified technician to arrive on site within twenty-four (24) hours.

- Contractor must have no more than one deficiency related to these Response

Times during the contracting period.

- The contractor must be able to ensure emergency services to the VA, During times of disaster inclusive of hurricanes, and/or any other emergency conditions, the contractor must inform facility of any unavoidable delays in service. Service should resume as soon as access is available.

- Expedited Parts

- If parts are not available on the service truck or in the service office, Contractor shall expedite delivery of unavailable parts for Emergency Calls and ensure they are available by the next day.

- Proactive Maintenance. Minimum of two (2) planned or scheduled maintenance appointment during each contracting period. Each shall include identification of potential service problems and replacement of essential parts. Timing and services shall be coordinated and agreed upon by all parties involved. During each maintenance visit, contractor shall provide a checklist to the

COR or designee upon completion of the service.

- Maintenance Inspections. Minimum of two (2) visits during contracting period that identify potential service problems on a unit prior to occurrence.

- Expendable Parts. Labor, travel, as it relates to the service of the following Parts:(i) plastic flight links, curtains, blades, slicer knives, sharpening devices, pulley wipes, shredder plates, fryer baskets, customer removable seals, door gaskets; (ii)consumable components or ordinary wear items including but not limited to; rinse arm strainers, final rinse nozzles, filters

(including water filters), wash arm end caps, lower arm bushing, rollers, retaining rings, wash arm plugs, dish-limit rubber bumper, lamps, dish racks.

3. Disposal of Removed Parts and Articles:

Upon receiving approval from the Contracting Officer’s authorized representative, Contractor shall be responsible for disposing all removed parts, waste and articles in accordance with the applicable guidelines including those from the manufacture, industry, federal, state, and local agencies..

4. Reports:

The Contractor's Service Representative is to complete a service report or checklist in writing after each preventive maintenance inspection, including identifying discrepancies found and corrective actions made. Contractor reports should include specific findings and recommendations for prevention of future problems if feasible (i.e. employee error). Reports must be submitted to the Contracting

Officer and Contracting Officer Representative within 5 business days of inspection.

5. Materials and Workmanship:

The Contractor may furnish new or refurbished parts. All parts shall be of current manufacture and shall have versatility with presently installed equipment. All newly installed replacement parts become the property of the Government. All material and equipment shall be installed in accordance with the recommendations of the manufacturer and must conform to this contract and industry standards.

6. Inspection of Materials and Articles:

Inspection of materials and articles furnished under this contract may be made at the site by the COR, the Chief, Food Production or their designee, unless otherwise provided for in the specifications.

7. Safety Requirements:

Contractor shall provide at least one competent technician. In the performance of this contract, the

Contractor shall take such safety precautions as the Contracting Officer, or his/her designee, may determine to be reasonably necessary to protect the lives and health of occupants of the building.

8. Work Stoppage:

Scheduled inspections and non-urgent repairs shall be scheduled in advance with the COR to minimize workflow disruptions in the work area. Inspections and non-urgent repairs shall only be conducted on one unit at a time. Technicians should ensure one unit is available at all times to maintain workflow within the kitchen area.

9. Repairs Not Covered Under Service Agreement

A parts rider will be included in the contract for items not covered under service contract. Any repairs that are outside this agreement will be communicated to the COR, to include a detailed description and price estimate of all parts and labor charges. All work not covered under service agreement will only be authorized by the COR or Contracting Officer. Work shall not be completed until this authorization is given.

10. Authorized Personnel:

1. A Delegation of Authority memorandum will be issued after award of contract. All contract administration functions relative to the administration of this contract, excluding termination rights, will be delegated to a Contracting Officer (CO) of the medical center.

2. After contract award, inquiries and correspondence pertaining to administration of this contract shall be addressed to the MEDVAMC. Only the CO is authorized to make commitments or issue changes which will affect the price, quantity, quality, or terms of this contract.

Evaluation Criteria

1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government price and other factors considered. The following factors shall be used to evaluate offers:

Price: All evaluation factors other than cost or price when combined are approximately equal to cost or price.

Past Performance: The offeror must provide documentation of three (3) references for verification purposes of past performance which demonstrate the company's ability to meet the qualifications herein, inclusive of point of contract information and current phone numbers.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. (a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the

SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/

(see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13

CFR 121, 125 and 128.).

(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.

C.5 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT

REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a

Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National

Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting

Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office.

Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

***Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($17.20 per hour) or 13658 ($12.90 per hour). Please see the Note at the top of the wage determination for more information. Please also note that the minimum wage requirements of Executive Order 14026 and 13658 are not currently being enforced as to contracts or contract-like instruments entered into with the federal government in connection with seasonal recreational services or seasonal recreational equipment rental for the general public on federal lands. The minimum wage requirements of Executive Order 14026 also are not currently being enforced as to any contract or subcontract to which the states of Texas, Louisiana, or Mississippi, including their agencies, are a party.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is the victim of, domestic violence, sexual assault, or stalking. ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: $4.98 per hour, up to 40 hours per week, or $199.20 per week or $863.20 per month.

HEALTH & WELFARE EO 13706: $4.57 per hour, up to 40 hours per week, or $182.80 per week, or $792.13 per month*.

*This rate is to be used only when compensating employees for performance on an SCA-covered contract also covered by EO 13706, Establishing Paid Sick Leave for Federal Contractors. A contractor may not receive credit toward its SCA obligations for any paid sick leave provided pursuant to EO 13706.

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor, 3 weeks after 5 years, and 4 weeks after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. HOLIDAYS: A minimum of eleven paid holidays per year: New Year's Day, Martin Luther King Jr.'s Birthday, Washington's Birthday, Memorial Day, Juneteenth National Independence Day, http://www.dol.gov/whd/govcontracts

Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)

THE OCCUPATIONS WHICH HAVE NUMBERED FOOTNOTES IN PARENTHESES RECEIVE

THE FOLLOWING:

1) COMPUTER EMPLOYEES: This wage determination does not apply to any individual employed in a bona fide executive, administrative, or professional capacity, as defined in 29 C.F.R. Part 541. (See 41 C.F.R. 6701(3)). Because most Computer Systems Analysts and Computer Programmers who are paid at least $27.63 per hour (or at least $684 per week if paid on a salary or fee basis) likely qualify as exempt computer professionals under 29 U.S.C. 213(a)(1) and 29 U.S.C. 213(a)(17), this wage determination may not include wage rates for all occupations within those job families. In such instances, a conformance will be necessary if there are nonexempt employees in these job families working on the contract.

Job titles vary widely and change quickly in the computer industry and are not determinative of whether an employee is an exempt computer professional. To be exempt, computer employees who satisfy the compensation requirements must also have a primary duty that consists of:

(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;

(2) The design, development, documentation, analysis, creation, testing or modification of computer systems…
