SECTION 3 - ELIGIBILITY AND PREFERENCES FOR AWARD

3.01 BASIS OF AWARD (OCT 2023)

A. Best Value Tradeoff Approach. The Lease will be awarded to the responsible Offeror whose offer will be most advantageous to the Government.

1. The combination of factors below is approximately equal in importance to price. As proposals become more equal in price, their technical merit becomes more important. Likewise, as technical factors become more equalized, price becomes the most important component.

2. The following evaluation factor(s) will be considered: The factors are listed in descending order of importance.

Factor 1 Technical

a. Distance to the VAMC: The closer a parking location is to the VAMC the more consideration it will receive. Offeror shall provide the location distance to the VA facility.

b. Site Quality: Age of the pavement, last restriping, lighting and site security considerations. The offeror shall provide a site map and highlight the proposed VA Parking Spaces. Information provided shall include the Age of the pavement, date of last restriping, lighting and site security considerations. Newer pavement and more recent restriping shall receive more consideration.

Factor 2 Past Performance: Offerors shall provide up to three reference phone numbers and email addresses with current first-hand knowledge of offeror’s (within the last 3 years) performance with snow and ice removal on similar sized parking lots and who have knowledge of the firm’s management ability. Offeror may provide information on problems encountered on any contracts and include the corrective action taken to resolve those problems. References shall complete Exhibit H Past Performance survey and submit it directly to the LCS and LCO prior to the due date for receipt of offers. The more relevant and recent past performance information provided to or obtained by the Govt will be given greater evaluation consideration. The SSEB will conduct a structured Past Performance / Risk Assessment that examines an Offeror’s relevant present and past performance record to determine the performance risk associated with each proposal and the degree of confidence for successful performance based on the Offeror’s demonstrated record of performance on similar contracts. An Offeror’s past performance is important in determining its ability to successfully perform required services. The Government is especially interested in recent and relevant past performance that relates to the ability to provide quality construction contractors and providing and managing leased space. The Government will evaluate the Offeror’s previous performance in the following areas; 1) management of leased space, 2) customer satisfaction, and 3) timeliness. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated favorably or unfavorably on past performance. Performance Confidence will be evaluated in accordance with FAR 15.305(a)(2). Performance confidence ratings assess the probability of the offeror successfully accomplishing the proposed effort based on the offerors past performance. In assessing past performance confidence, the evaluators will primarily rely on information provided by offerors completed past performance questionnaires. The Government may use data independently obtained from other government and commercial sources to be used in the evaluation process. Offerors shall provide a maximum of 5 references. Offeror may provide information on problems encountered on any contracts and include the corrective action taken to resolve those problems.

Factor 3– Veterans Involvement- Consistent with Department of Veteran Affairs (VA) policy, small business concerns owned and controlled by veterans shall have maximum practicable opportunity to participate in VA acquisitions, consistent with efficient contract performance and the priorities and preferences established under 38 U.S.C. 8127 and 8128. When technical factors become more equalized; veteran participation status becomes more relevant and may be given greater weight in the award decision process.

a) In order to receive full credit under this evaluation factor, the SDVOSB be registered and verified in the Veteran Small Business Certification (VetCert) at the time of submission of the offer and at the time of award at HTTPS://VETERANS.CERTIFY.SBA.GOV/ .

b) For Non-SDVOSBs/VOSBs: To receive some consideration under this evaluation factor, the Offeror must state in its proposal the names of SDVOSB(s) and/or VOSB(s) with whom it intends to subcontract, and provide a brief description and the approximate dollar values of the proposed subcontracts. Additionally, proposed SDVOSB/VOSB subcontractors must be registered and verified at the time of submission of the offer and at the time of award in the Veteran Small Business Certification (VetCert) HTTPS://VETERANS.CERTIFY.SBA.GOV/ in order to receive some consideration under this evaluation factor.

c) Past performance in meeting VA's department-wide SDVOSB subcontracting goals for 2022 and 2023: To receive some consideration under this evaluation factor, the Offeror shall submit information which evidences the offeror's past performance in meeting VA's department-wide SDVOSB subcontracting goals for 2022 and 2023. The SDVOSB subcontracts included in this past performance must have been performed by SDVOSB firms registered and verified in the Veteran Small Business Certification (VetCert) at HTTPS://VETERANS.CERTIFY.SBA.GOV/ prior to performance of the subcontract work in order to receive some consideration under this evaluation factor.

Factor 4 – Price: The offered price will be evaluated utilizing the gross rate per parking space. The Offeror shall submit the offer with the total “gross” annual price per parking space for services and utilities (operating expenses) to be provided by the Lessor, GSA Form 3626. The net (shell) and base prices combined are the total “gross” annual per parking space offered. The base price from which adjustments are made will be the base price for the term of the lease, including any firm and non-firm periods. The “gross” price shall include the “base” price.

B. See FAR Clause 52.219-4 Notice of Price Evaluation Preference for HUBZone Small Business Concerns, as listed under the attached GSA 3517A, General Clauses.

C. If an offer contains terms taking exception to or modifying any Lease provision, the Government will not be under any obligation to award a Lease in response to that offer.

B. If the offered Space is not in a Building that has earned the ENERGY STAR® Label within one year prior to the due date for final proposal revisions, Offerors are required to include in their lease proposal an agreement to renovate the Building for all energy efficiency and conservation improvements that it has determined would be cost effective over the Firm Term of the Lease, if any, prior to acceptance of the Space

E. If the offered Space is not in a Building that has earned the ENERGY STAR® Label within one year prior to the due date for final proposal revisions, the successful Offeror will be excused from performing any agreed-to energy efficiency and conservation renovations if it obtains the Energy Star Label prior to the Government’s acceptance of the Space.
