About this file
This document is an amendment to Solicitation 36C24424Q0639 for a Blanket Purchase Agreement (BPA) for dairy and juice products for the Department of Veterans Affairs' VISN 4 network. The amendment provides clarification on the pricing structure, specifically that dairy products will be priced according to the monthly minimum prices set by the Pennsylvania Milk Board, regardless of the delivery location. It also confirms that prices will undergo quarterly review by the VA Contracting Office, and any price adjustments would be made through a bilateral modification. The key requirements are for various milk, juice, tea, and cultured dairy products, with the BPA term being 1 year with four 1-year option periods. The solicitation is open to all offerors, with no set-asides indicated.

CONTINUATION PAGE
1. Relative to pricing, all milk line items (except for Teas, juices, drinks and cultured products) for each year have the same notation which states that each is “Subject to Monthly Minimum PA Milk Board Prices”. Can you explain what is meant by this statement?
Correct, in an effort to obtain effective pricing, the solicitation is seeking pricing consistent with the PA Milk Board. Upon market research, it was determined that dairy manufacturing facilities located in Pennsylvania must charge prices stabilized by the PA Milk Board as producers.
2. Regarding #1 above, since the VA Wilmington is in Delaware, does the “Subject to Monthly
Minimum PA Milk Board Prices” notation still apply to the VA Wilmington line items?
Yes, should the manufacturer be a PA based producer.
3. Also, at B.6 Pricing Date, para 3 (on p. 14 of 62), it states that “The BPA holder may also increase BPA prices with valid justification and prior approval”. What is the procedure for adjusting prices and what constitutes valid justification? Is there a US Government metric used as a guide for any price adjustments, or is the PA Milk Board used to determine this?
Please clarify.
Economic changes as well as large fluctuations in the market could be considered when determining BPA Prices. The dairy products regulated under the PA Milk Board shall be provided and invoiced under the monthly minimums. These published prices will be adjusted within the BPA, as needed.
4. Also, in this same paragraph, it states that “The prices offered under this BPA will undergo at least a quarterly review by the Department of Veteran Affairs/Contracting office”---does this mean that prices will be unilaterally adjusted by the Contracting Officer with no input from the contractor?
Any changes would undergo a bilateral modification, if required.
