B.2 LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

B.4 STATEMENT OF WORK

A. GENERAL REQUIREMENTS

1. Contractor shall provide all necessary equipment, labor, materials, and supervision to perform required interval preventative maintenance, inspection, routine, and emergency repairs on Fire Alarm Systems, to include fire alarm, fire alarm monitoring devices, and related components located at the Salem VA Medical Center, 1970 Roanoke Boulevard, Salem, VA 24153 and all its outlying buildings. Contractor shall also provide emergency repair call services.

2. Contractor shall provide a qualified individual, defined as a technician who is factory trained, certified, and authorized as a representative of the major equipment manufacturer Simplex; National Institute for Certification in Engineering Technologies (NICET) fire alarm certified; International Municipal Signal Association (IMSA) fire alarm certified; certified by the Commonwealth of Virginia; and/or trained and qualified by an organization listed by a national testing laboratory for the servicing of fire alarm systems, to perform Testing, Maintenance, Inspections, and any necessary repairs.

3. Contractor shall test and inspect Fire Alarm Systems, to include fire alarm, fire alarm monitoring devices, and related components quarterly, semi-annually, and annually. Contractor shall provide documentation for all previously mentioned tests and inspections. All work shall be in accordance with VA Master Specifications; the most current NFPA Codes including but not limited to National Fire Alarm Code and Life Safety Code; and the most current Joint Commission requirements. Testing, Maintenance and Inspection frequency shall be in accordance with the previously mentioned standards and all applicable reports will be provided within 5 business days following each inspection. Emergency services for critical system failures shall be initiated within four (4) hours of notification. Performance and quality of work shall be evaluated by assuring all testing, maintenance, and inspection services are conducted in the appropriate timeframe and all devices/systems are tested according to the previously mentioned standards.

4. Services include the following:

A. Inspections:

(1) Systematic examination of all system components, including, but not limited to Control Panel equipment, Control Panel Batteries, Initiating Devices, Alarm Notification Appliances and Devices, Supervisory Signal Devices, Interface Relays and Modules, Smoke Detector Sensitivity, and Off-premise Monitoring Transmission Equipment. Resettable heat detectors are to be tested with heat, not with magnets.

(2) Contractor shall perform testing, cleaning, and adjusting of all components as necessary to keep the system in reliable condition and proper working order. VA will supply all replacement components as necessary.

(3) Contractor shall furnish all tools, and cleaning materials, and parts required to perform inspections and testing.

(4) Contractor shall perform battery and charger maintenance.

B. Emergency Service:

(1) Contractor shall respond within four (4) hours upon notification of system trouble.

(2) Emergency call-back service shall be limited to minor adjustments and major repairs to affect the integrity of the system to include all fire alarm systems.

B. SPECIFIC REQUIREMENTS

1. Contractor shall perform Quarterly, Semi-annual and Annual inspections and maintenance in accordance with the most current editions of Manufacturer’s maintenance manuals, NFPA 101, 25, 72, and 13 standards, and National Fire Alarm Code as prescribed by The Joint Commission (TJC).

A. Fire alarm panels including batteries and battery chargers, shall include testing and inspection of all functions for:

(1) Charger Test

(2) 30-Minute Discharge Test

(3) Remote Annunciator

(4) Load Voltage Test B. Initiating devices include:

(1) Smoke Detectors

(2) Heat Detectors (tested with heat, not magnets, as well as inspected)

(3) Duct Detectors

(4) Manual Alarm Stations

(5) Interface Devices (Relays and Control Elements) C. Notification Appliances include:

(1) Audible Devices (bells, chimes, horns)

(2) Visual Devices (strobes, lights) D. Interface Relays and Modules include:

(1) Magnetic hold-open

(2) Air handler shut down

(3) Magnetic locks

2. Contractor shall maintain an updated back up disc for the Simplex fire alarm system.

A. Download latest software revision.

B. Verify As-Built drawings are accurate.

C. Current As-Built drawings will be provided by VA upon Contract Award. Vendor shall compile updated As-Built.

C. REPORTS/TESTS

1. Contractor shall submit a quarterly report to the COR and the Contracting Officer that includes the following information:

A. Testing Schedule:

(1) Building number

(2) System type tested

(3) Device tested

B. Detailed Report:

(1) Building number

(2) Location of device

(3) Type of device

(4) Test Results

a. Pass

b. Fail

(5) Zone (Zone FACP)

(6) Code (Chime Code)

(7) Year

(8) Date

(9) Comments C. Fire Alarm Discrepancy Report:

(1) Building number

(2) Device and location

(3) Type of Discrepancy

(4) COR shall be notified of any discrepancy by the end of each day.

