B.2 STATEMENT OF WORK
STATEMENT OF WORK
Fuel Oil Removal, Tank Cleaning, and Permanent Out-of-Service Safeguarding
1. Scope The contractor shall provide all labor, supervision, equipment, materials, transportation, and disposal services necessary to remove the remaining #2 fuel oil from an out-of-service above-ground storage tank (AST) at the Atlanta VA Medical Center; clean and decontaminate the tank interior; render the tank vapor-free at the time of testing and place it in a safe condition for permanent out-of-service status; safeguard the tank against tampering or unauthorized reuse; and provide documentation of final tank condition and waste disposition. Physical removal of the tank is not included.
1.1 Place of Performance
Joseph Maxwell Cleland VA Medical Center, 1670 Clairmont Road, Decatur, GA 30033. The tank and work area are exterior to the main hospital building.
1.2 Period of Performance
The period of performance shall begin upon contract award or written authorization to proceed by the Contracting Officer and shall not exceed 30 calendar days. On-site work is expected to be completed in one to two workdays.
1.3 Contract Type
Firm-Fixed-Price.
1.4 Points of Contact
The Contracting Officer’s Representative (COR) is Ioana St Amand. The contractor shall not accept technical direction from any individual other than Ioana St Amand and/or the Contracting Officer.
1.5 Tank Information
The tank is a 4,500-gallon nominal capacity above-ground tank containing an estimated 3,000 gallons of #2 fuel oil (based on a measured fuel depth of approximately 40 inches). The estimated fuel quantity is provided for planning and pricing purposes only. The contractor shall verify and document the actual quantity removed.
2. Applicable Standards The contractor shall perform the work in accordance with the applicable requirements, including but not limited to:
1. NFPA 30, Flammable and Combustible Liquids Code (provisions for above-ground tanks taken out of service);
1. NFPA 326, Standard for the Safeguarding of Tanks and Containers for Entry, Cleaning, or Repair;
1. OSHA 29 CFR 1910.146 (Permit-Required Confined Spaces) and 29 CFR 1910.120 (HAZWOPER), as applicable;
1. EPA RCRA and used oil management standards (40 CFR Part 279), as applicable;
1. DOT Hazardous Materials Regulations (49 CFR Parts 100–185), as applicable;
1. Georgia EPD requirements; and the Authority Having Jurisdiction (AHJ).
Where requirements conflict, the more stringent shall apply. Where the contractor identifies an apparent conflict that cannot be resolved by application of the more-stringent rule, the contractor shall notify the COR and Contracting Officer before proceeding and shall follow the direction of the AHJ and applicable law. The contractor shall obtain or complete any permits, notifications, facility approvals, waste profiles, transportation documents, or disposal/recycling approvals required for the contractor’s work, including fuel removal, tank cleaning, waste handling, transportation, recycling, treatment, disposal, and permanent out-of-service safeguarding.
3. Specific Tasks
3.1 Pre-Work Coordination
1. A pre-work site visit is not required, but may be conducted if requested by the contractor or the Contracting Officer. If the contractor elects not to conduct a site visit, the contractor remains responsible for verifying means, methods, access, equipment needs, and site conditions necessary to complete the work within the awarded firm-fixed price.
1. Submit a brief work plan, schedule, and site-specific health and safety plan (including a confined-space entry plan if tank entry is required) to the COR at least five (5) business days before mobilization.
1. Provide not less than 72 hours advance notice of mobilization.
3.2 Waste Characterization
1. Characterize and profile the #2 fuel oil and each secondary waste stream (oily water, sludge, sediment, rinsate, absorbents, used PPE) based on analytical data, generator knowledge, and applicable regulations.
1. Submit waste profiles and receiving facility approvals before shipment of each waste stream, unless the receiving facility allows management under an existing approved profile or other lawful acceptance process. Copies shall be provided to the COR.
1. The Government makes no representation as to whether any waste stream is hazardous or non-hazardous; the contractor shall manage all wastes in accordance with their actual regulatory status.
3.3 Fuel Removal and Final Disposition
1. Pump out the #2 fuel oil from the tank using a properly equipped vacuum truck.
1. Measure or meter the actual quantity removed and document it at the point of transfer.
1. Transport the recovered fuel to an authorized receiving facility under proper DOT shipping papers, placarding, and labeling.
1. Determine the final disposition of the recovered fuel — recycling, reclamation, treatment, energy recovery, or disposal — based on material characterization, receiving facility acceptance, and applicable requirements. Recycling or reclamation is permitted and preferred where lawful and feasible. The contractor remains responsible for completing the work within the awarded firm-fixed price regardless of the disposition path selected.
3.4 Tank Cleaning and Decontamination
1. Clean and decontaminate the tank interior to remove residual fuel, sludge, sediment, and film, in accordance with NFPA 326 and applicable industry practice.
1. Where tank entry is required, perform the work under OSHA permit-required confined-space entry procedures (29 CFR 1910.146).
1. Use pressure washing or other appropriate cleaning methods compatible with the tank.
1. Collect all wastewater, rinsate, sludge, and sediment generated during cleaning.
1. Hot work (welding, cutting, grinding, open-flame operations) is prohibited unless separately authorized through the VA hot-work permit process and approved by the Contracting Officer if it represents a change in scope.
