ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

EVALUATION FACTORS CRITERIA

COMPARATIVE EVALUATION PER FAR 13

TOTAL SET ASIDE FOR SMALL BUSINESSES

1. General considerations:

1. Although the solicitation is Total Small Business Set Aside based on Market Research done, the Department of Veterans Affairs will implement the Veterans First Contracting Program P.L. 109-461 and the VA Rule of Two – means the process in 38 U.S.C. 8127 (d) whereby a contracting officer of the Department “shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans, if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers, and that the award can be made at a fair and reasonable price that offers the best value to the United States.” SDVOSBs are encouraged to participate in this Total Small Business Set Aside. If SDVOSB or VOSB; the offeror shall be registered in VetBiz at the time of award.

1. The Government will determine acceptability by assessing the offeror’s compliance with the terms of the Request for Quotations to include the technical information required by the Performance Work Statement (PWS).

1. The Government will evaluate the quotations received as per FAR 13.106-2(b)(2)-Comparative Evaluation in FAR 13:

i. Quotations will be evaluated in an impartial manner.

ii. Contracting will conduct a comparative evaluation of offers.

iii. All quotations will be considered; however, those offers having the highest past performance rating will represent the best value, when compared to any lower priced quotation/offer.

iv. Quotations/Offers in response to this solicitation shall be provided, preferably, via postal mail or in person due to e-mail limitations to:

v. If you elect to submit your offer/quotation electronically via email, please confirm that all information was transmitted, and received on time, due to e-mail limitations. The Government will not be responsible for any not transmitted data. The email to submit your entire package is AQG@va.gov or America.Quinones-Gonzalez@va.gov. Late submittals will be considered pursuant FAR 52.212-1(f).

vi. A Site Visit is scheduled for:

Monday, June 4, 2018 at 8:30 am AST, PR-Time Meeting Office: Facility Management Service (FMS) – Main VA Building-Basement

The Questions due date on this solicitation is:

Thursday, June 7, 2018 at 4:00 pm AST-Puerto Rico Time. Please submit your questions to the CO, America.Quinones-Gonzalez@va.gov and the COR: Ms. Luz E. Muriel-Diaz at Luz.Muriel-Diaz@va.gov, and/or to the Supervisory Contract Specialist, Mr. José I. Hernández at Jose.Hernandez6@va.gov

vii. Offers/Quotations shall be submitted by or before Tuesday, June 12, 2018 and not later than 2:00 PM AST-PR Time.

1. At minimum, the Government will determine contractor’s responsibility by analyzing whether the apparent successful offeror complies with the requirements of FAR 9.1 including, but not limited to:

i. Adequate financial resources or the ability to obtain them;

ii. Ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;

iii. Satisfactory record of integrity and business ethics;

iv. Necessary organization, experience, and skills or the ability to obtain them;

v. Necessary equipment and facilities or the ability to obtain them; and

vi. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

BASIS FOR AWARD: The award will be made in a uniform and fair manner to determine which quote/offer provides the government what it needs, where, and when as identified in the Request for Quotations – Performance Work Statement. It will be an assessment of which response is “best” as a whole. Once one quotation/offer is found acceptable, it is compared side by side to the remaining ones, and the “best” one is chosen.
