Questions

Question # 1 Is there any government-owned equipment used in conjunction with this contract?

Response: Please specify what type of government-owned equipment are you referring to.

Question # 2 CLIN 0004, 1004, 2004, 3004, 4004 – Stand / Racks for Portable Cylinders

Is this for rental of stands/racks for portable oxygen cylinders OR larger M/H Cylinders?

Response: The stands/racks are rentals (contractors-owned)

Question # 3 CLIN 0010, 1010, 2010, 3010, 4010 – Ventilator IC 2A

Are these contractors-owned ventilators rented to the VA?

Response: Yes

Question # 4 Can new home oxygen setups be completed by a properly trained HME Technician?

Response: All new oxygen setups and in the event, re-education will be performed by the contractor’s trained personnel as stated in the performance work statement.

1. Will the government please confirm which medical facilities the contractor will be required to have a business location within 50 miles of? Please also confirm which counties the medical centers are located in. Please refer to the performance work statement provided under the section labeled location.

2. Performance Work Statement Section 2.3 d. mentions “Equipment shall be delivered within 4 hours of the request.” Will the government change the requirement to within 6 hours of discharge instead of 4 hours? This change is consistent with other VISN contracts and commercial home oxygen response times.

The 4-hour requirement will remain at this time.

4. Please confirm that CLIN 22 will be used to bill for the emergency services described in Performance Work Statement section 3.8. The government will satisfy its debts for services rendered based on the contractual agreement of the performance work statement.

5. Performance Work Statement section 4.1 a. mentions “At least once every 30 days the Contractor shall visit the patient to reassess equipment compliance, and educational needs, and to perform an environmental survey.” Will the government change the requirement to 90 days for reassessments to be consistent with other VISN contracts? The 30-day requirement will remain at this time.

6. Performance Work Statement section 4.1.7 mentions “The report shall be submitted by the Contractor in both hard copy and on electronic media (DVD or CD).” Will the government also allow the reports to be submitted by secure or encrypted email?

7. Performance Work Statement section 4.2 b. mentions “All electrically powered equipment used in the performance of this contract shall be UL-approved and shall be the most recently developed in the field at the time of use and not more than three (3) years old.” Will the government remove this requirement as the age of the machine is not indicative of proper performance. This requirement will remain at this time.

8. Please distinguish the unit of measure on the price schedule to differentiate rental items from one-time services. For example, CLIN 10 says ventilator but does not say rental. CLIN 13- 16 say tanks but don’t say rental or refill. Every line item should indicate a rental or one time charge to ensure the offerors have the required information to bid. Noted unit of measure is rental, to refer to the performance work statement.

9. As a follow-on question, is a rental fee paid for all cylinders and are refills paid for all cylinders? Please refer to the performance work statement.

10. Performance Work Statement section 5.3 f. mentions “Each employee visiting patients’ homes shall have five (5) unannounced follow-up visits by a supervisor each quarter…” Would the government consider changing the unannounced visit requirement to once a quarter per employee? This requirement will remain at this time.

11. Performance Work Statement section 5.13 a. mentions “At the Government’s request, the Contractor may be required to attend and participate in some meetings face-to-face with the VA facility rather than by teleconference.” Will the government limit the requested in-person meetings to no more than once a quarter? The government accepts this recommendation, however, in unforeseen occurrences such as recalls, emergencies, disasters, or any issue that would be deemed life-threatening the contractor will be available by phone, face-to-face, or teleconference within two hours.

12. Performance Work Statement section 7.13 lists acceptable quality levels per service requirement. Will the government consider changing the acceptable quality levels to no greater than 95% as the highest acceptable quality level for all service requirements? This is consistent with other VISN contracts for home oxygen. This requirement will remain at this time.

1. As the Invacare “Homefill system” is not currently manufactured could we please adjust or remove CLINs referencing this item? Your response is noted, per the performance statement, the service is to provide a home-fill oxygen system.

2. CLINS XX13-16 are for B, C, D, & E tanks. The “Principal NACIS Code” noted in the CLIN description is a rental code. Is this CLIN for rental of Cylinder? If so, is the quantity the number that are on rent or the number of refills. Also if it is rent does the price include refills?

This service is a rental and the price does include refills.

3. Would it be possible to provide an excel sheet for the pricing? Please refer to the performance work statement provided.

Page 24: Paragraph 5.7 a. provides:

Offers will be considered only from offerors who are regularly established in the business called for and who, in the judgment of the Contracting Officer, are financially responsible and able to show evidence of their responsibility, ability, experience, equipment, facilities, and personnel directly employed or supervised by them to render prompt and satisfactory service in the volume required for all items under this contract.

Page 24: Paragraph 5.8 a further provides:

The Contractor shall maintain service location(s) that is (are) physically located within the geographic area covered by the area of responsibility/jurisdiction that the Contractor shall provide home oxygen services (specifically for performance of emergency service requirements).

Question 1: Are offerors required to have the equipment, facilities, and personnel required for performance under this contract in place prior to submitting an offer as these paragraphs seem to require? If not, are offerors required to have the equipment, facilities, and personnel required for performance under this contract in place before award?

Page 25: Paragraph 5.12 a. provides:

The Contractor and his/her employees shall conform to all regulations, Federal, state, and local, governing the performance of contracted services in each state in which performance occurs. By signing this offer, the offeror is certifying that he/she shall meet all requirements of Federal, State, and local laws, codes, and/or regulations regarding the operation of this type of service.

Since healthcare is ever-evolving and life-sustaining measures such as oxygen and ventilatory therapy are critical to our Veterans factors such as past performance, and experience, are well-thought-out.

Question 7: Is the experience of any proposed subcontractors considered relevant to the evaluation of an offeror’s experience?

Page 95: Past Performance. The past performance of the apparent successful offeror will be reviewed by the contracting officer prior to award as part of the contracting officer’s responsibility determination per FAR Part 9.

The Government will award a single award 5-Year IDIQ with 5 separate pricing periods.

Question 8: The FAR guidance on past performance contains several references to the importance of the relevance of past performance and the GAO has interpreted those provisions as imposing a mandatory requirement on agencies to assess the relevance of past performance. What evaluation scheme will the VA use to rate an offeror’s past performance in accordance with the relevance of their experience?

Based on the offeror's prior knowledge, skills, and abilities gained from providing oxygen and ventilatory services for the private, public, or other organizations that have been submitted and can be verified.

Question 9: The Solicitation is silent as to what types of contracts are relevant to the instant procurement. What factors will the VA use to evaluate an offeror’s past performance?

It is the government's responsibility to provide the highest quality service to our Veterans.

As a result, the government evaluation will be all-encompassing based on the performance work statement.

Question 10: The Solicitation is silent as to the minimum number of contracts an offeror is required to submit for the past performance evaluation. How many relevant contracts must an offeror include in its proposal?

The past performance submitted to the government for evaluation should include the offeror’s ability to complete the services listed as specified in the performance work statement.

Question 11: The Solicitation is silent as to how recent an offeror’s past performance must be for it to be considered relevant to instant procurement. How will the VA determine whether an offeror’s past performance is recent enough to be considered relevant to this effort? Duplicate question
