X X March 24, 2021 3:00PM X Subject Solicitation Shall be Amended as Follows:
1. Provide Questions and Answers received, incorporated.
2. Provide Estimate Spreadsheet referenced in solicitation documents, attached.
3. All other terms and conditions remain unchanged.
Kathryn C. Kaiser Contracting Officer 304-263-0811 ext. 2083 Q1) Site Superintendent – page 5 or 141 -Pricing Schedule list SPM, QCM, and Site Superintendent.
page 12 of 141 -5. Contractor Staff and EMployees states "A separate superintendent shall be established for each task order and shall maintain a 30 Hour OSHA card that is to be submitted prior to the start of work" page 12 of 141 -2.5.d Items such as, but not necessarily limited to, review and coordination, estimating, and expediting relative to the task order are associated with the field and office supervision and are considered to be included in the contractor’s overhead and/or fee percentage. Separate line items on proposal breakdowns for these items will not be allowed.
So if I am to understand this correctly it's the intention of this solicitation to say that we can have one site superintendent on the pricing schedule and any additional site superintendents are required to be covered in overhead and that all task orders must have their own site superintendent?
Response: All task orders must have their own site superintendent. The site superintendent included on the pricing schedule is the rate that will be included with each task order for the site superintendent per hour.
A site superintendent is NOT allowed to be charged on a task order proposal? This is difficult to plan if you have three task orders under $5000 and one task order for $250,000 then you have a need for four superintendents that are all OSHA 30. Do you have a limit on the number of task orders that will be issued at one time? Do you have an average amount of task orders per year? Can the Quality Control Manager also serve as a superintendent for the smaller task orders? Can a subcontractor be designated as a site superintendent?
Response: The assumption that the site superintendent is NOT allowed to be charged on a task order proposal is incorrect. Please refer to response above. The rate in the pricing schedule provides a firm hourly rate that will be utilized through the contract. An average amount of task orders issued at one time is unknown. Per the specifications, the Quality Control Manager and superintendent can be one and the same if they meet the requirements of both positions and it is approved for the Task Order. It is not common practice to allow a subcontractor to be designated as a site superintendent as the General Contractor has a responsibility to self-perform work and supervise the projects.
Q2) Page 11 of 141 - 2. Task Order Pricing 1st paragraph 1st sentence states that a "suggested attached Estimate Spreadsheet may be used". Will you be attaching this Estimate Spreadsheet to the solicitation?
Response: Estimate Spreadsheet is attached to this amendment.
Q3) Will teaming agreements be accepted so that multiple special skills and experiences can be formed into one benefit to the VA?
Response: Teaming Agreements or Joint Ventures are allowed but will be reviewed and approved prior to award in accordance with the solicitation, FAR and VAAR requirements.
Q4) Based on the contract type as Firm fixed Price (FFP) , verifying this is an IDIQ?
Response: This solicitation will result in two IDIQ contracts. The FFP reference is to the pricing submitted under the schedule.
Q5) Based on the evaluation of construction management services, verifying the VA is looking for construction services via the IDIQ?
Response: This solicitation is for construction services.
Q6) Past Performance Questionnaire’s were submitted direct from our client’s. Do you still have them, or should we resubmit?
Response: If client’s submitted Past Performance Questionnaires directly to the CO than they are not required to be submitted again.
Q7) Can you please clarify Section D of the Evaluation Procedures/Proposal Submission Requirements from page 37?
0. Factor 1 - Technical Construction Management Capability – are the elements to be addressed Construction Management, Project Personnel Experience and Management Approach?
0. Factor 2 – Please define.
0. Factor 3 – Please define.
Response: Beginning on page 37 of the solicitation and continuing through page 41 the Factors are spelled out in their entirety for what is required and how these will be evaluated.
Q8) For the certification of no EPA violations, what document is deemed acceptable?
Response: This is typically provided by the General Contractor’s certification on company letterhead or by OSHA reports.
Q9) Can the requirements for 3 projects between 300K and 750K be waived? Our company has done 70+ multi-million dollar projects and we are requesting permission to submit projects outside of the dollar range amount
Response: This requirement will not be waived, however, if larger projects are submitted, they will be considered. The overall goal of this objective is to evaluate contractor performance on projects in the pricing area for task orders under the resulting contracts.
