PERFORMANCE WORK STATEMENT (PWS)

Golf Cart Preventive Maintenance and Repair Services Hampton VA Medical Center Hampton, Virginia

1. GENERAL

1.1 Purpose

The purpose of this Performance Work Statement (PWS) is to obtain contractor-provided preventive maintenance, inspection, troubleshooting, and repair services for Government-owned golf carts and utility vehicles located at the Hampton VA Medical Center (VAMC), Hampton, Virginia. The objective is to maintain the fleet in safe, reliable, and serviceable operating condition while minimizing downtime.

1.2 Scope

The Contractor shall provide all personnel, supervision, tools, diagnostic equipment, transportation, and other items and services necessary to perform the work described in this PWS, except for those items specifically identified as Government-furnished. Services shall include scheduled preventive maintenance, safety inspections, diagnosis of malfunctions, repairs authorized by the Contracting Officer, and maintenance documentation for the covered fleet.

1.3 Place of Performance

Services may be performed at Hampton VA Medical Center or at the Contractor’s off-site service facility. The Contractor may pick up Government-owned golf carts and utility vehicles for preventive maintenance and repairs and shall coordinate pickup and return with the COR or designated Service point of contact in advance.

The Contractor shall provide transportation to and from its service facility and safeguard Government vehicles while in its possession. Transportation charges, if any, shall be identified in the contract’s pricing schedule. Off-site servicing does not independently authorize repairs or charges requiring prior Contracting Officer approval.

1.4 Period of Performance

The period of performance shall be as stated in the contract/order, including any option periods exercised by the Government.

1.5 Hours of Performance

Routine services shall normally be performed during Hampton VAMC business hours, Monday through Friday, excluding Federal holidays, unless otherwise coordinated with the COR. Work that may interfere with facility operations shall be scheduled in advance.

2. FLEET COVERED

The current fleet consists of the following 39 Government-owned golf carts/utility vehicles:

Manufacturer / Type
Quantity
Star EV
6
Polaris GEM
2
Gatormoto Utility LLC
1
Toro
3
MotoElectric
7
Icon
1
E-rides
15
Pilotcar
1
Kubota Tractor
3

Fleet substitutions may occur during the contract due to normal replacement of Government vehicles. A replacement vehicle may be substituted for an existing covered vehicle when the total quantity remains unchanged and the substitution does not materially change the nature or level of effort. Any increase in quantity or material change in scope requires authorization by the Contracting Officer and, when required, a contract modification.

3. PERFORMANCE REQUIREMENTS

3.1 Preventive Maintenance

The Contractor shall develop and follow a preventive maintenance schedule appropriate for each make/model and consistent with the manufacturer's recommended maintenance intervals. At a minimum, preventive maintenance shall include inspection, servicing, adjustment, and functional testing of applicable systems.

Tire condition and tire pressure.

Battery condition, terminals, cables, electrolyte/water level when applicable, charging system, and state of charge.

Brakes, parking brake, brake adjustment, and stopping function.

Steering, suspension, wheel condition, and related fasteners.

Lights, horn, reverse warning devices, mirrors, seat belts, and other installed safety equipment, as applicable.

Accelerator/throttle operation and direction controls.

General inspection for leaks, loose or missing hardware, structural damage, and unsafe conditions.

3.2 Scheduled Service

The Contractor shall coordinate the preventive maintenance schedule with the COR. Scheduled maintenance shall be completed by the agreed due date unless the COR approves an alternate date. The Contractor shall avoid unnecessary removal of vehicles from service and shall return vehicles to the Government promptly after completion of work.

3.3 Repair Services

The Contractor shall diagnose reported malfunctions and provide repair recommendations. No repair outside the firm-fixed-price preventive maintenance scope, if any, shall be performed without authorization from the Contracting Officer or other written authorization expressly permitted by the contract. Repair recommendations shall identify the problem, proposed corrective action, estimated labor, parts/materials, and estimated completion time.

3.4 Parts and Materials

Replacement parts shall be new and suitable for the specific make/model unless the contract expressly permits another condition. Parts shall meet or exceed the applicable original equipment manufacturer's specifications. The Contractor shall obtain approval before installing parts that are separately billable to the Government.

3.5 Safety Deficiencies

The Contractor shall immediately identify to the COR any condition that makes a vehicle unsafe to operate. A vehicle determined unsafe shall not be returned to service until the condition is corrected or the Government accepts an authorized interim disposition.

3.6 Service Calls and Response

For unscheduled maintenance requests, the Contractor shall acknowledge the service request within one business day. The Contractor shall provide a diagnosis or status update as soon as practicable after inspection and shall keep the COR informed of delays caused by parts availability, manufacturer support, or other conditions affecting completion.

4. DELIVERABLES AND DOCUMENTATION

SECTION C - CONTRACT CLAUSES

C.1 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (OCT 2025) (DEVIATION)

(a) Definitions. The clause at Federal Acquisition Regulation (FAR) 52.202-1, Definitions, is incorporated by reference.

(b) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post acceptance rights—

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(c) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(d) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(e) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause FAR 52.233-1, Disputes, which is incorporated in this contract by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence. Examples of occurrences include acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. When an excusable delay occurs, the Contractor shall—

(1) Notify the Contracting Officer in writing as soon as possible;

(2) Remedy the delay as quickly as possible; and

(3) Notify the Contracting Officer when the occurrence is over.
