B.3 PERRFORMANCE WORK STATEMENT

1.0 BACKGROUND

The CGVAMC is seeking to procure non-personal mail room services for a variety of tasks inclusive of typical mail room operations.

1.1 Period of Performance

The requirement for this procurement will be one (1) base year and four (4) option years. The estimated period of performance for this task order is:

Base Period:October 1, 2019 – September 30, 2020
Option Period 1:October 1, 2020 – September 30, 2021
Option Period 2:October 1, 2021 – September 30, 2022
Option Period 3:October 1, 2022 – September 30, 2023
Option Period 4:October 1, 2023 – September 30, 2024

2.0 SCOPE:

The Contractor shall perform all tasks associated with mail room operations. This includes but is not limited to: mail pickup, sorting, delivery, return, pharmaceutical mail requirements, track incoming and outgoing mail and packages internally using SendSuite software applications, and any other tasks necessary for the successful operation of a federal facility mailroom.

3.0 QUALIFICATIONS:

3.1 Where required, personnel assigned by the Contractor to perform the services covered by this contract shall be currently licensed in a State, Territory, or Commonwealth of the United States or the District of Columbia to operate a motor vehicle. Qualified personnel must be American citizens (or offer evidence of a green card) and be proficient in the English language. The Contractor shall bear all expenses associated with any, and all licensure requirements. The contractor shall include personnel qualifications with their proposal.

3.2 The Contractor shall comply with all Department of Transportation and State of Origin requirements for operating commercial vehicles on public highways. The Contractor shall bear any, and all expenses associated with compliance of Federal and State of Origin Transportation authorities.

3.3 Provide documentation the offeror and prospective contract employees are experienced in operation of a federal facility mailroom.

4.0 SPECIFIC TASKS

4.1 Contractor shall possess the capability to support all three Outpatient Clinics (Franklin, NC, Hickory, NC and Rutherfordton, NC).

4.2 Contractor shall own a USPS meter account and own the equipment associated with meter account

4.3 The Contractor shall perform the following tasks daily:

(a) Pick up incoming mail from the local (28805) United States Post Office

(b) Deliver mail to CGVAMC mailbox room and sort mail into the boxes

(c) Sort incoming mail by service line and place in the specific box for that service.

(d) Scan to Send Suite to initiate the tracking process.

(e) Scan all outgoing mail to maintain the internal tracking process.

(f) Process outgoing mail for postage and ensure all outgoing mail is delivered to USPS prior to 5:00pm daily.

(g) Process all packages for the United States Postal Service (USPS) postage and tracking.

(h) Pick up mail from the CGVAMC in the afternoon

(i) Bring mail from the CGVAMC to their own facility and meter the mail on their account and deliver mail to Charlotte, NC sorting facility by 7 pm sharp

(j) Keep work area neat and in compliance with facility safety mandates.

*NOTE* The government shall provide the contractor with the facility safety policy.

4.3.1 The contractor shall submit a detailed plan outlining how the above tasks are to be completed, to include to the following:

(a) Personnel orientation to the medical facility;

(b) Mail distribution deadline(s);

(c) Parcel delivery times;

(d) Deadline for Service Lines’ outgoing mail drop off;

(e) Outgoing mail processing deadline;

(f) Preparing shipping labels for outgoing parcels, regardless of the shipping method (USPS, UPS, FEDEX, etc.).

NOTE: Mail customers shall be responsible for all packaging associated with shipping parcels.

4.4 GOVERNMENT FURNISHED EQUIPMENT

The Government will provide three carts, workspace, personal computers (to be quantified at time of award), and routine office supplies necessary to complete mailroom operations in performance of this contract. Off campus use of government furnished equipment is not allowed.

5.0 BACKGROUND INVESTIGATIONS

All contract personnel providing services under this contract shall be required to be fingerprinted and undergo a National Agency Check with Written Inquiries (NACI) background investigation. No contract personnel shall be allowed to perform under this contract until fingerprints have been favorably adjudicated and/or background investigations have been completed. Fingerprints favorably adjudicated within 120 days and BIs conducted within the past five (5) years are acceptable. The Contractor shall be responsible to present evidence of fingerprint adjudication and completed BIs for personnel performing under this contract to the CO.