D. MANUALS

The publications listed below shall be followed and adhered to while conducting repairs, testing, maintenance, and inspections:

1. Manufacturer’s maintenance manuals

2. Manufacturer’s recommendations

3. National Fire Protection Association Standards (NFPA)

4. National Electrical Code (NEC)

5. National Fire Code

6. The Joint Commission (TJC) requirements. (VA will provide. COR)

Contractor shall report to the electric shop building 76 room 4, PRIOR TO STARTING AND AFTER COMPLETION OF WORK.

E. REQUIRED TESTS

1. Clean All Detectors

a. When a detector is out of range; disassemble, clean with vacuum or cloth, and reassemble.

b. Test sensitivity as required by NFPA using a UL listed test meter. If detector is out of range, adjust and repeat.

c. Record test results on inspection report.

2. Test All Pull Stations

a. Check for any physical damage.

b. Activate pull station to verify alarm signal and then reset pull station.

c. Record test results on inspection report.

3. Functional Test

a. Put control panel into alarm mode.

b. Verify operation of Fan shutdown, remote signal transmission and all other automatic functions that have been designed into the system.

c. Verify operation of Elevator Recall, Power Shunt Breaker, and Elevator Shaft Smoke Sensors (may require elevator mechanic or contractor to assist).

d. Record test results on inspection report.

F. EMERGENCY REPAIR SERVICE

1. Contractor shall be required to provide emergency service 24-hours a day, 7 days a week. Each contract option year includes a separate estimated NOT TO EXCEED line item for emergency repair services. Contractor shall provide unlimited emergency callback service for emergent repairs. The contractor shall be required to report to the generator location within four (4) hours of notification from appropriate Medical Center personnel. Notification can be accepted by the Contractor from the following staff members for emergent repairs only: COR/Fire and Emergency Management or CO. Contractor shall report to Electrical Shop, Building 76, Room 4 during normal working hours, 8:00 a.m. to 4:30 p.m. Evenings, weekends, and holidays, Contractor shall check in with VA Police and Building 13 (the boiler plant).

2. All repairs must be approved by the COR or CO prior to commencing work. Any additional work performed by the contractor without the prior written approval of the COR or CO shall be performed by the contractor at no additional cost to the government.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years, 6 months.

C.4 VAAR 852.203-70 COMMERCIAL ADVERTISING (JAN 2008)

The bidder or offeror agrees that if a contract is awarded to him/her, as a result of this solicitation, he/she will not advertise the award of the contract in his/her commercial advertising in such a manner as to state or imply that the Department of Veterans Affairs endorses a product, project or commercial line of endeavor.

(End of Clause) C.5 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.

(d) A joint venture may be considered a service-disabled veteran owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB as appropriate.

(e) Any service-disabled veteran-owned small business concern (non-manufacturer) must meet the requirements in FAR 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Designated agency office has the meaning given in 5 CFR 1315.2(m).

(3) Electronic form means an automated system transmitting information electronically according to the Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.

(4) Invoice payment has the meaning given in FAR 32.001.

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.)

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats.

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for:

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Virginia. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

E.1 INSTRUCTIONS TO OFFERORS

Note that FAR Subpart 13.5 Simplified Acquisitions Procedures for Certain Commercial Items procedures will be used. This authorizes the use of simplified procedures for the acquisition of supplies and services in amounts greater than the simplified acquisition threshold but not exceeding $7 million ($13 million for acquisitions as described in 13.500(c)), including options, if the contracting officer reasonably expects, based on the nature of the supplies or services sought, and on market research, that offers will include only commercial items.

