Brown Contracting Officer A.1 VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SERVICES AND CONSTRUCTION (JAN 2023) (DEVIATION)

(a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certifies that—

(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

(i) [] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.

(ii) [] General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.

(iii) [] Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 75% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.

(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.

(3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:

(i) Referral to the VA Suspension and Debarment Committee;

(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and

(iii) Prosecution for violating 18 U.S.C. 1001.

(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.

(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.

(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed and returned with the offeror’s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.

1. What is the thickness of the existing wall to be modified in G12B?

a. ACG Response: Wall is believed to be 6” or 3 5/8” stud wall. Invasive survey was not permissible. The 3 5/8” 16 ga studs to be added for welding the diamond mesh to will fit either scenario. 2 ½" 16 ga studs permissible if wall is 3 5/8”.

2. Can new bollards be sleeved in lieu of paint?

a. ACG Response: Yes

3. What is the thickness of the concrete on sheet CS100?

a. ACG Response: Borings of the concrete were not taken. Assume 6” thick.

4. It is unclear from detail 11/A-601 how to attach the new studs onto existing wall. Please provide additional front elevation showing height and attachment method for new studs.

a. ACG Response: The height of additional studs is from floor to underside of deck. Welding is called out 16” o.c. both ways, add 16 ga horizontal blocking where needed. There are mulitple acceptable ways of attachment for new studs to existing. This can be determined by cold form vendor.

5. Sheet A-100 Key Note 6 does not appear to be used in the drawing. Please indicate which windows are to receive this film and what size is needed.

a. ACG Response: Keynote 6 shows in 3 locations just below column line A. Size of film is listed in keynote.

6. Can superintendent dual-hat as SSHO?

a. Yes

7. Detail 11/A-601 shows 2 runs of stud horizontal in wall. Is this correct or are new studs attached vertically to existing studs?

a. ACG Response: Our partition details show partitions in section at floor and ceiling with break lines, then plans in the middle. Details are labeled. New 16 ga studs to be attached to existing vertical studs.

8. 01 45 00 3.4.B states the CQC System Manager must be a graduate engineer, architect, or construction manager. Can this be substituted with 5 years of quality control experience?

a. Yes

9. 01 00 00 1.23 states a project sign is required. Is a project sign needed?

a. No

10. 01 00 00 1.24 states a safety sign is required. Is a safety sign needed, or can safety information be displayed in the prime contractor’s job trailer?

a. Yes

11. 01 00 00 1.25 and 1.26 requires the contractor to provide professional photo documentation and indexing. Is it acceptable for the prime contractor to provide this through ProCore?

12. Is there a basis of design for the new pass window?

13. Some of the steel subcontactors have expressed concern about spot welding the security mesh onto metal studs, due to the possibility the welding process may melt through the studs and not provide a secure connection. Is it acceptable to use metal screws to fasten the security mesh onto the metal studs?

a. ACG Response: No

14. Detail 3/E-501 shows a PACS panel but does not indicate if it is new or existing. Is the contractor to replace the physical access control panel or tie into existing?

a. ACG Response: Elect – Tie into existing.

15. Detail 1/E-501 shows locations for all access control devices around the doors (ie. Controller Box, RX, ES, DC, etc.). Is the contractor to replace all access control devices or only replace card readers?

a. ACG Response:Elect – Install all new.

16. Detail 1/E-501 notes seem to indicate new conduit, boxes, supports and cabling for the PACS devices at each door. Is this correct?

a. ACG Response:Elect – Contractor may reuse conduit from PACS panel to door location. Contractor to install new cabling from PACS panel to door location. Provide new cabling and conduit at doors.

17. If cabling is to be replaced, is it to be replaced back to the panel, or just to the 8”x8”x4” Controller Box above the door?

52. On Sheet CS 100 will the contractor be allowed to leave the spoils from the bollards on site or will they have to be hauled off?

a. If they have to be hauled off, will the VA provide testing and inspection to make sure they are not contaminated soils?

53. On Sheet CS 100 there are several existing Underground Electrical lines where the contractor will be excavating for the bollards. How deep are these existing electrical lines Depth unknown.

a. Are they encased in concrete?

i. ACG Response: No, subsurface investigation indicates pipes are pvc and range from 0.75” - 3.5”

b. Will the contractor be required to Hydro excavate in order to not disturb these utility lines?

i. ACG Response: Contractor will be responsible for any damage caused to existing utilities shown to remain. Means and methods are at the contractor’s discretion.

60. Detail 11 on Sheet A-601, could you please provide a layout or diagram indicating the spacing and frequency of the spot welds required to attach the diamond security mesh to the metal studs? The detail does not currently specify the weld pattern or spacing, and this clarification is needed to ensure proper installation and adherence to design intent.

a. ACG Response: New add 16 gauge studs to be added to existing from floor to underside of deck. The weld pattern is spot weld, 16” o.c. both ways.

61. Detail 12 on sheet A-601, for bidding purposes please provide some kind of basis of design for the Plastic Laminate, so that the bidders are not guessing on what the VA will choose?

85. We are getting ready to change out the fire alarm system from Simplex to Edwards EST. Will these devices and relays be compatible with that system since these were not installed when the Fire Alarm design was done?

a. ACG Response: In general, addressable simplex devices will not work with Edwards control panels. Some conventional devices may work. We would recommend replacing Simplex with Edwards devices.