Q10) In Section 1.General, the government states, “Contractor’s office or satellite base must be operational prior to award of the contract and throughout the duration of the contract and must be open for business from 8:00am to 4:30pm, Monday through Friday, excluding Federal holidays. – What are the requirements for the contractor’s office or satellite based referenced in 1.General?
Response: This is referring to the Contractor’s place of business and its establishment. Requirements of the general office are prudent to standard business practices of the Contractor where they conduct business.
Q11) In reference to Section 2. Task Order Pricing para (1) the government states: “Proposals, to be submitted as expeditiously as possible but, within 30 calendar days after receipt of request, This Section 10. Ordering Procedures, the government states: “After site visit has been conducted, the Contractor shall submit his proposal to the Contracting Officer at the time mutually agreed upon by the Contractor and the Contracting Officer but no later than seven (7) workdays after the site visit. In the absence of an agreement, the proposal shall be submitted within five (5) workdays after requested by the Contracting Officer. – Will the government please clarify the task order response schedule?
Response: Task Order pricing proposal response deadlines will be outlined in each Task Order request. Typical timeframes are between 14-30 days, depending on need.
Q12) In Section 2.10 Documents Required with Proposal Package, the requires:
Completed 1442 – pages 1 & 2 Representations and Certifications Required proposal package documents, including but not limited to, Technical Package, Pricing Package, Safety and Environmental Record and Experience Modification Rate. Proposal packages must be complete to include all requirements for consideration. – In which part of Factors 1-3 would the government like to see these items, or would the government like to have them submitted separately?
Response: These items may be submitted under the Technical Package or separately as long as they are included in the response.
Q13) If a contractor’s proposed personnel already hold a DOD clearance or a GSA HSPD 12 clearance, is the contractor still required to submit a separate clearance though the VA in accordance with Section 2.11 Security Requirements of the solicitation?
Response: Every individual working under the resulting contract(s) MUST go through the VA Security Requirements, regardless of other clearances or ID badges held.
Q14) In Factor 1, Corporate Project Experience, may an offeror use a corporate experience that exceeds the $750,000 range?
Response: Yes, this is allowable.
Q15) We’ve recently requested Past Performance Questionnaires from our customers. Will the VA allow contractors to submit recently completed past performance questionnaires so as not to disturb our existing customers by repeatedly requesting new questionnaires?
Response: As long as the Past Performance Questionnaires are dated within six months of the closing of this solicitation they may be used and submitted with the package.
Q16) Past Performance Questionnaires: Attachment states that the PPQs should be sent directly to Kathryn Kaiser via email, but in the Solicitation under Evaluation Procedures/Proposal Submission Requirements – Factor 2 – Past Performance paragraph (1) it states “…PPQs shall be furnished with the offer or emailed to the designated contract specialist. Please verify that either option is acceptable.
Response: Either option is acceptable.
Q17) Task Order Bonding: Page 12 – Section 3 of the solicitation reads that P&P Bonds are required for projects over $150,000.00 but page 24 – Section 4 states that Task Orders that exceed $100,000.00 will require P&P Bonds. Please verify the amount a task order must exceed for both Payment and Performance Bonds to be required.
Response: Performance and Payment bonds are required for projects over $150,000.00 per the FAR, alternatives may be considered for projects $35,000.00 to $150,000.00.
Q18) Proposal Package Preparation: Please verify that the proposal package as a whole will consist of 3 separate parts, 1 original and 3 copies of each part, that must be hand delivered in separate sealed envelopes plus one CD.
Response: Package can be mailed or hand delivered. There will be 3 separate parts, 1 original and 3 copies of each part in separate envelopes and one CD. All parts, in separate envelopes, and CD can be packaged in one box for delivery.
Q19) Determination of Responsibility: On page 24, paragraph 6 of the Solicitation requires information be submitted stating that the bidder has no more than 3 serious, or 1 repeat, or 1 willful OSHA or ANY EPA violations in the past 3 years. Under which Part should this be included under? (Technical, Past Performance, Cost) Response: It would be most expected with the Technical Package, however, as long as it is included with the submission it will be reviewed.
Q20) EMR Letter: On Page 24 of the Solicitation, the bidder is required to submit a letter from their insurance company, furnished on insurance carrier’s letterhead, showing current Experience Modification Rate (EMR) is less than 1.0. Under which Part should this be included with? (Technical, Past Performance, Cost) Response: It would be most expected with the Technical Package, however, as long as it is included with the submission it will be reviewed.