The purpose of these simplified procedures is to vest contracting officers with additional procedural discretion and flexibility, so that commercial item acquisitions in this dollar range may be solicited, offered, evaluated, and awarded in a simplified manner that maximizes efficiency and economy and minimizes burden and administrative costs for both the Government and industry (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 3305, 3306, and chapter 37, Awarding of Contracts.

1.0 OFFER SUBMISSION

Offerors shall submit their offer via email in electronic format (PDF or Word) to Takira Peoples at takira.peoples@va.gov by 5pm, EST, April 27, 2018. Subject line should read 36C24618Q0291 – Fire Alarm Inspection, Monitoring, and Repair for the Salem VAMC.

SITE VISIT

Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost the contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

Site visit requests must be received by April 23, 2018 8:00am EST.

Offers shall be assembled by the following Sections; each section shall be easily identified.

Section A - Offer Form (Standard Form 1449) Signed and dated, include the North American Industry Classification System (NAICS) code and small business size standard in Block 10. Data Universal Numbering System (DUNS) Number shall be entered in the block with the Offerors name and address.

Section B – Pricing Pricing shall be submitted as requested in the Schedule of Services. Total price will be evaluated by the Government; proposed prices should reflect a clear understanding of the requirements and commensurate with the performance work statement.

Section C– Offerors Representations and Certifications A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically). An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at www.sam.gov/portal/public/SAM/.

All Offerors shall be registered and current in the System for Award Management (SAM) database at time of award.

To be eligible to submit an offeror. All offerors shall be verified in the Vendor Information Page (VIP) www.vip.vetbiz.gov. Unverified SDVOSBs or VOSBs will be considered non-responsive to the requirements of the solicitation. Offers from unverified SDVOSBs or VOSBs are considered deficient and will not be evaluated.

Section D – Technical Submit technical quote in a format which clearly addresses the evaluation factors. Each response offer shall address each factor in the sequence listed and clearly identify which factor and section within each factor is being addressed. Offerors should address all items contained within the Statement of Work of this solicitation.

Section E – Past Performance Identify all federal, state, and local government contracts as well as any private/commercial contracts of similar scope, size, complexity that are ongoing or have been completed within the last three years.

2.0 AWARD BASIS

Note that FAR Subpart 13.5 Simplified Acquisitions Procedures for Certain Commercial Items procedures will be used. A contractor may be eliminated from consideration without further exchanges if technical and/or pricing quotes are not among those Offerors considered most advantageous to the Government.

This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) procedure to make a best value award. For those offerors determined to be technically acceptable, award will be made to the vendor with the lowest overall price. Your proposal must demonstrate a clear understanding of the standards and requirements outlined in the solicitation.

The contract will be awarded to the offeror with the lowest price technically acceptable offer based on the factors listed below. A rating of “acceptable” or “unacceptable” will be assigned to each non priced factor.

Factor 1: Technical

· Shall be an authorized representative of the major equipment manufacturer, Simplex.

· Shall be fire alarm certified by the National Institute for Certification in Engineering Technologies (NICET), as well as, the International Municipal Signal Association (IMSA).

· Shall be certified by the Commonwealth of Virginia and/or trained and qualified by an organization listed by a national testing laboratory to service fire alarms.

· Shall provide evidence that vendor has a minimum of three (3) years of servicing fire alarm systems.

Factor 2: Past Performance

Offeror shall furnish names, addresses and telephone numbers of three references for whom similar services have been furnished (COR contact information for Government Agencies) with the quote.

Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery of quality services. Emphasis will be on recent, relevant past performance in the previous 3 years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Performance Work Statement (PWS).

Past performance information is one indicator of an offeror’s ability to perform the contract successfully. Current and relevant information, source of information, context of data, and general trends in Contractor’s performance shall be considered as it pertains to the performance of work described in this solicitation. Offerors may provide information on problems encountered on identified contracts and the offeror’s corrective action. The Government shall consider this information as well as information obtained from any other sources when evaluating the offeror’s past performance.

Since the Government may not necessarily interview all of the sources provided by the offerors, it is incumbent upon the offeror to explain the relevance of the data provided. Offerors are reminded that the Government may elect to consider data obtained from other sources. Offerors with no relevant past performance or whom information is not available, shall be evaluated natural.

Factor 3: Price

Your prices shall be submitted in accordance with the Price Schedule contained in the solicitation.