5.1 The Contractor shall bear all expenses incurred for background investigations and fingerprint adjudication.

5.2 Contract employees shall be issued a VA Personal Identity Verification (PIV) card. The PIV card shall be displayed above the waist while contract employees are on CGVAMC property IAW CGVAMC policy.

5.2.1 Contract personnel shall notify the Contractor, Contractor’s manager/supervisor, and the COR immediately if the PIV card is lost, stolen, or does not function. The COR will assist the Contractor’s manager/supervisor in reporting lost/stolen cards and obtaining a replacement card.

5.3 PIV cards for Contract personnel shall be surrendered to the Contractor’s supervisor/manager immediately when Contract personnel will no longer be employed by the Contractor and upon contract expiration/termination. The Contractor’s manager/supervisor shall notify the COR within 24 hours of any contract employee no longer employed by the Contractor.

6.0 DELIVERABLES

The contractor shall provide the following within seven (7) calendar days of contract award:

(a) Documentation individuals performing under this contract are licensed to operate a motor vehicle in the State of North Carolina.

(b) Documentation individuals performing under this contract are experienced in mail room operations in a Federal facility.

(c) Task Completion Plan

(d) Documentation of BIs completed within the last five (5) years, where applicable.

(e) Documentation of fingerprint adjudications within the last 120 days from contract award, where applicable.

(f) Quality Assurance Surveillance Plan (QASP).

6.0 INVOICING / PAYMENT:

The Contractor shall submit invoices monthly in arrears, itemizing the services performed under this contract. All invoices shall be submitted electronically in the Tungsten/OB10 Network.

7.0 CONTRACT ADMINISTRATION DATA:

The CO is the only person authorized to approve changes or modify any or all of the requirements under this contract. The Contractor shall communicate with the CO on all matters pertaining to the contract. In the event the Contractor effects any such change at the direction of any person other than the CO, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof.

7.1 All contract administration functions will be retained by the Department of Veterans Affairs. After contract award, all inquiries and correspondence relative to the administration of the contract shall be addressed to:

8.0 MANAGEMENT AND SUPERVISION OF CONTRACT PERSONNEL

The Contractor shall be responsible for supervising the daily services provided under this contract and shall provide an on-site supervisor whenever contract personnel are on VA property. The Contractor shall provide the name and contact information for a person designated to manage and supervise performance under this contract to the CO upon award of the contract.

9.0 CONTRACTING WITH PARTIES LISTED ON THE OIG LIST OF EXCLUDED

IN DIVIDUALS/ENTITIES:

9.1 IAW The Health Insurance Portability and Accountability Act (HIPAA) and the Balanced Budget Act (BBA) of 1977, the Office of Inspector General (OIG) has established a list of parties and entities excluded from Federal health care programs. Specifically, the listed parties and entities may not receive Federal Health Care program payments due to fraud and/or abuse of the Medicare and Medicaid programs.

9.2 Therefore, all offerors shall review the OIG List of Excluded Individuals/Entities on the OIG web site at www.hhs.gov/oig to ensure that the proposed candidate(s) and/or firm(s) are not listed. Offerors should note that any excluded individual or entity that submits a claim for reimbursement to a Federal health care program, or causes such a claim to be submitted, may be subject to a Civil Monetary Penalty (CMP) of $10,000 for each item or service furnished during a period that the person or entity was excluded and may also be subject to treble damages for the amount claimed for each item or service. CMPs may also be imposed against health care providers and entities that employ or enter into contracts with excluded individuals or entities to provide items or services to Federal program beneficiaries.

9.3 By signing the quote, the Contractor certifies that he/she has reviewed the OIG List of Excluded Individuals/Entities and that the proposed candidate(s) and/or firm are not listed as of the date the offer/bid was signed.

