About this file
This document is Amendment 0001 to Solicitation 36C25526Q0298, issued by the Department of Veterans Affairs Network Contracting Office (NCO) 15 in Leavenworth, Kansas, effective April 9, 2026. The amendment provides answers to questions received from offerors regarding a Blanket Purchase Agreement (BPA) solicitation for construction materials.
Key pricing and submission requirements clarified in the Questions and Answers include: (1) all prices in the Price Schedule and Attachment B must be fully completed at time of submission; offerors may use standard escalation or pricing approaches to account for anticipated cost changes across all ordering periods, with any post-award adjustments following BPA pricing procedures in Section B.6; (2) the solicitation was issued as unrestricted, not as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside; (3) a tax exemption certificate can be provided upon request for qualifying purchased construction materials; and (4) BPA holders may increase prices at any time after written notification to the Department of Veterans Affairs Contracting Officer, though price increases do not affect orders already issued. Offerors must acknowledge receipt of this amendment prior to the deadline specified in the solicitation by completing Items 8 and 15, acknowledging receipt on each copy of their offer, or submitting a separate letter or electronic communication referencing the solicitation and amendment numbers.

QUESTIONS AND ANSWERS
Q1. Please advise on the following clarifications requested by most manufacturers / distributors.
Due to ongoing supply chain volatility and raw material cost fluctuations, firm fixed pricing for the full BPA term is not commercially viable. Definitely a quote-at-time-of-order will be provided.
Can we submit a blank price column on the Attachment B with the note “discounted Pricing will be determined at time of order according to the required qty” ?
A1: Pricing must still be fully completed in the Price Schedule and Attachment B at the time of submission. Offerors may account for anticipated cost changes by using their standard escalation or pricing approach as long as all prices for all ordering periods are provided.
Any adjustments after award must follow the BPA pricing procedures in Section B.6.
Q2. Is this solicitation a SDVOSB set aside? This looks like an “unrestricted” solicitation.
A.2: The solicitation was issued as unrestricted.
Q.3: Will there be a Tax Exemption Certificate issued for the Construction Materials? I understand that a TEC does not exempt all purchased materials, but only qualifying purchased materials.
A.3: A tax exempt form can be provided upon request
Q.4: As we work through the pricing exercise in Attachment B, we are noticing many items that have fluctuating price points due to a volatile market, making it nearly impossible to lock in for 1-year, and not possible to lock in for 2-5 years into the future. It is our intention to price these items with our vendors at today’s market value and include a standard percentage markup to cover our Costs, Overhead and Profit.
By establishing a standard percentage markup to all orders, this allows for bulk-purchase discounts, or other discounts as well as any unforeseen cost increases to be passed through to the VA.
When considering B.6 Pricing Data, Item 3, It appears there is room for market price increases to be passed on to the VA, and we would not be held to the Attachment B Pricing Schedule. Is this understanding correct?
A.4: Yes, in accordance with B.6 the BPA holder may increase BPA prices at any time.
However, the BPA price increase shall not take effect until the Department of Veterans
Affairs Contracting Officer receives written notification. Any order already issued shall not be affected by the change to BPA pricing.