3.5 Vapor-Free Status and Atmospheric Testing
1. Render the tank interior vapor-free at the time of testing, in accordance with NFPA 30 and NFPA 326.
1. Perform atmospheric testing using a calibrated combustible-gas indicator (and oxygen meter, as applicable) to verify vapor-free status at the time of testing.
1. Provide written documentation, signed by a qualified person, of atmospheric test results and the tank’s safe condition at the time of completion.
3.6 Permanent Out-of-Service Safeguarding
Upon completion of cleaning and atmospheric testing, the contractor shall safeguard the tank for permanent out-of-service status by performing all of the following, except where modified by the COR or AHJ:
1. Drain residual liquid and leave the tank visibly clean and dry.
1. Cap, plug, blind, or otherwise mechanically secure all tank openings (manway, fill, vent, gauge, etc.) and product piping connections at the tank, by mechanical means appropriate to each connection (e.g., threaded plug or blind flange; welded caps are not within this scope). The contractor shall not alter, cut, or remove piping or appurtenances beyond the closures necessary to safeguard the tank, except as specifically authorized in writing by the COR.
1. Leave the tank vent open to atmosphere or otherwise configured per AHJ direction. The contractor shall not seal a tank vent without specific written direction from the COR and AHJ.
1. Secure the manway and other access openings using tamper-resistant fasteners or padlocks.
1. Apply durable, weather-resistant labels to the tank shell and at each access point indicating: “OUT OF SERVICE – EMPTY – VAPOR FREE – DO NOT FILL,” the date of cleaning, and the name of the cleaning contractor. Equivalent wording approved by the COR or AHJ may be substituted.
3.7 Secondary Waste Management
1. Containerize, label, manifest, and transport each waste stream to a permitted facility for disposal or recycling, in accordance with applicable EPA, DOT, state, and local regulations.
1. Discharge no fuel, wastewater, rinsate, or other residue to VA storm drains, sanitary sewer, soil, surface water, or any other location on or off VA property.
3.8 Deliverables
1. Pre-work plan, schedule, and site-specific health and safety plan (including confined-space entry plan, if applicable) prior to mobilization.
1. Approved waste profiles or evidence of acceptance under an existing profile prior to shipment of each waste stream.
1. Shipping papers, manifests, bills of lading, disposal tickets, recycling certificates, or other receiving facility documentation, as applicable, at the time of each shipment.
1. Certificates of disposal, recycling, or destruction within 30 calendar days of the final shipment.
1. Atmospheric test records and signed documentation of the tank’s safe condition at the time of completion.
1. A final completion report within 15 business days of completing on-site work, including: quantities of fuel removed and waste disposed; receiving facility names, addresses, and EPA ID or permit numbers, if applicable; final disposition path; dates of service; cleaning method; atmospheric test results; safeguarding measures performed; and final tank condition.
1. Invoice documentation shall include, at minimum, the contract/order number, date of service, quantities removed, waste streams generated, manifests or bills of lading, receiving facility documentation, and certification/disposition documents supporting the completed work.
4. Acceptance All work is subject to review and acceptance by the COR. The Government will accept the work when fuel has been removed, the tank cleaned and tested vapor-free at the time of completion, safeguarding measures (Section 3.6) completed, all waste removed from VA property, and all required documentation delivered. The contractor shall correct deficient work or documentation at no additional cost to the Government.
5. Hours of Work Monday–Friday, 7:30 AM – 4:30 PM. Weekend or after-hours work is permitted with COR approval.
6. Safety The contractor shall comply with VA safety requirements; OSHA confined space and HAZWOPER standards as applicable; NFPA 30 and NFPA 326; lockout/tagout for contractor equipment; and DOT placarding and labeling for transportation. Spill kits and containment shall be staged at the work area for the duration of the work. The contractor is responsible for the immediate containment, cleanup, and lawful disposal of any spill caused by contractor operations, and for any required regulatory notifications. The contractor shall immediately notify the COR and designated VA site contact of any spill, release, leak, fire, injury, property damage, unsafe condition, or unexpected tank condition encountered during the work.
7. Site Conduct
1. Contractor personnel shall check in with Engineering Service.
1. Escort required as determined by VA staff.
1. Contractor vehicles are limited to two (2) and shall be legally parked in designated areas. The pump/vacuum truck shall have access to the tank as needed to perform the work; staging and parking shall be coordinated with the COR.
1. Photography on VA property only with prior COR approval.
1. The Atlanta VA Medical Center is a tobacco-free campus; tobacco use of any kind is prohibited on VA property.
8. General Provisions The contractor shall be self-sufficient for all equipment, tools, pumps, hoses, lighting, ventilation, confined-space equipment, PPE, containers, and safety equipment. Use of VA water or electrical service is not guaranteed and must be approved in advance by the COR.
COR approvals under this SOW are for technical coordination and site access only and do not authorize changes in contract scope, price, or period of performance. Changes to scope, price, or period of performance must be authorized by the Contracting Officer.