10.0 NO SMOKING POLICY

Except in designated areas smoking is strictly prohibited on CGVAMC property.

11.0 TRAINING

All contractor employees and subcontractor employees requiring access to VA information and VA information systems shall complete the following before being granted access to VA information and its systems:

(1) Sign and acknowledge (either manually or electronically) understanding of and responsibilities for compliance with the Contractor Rules of Behavior, Appendix E relating to access to VA information and information systems;

(2) Successfully complete the VA Information Security Awareness and Rules of Behavior training and annually complete required security training;

(3) Successfully complete the appropriate VA privacy training and annually complete required privacy training; and

(4) Successfully complete any additional information security or privacy training, as required for VA personnel with equivalent information system access.

11.1 The contractor shall provide to the contracting officer and/or the COR a copy of the training certificates and certification of signing the Contractor Rules of Behavior for each applicable employee within one (1) week of the initiation of the contract and annually thereafter, as required.

11.2 Failure to complete the mandatory annual training and sign the Rules of Behavior annually, within the timeframe required, is grounds for suspension or termination of all physical or electronic access privileges and removal from work on the contract until such time as the training and documents are complete.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and SIX (6) months.

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective—

(1) For such period as the laws of the State in which this contract is to be performed prescribe; or

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

C.5 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

C.6 52.237-3 CONTINUITY OF SERVICES (JAN 1991)

(a) The Contractor recognizes that the services under this contract are vital to the Government and must be continued without interruption and that, upon contract expiration, a successor, either the Government or another contractor, may continue them. The Contractor agrees to (1) furnish phase-in training and (2) exercise its best efforts and cooperation to effect an orderly and efficient transition to a successor.

(b) The Contractor shall, upon the Contracting Officer's written notice, (1) furnish phase-in, phase-out services for up to 90 days after this contract expires and (2) negotiate in good faith a plan with a successor to determine the nature and extent of phase-in, phase-out services required. The plan shall specify a training program and a date for transferring responsibilities for each division of work described in the plan, and shall be subject to the Contracting Officer's approval. The Contractor shall provide sufficient experienced personnel during the phase-in, phase-out period to ensure that the services called for by this contract are maintained at the required level of proficiency.

(c) The Contractor shall allow as many personnel as practicable to remain on the job to help the successor maintain the continuity and consistency of the services required by this contract. The Contractor also shall disclose necessary personnel records and allow the successor to conduct on-site interviews with these employees. If selected employees are agreeable to the change, the Contractor shall release them at a mutually agreeable date and negotiate transfer of their earned fringe benefits to the successor.

(d) The Contractor shall be reimbursed for all reasonable phase-in, phase-out costs (i.e., costs incurred within the agreed period after contract expiration that result from phase-in, phase-out operations) and a fee (profit) not to exceed a pro rata portion of the fee (profit) under this contract.

C.7 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

(a) In an effort to achieve socioeconomic small business goals, depending on the evaluation factors included in the solicitation, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business status and their proposed use of eligible service-disabled veteran-owned small businesses and veteran-owned small businesses as subcontractors.

(b) Eligible service-disabled veteran-owned offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the Service-Disabled Veteran-Owned and Veteran-owned Small Business Status evaluation factor. (a) This solicitation includes FAR 52.219-14 Limitations on Subcontracting.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.11 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of North Carolina. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(i) 52.203-13, Contractor Code of Business Ethics and Conduct (OCT 2015) (41 U.S.C. 3509).

(ii) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions)).

(iii) 52.204–23, Prohibition on Contracting for Hardware, Software, and Services Developed or Provided by Kaspersky Lab and Other Covered Entities (Jul 2018) (Section 1634 of Pub. L. 115–91).

(iv) 52.219–8, Utilization of Small Business Concerns (Oct 2018) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. If the subcontract (except subcontracts to small business concerns) exceeds $700,000 ($1.5 million for construction of any public facility), the subcontractor must include 52.219–8 in lower tier subcontracts that offer subcontracting opportunities.
