Description This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 in conjunction with Part 13 of Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This Solicitation is issued as a Request for Quote (RFQ), and the solicitation number is 36C24420Q1114.
This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2020-07 effective August 31, 2020, and the Veterans Affairs Acquisition Regulations (VAAR). The complete text of any of the clauses and provisions may be accessed in full text at http://farsite.hill.af.mil.
This Solicitation is Unrestricted. The NAICS Code is 238220 – Plumbing, Heating, and Air- Conditioning Contractors and the business size standard is $16.5 million.
The Wilkes-Barre, PA Contracting Office is seeking to purchase services for testing of Backflow Preventers for the Veterans Affairs Medical Center located in Erie, PA
Service Contract Act Wage Determination apply to this acquisition and will be incorporated into the resulting contract. A copy of the Wage Determination is included in the solicitation as follows: Attachment 1 - Erie, PA, No. 2015-4223, Revision No. 13, dated 5/1/2020.
Complete instructions for submitting a response to this solicitation and applicable provisions and clauses are enclosed. All offerors are advised to pay careful attention to the quote submission instructions as there are very specific instructions as what is required to be provided.
The applicable line item/CLIN are enclosed.
The purchase order period of performance (POP) will begin upon award of contract.
Any award resulting from this solicitation will be issued on a Standard Form 1449.
In accordance with FAR 4.1102 and FAR 52.204-7 (b)(1) offerors must be registered in the System for Award Management (SAM) database at time of quote submission and at time of award. Registration may be done online at: www.acquisition.gov or www.sam.gov.

STATEMENT OF WORK
For
Back Flow Preventers
I. PROVIDE: The contractor shall provide all necessary labor, equipment and materials necessary to test back flow preventers at the Erie VA Medical Center 562 (EVAMC) Main Campus.
II. GENERAL:
Erie Veterans Affairs Medical Center is located in Erie, PA. EVAMC treats eligible veterans for various conditions. EVAMC provides inpatient, outpatient and residential services. This contract is to clean, test and certify the installed back flow preventers IAW federal, state and local regulations, as well as The Joint Commission, NFPA and ASSE requirements.
III. SPECIFICS:
A. EVAMC has 51 installed backflows that require annual testing for operation. See Attachment A for the complete inventory. This request will include the possible increase of 10 additional backflow preventers.
B. The contractor shall perform services during normal business hours. Normal business hours are Monday, Tuesday, Thursday & Friday 6:00 AM-3:30 PM, excluding federal holidays.
C. The contractor shall provide a proposed schedule to the CO and COR within 2 weeks following the award.
D. The contractor shall perform the test on each device or remove it from service only when specifically directed by the COR or his assigned delegate.
E. The contractor shall clean, inspect, lubricate and test all backflow preventers listed in Attachment A.
F. The contractor shall perform testing IAW EPA Cross-Connection Control Manual Chapter 5, Attachment C.
G. For devices 29, and 34 highlighted in Attachment A, the contractor shall conform to current EWW reporting specifications.
H. For all devices, the contractor shall fill in the required data on a copy of Attachment B, 2017 EWW Backflow Test Report Form and send the completed forms to the COR within 10 days. Electronic copies are acceptable.
I. If a device fails testing, the contractor shall notify the COR or delegated representative immediately. Attachment B shall be filled out with the words “Failed Test” at the top of the form.
The cause of the failed test shall also be listed on the form.
J. The contractor may submit a cost to repair/replace and retest all failed devices to the COR. The COR will evaluate the submittal and accept or reject the proposal. If the proposal is accepted, the services may be purchased using a government purchase card or via a new order. The government has no obligation to accept the repair/replace and retest proposal and no obligation to the contractor to use their services for this repair.
K. All methods of cleaning and maintenance of equipment must meet manufacturer’s standards to ensure no damage to either quality or equipment through the use of chemicals or materials harmful to components within the system.
L. The contractor is responsible for transportation of personnel, tools, materials, gauges, etc.
necessary for the performance of this contract.
M. The contractor is responsible for safe and legal transport and disposal of all items necessary for the performance of this contract.
N. All specification sheets, MSDS, chemical precautions, etc. shall be submitted to CO and COR for evaluation with quote submittal. Substitute chemical compositions may be submitted to CO and COR for evaluation of suitability for this contract, prior to use.
O. Internal Inspection for EWW Primary Back Flows, with total rebuild of these 2 devices 29, and 34 will be completed every 5 years. Next rebuild due June 2022.
P. The proposals shall be submitted in the form of Base Year and four (4) individual option years.
IV. QUALIFICATION REQUIREMENTS:
A. All testing shall be performed by an ASSE certified backflow tester. The backflow preventer tester certification shall be current and not expired.
B. The tester shall hold a current license to perform backflow test and/or rebuilds issued by Erie Water Works.
V. PRIVACY EXPECTATION: The generalized privacy training “VA Privacy Training for Personnel Without Access to VA Computer Systems or Direct Access or Use to VA Sensitive Information” must be completed by all contractors and subcontractor employees assigned to VA accounts prior to delivery of service and annually thereafter as long as the contract is in place.
The contractor shall provide to the VA COR a copy of the completed training certificate(s).

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from Will be provided at contract award through Will be provided at contract award.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor—
(1) Any order for a single item in excess of Will be provided at time of contract award;
(2) Any order for a combination of items in excess of Will be provided at time of contract award; or
(3) A series of orders from the same ordering office within 1 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-21 REQUIREMENTS (OCT 1995)
(a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.
(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.
(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.
(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period;
provided, that the Contractor shall not be required to make any deliveries under this contract after Will be provided at time of contract award.

52.219-4 NOTICE OF PRICE EVALUATION PREFERENCE FOR HUBZONE
SMALL BUSINESS CONCERNS (DEVIATION 2019-01)
(a) Definitions. As used in this clause—
“HUBZone small business concern” means a small business concern, certified by the Small Business Administration (SBA), that appears on the List of Qualified HUBZone Small Business Concerns maintained by the SBA (13 CFR 126.103).
“Similarly situated entity” means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award, and that is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform. An example of a similarly situated entity is a first-tier subcontractor that is a HUBZone small business concern for a HUBZone set-aside or sole source award under the HUBZone Program.
(b) Evaluation preference.
(1) Offers will be evaluated by adding a factor of 10 percent to the price of all offers, except—
(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and
(ii) Otherwise successful offers from small business concerns.
(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.
(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.
(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraphs (e) and (f) of this clause do not apply if the offeror has waived the evaluation preference.

(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) Agreement. By submission of an offer and execution of a contract, a HUBZone small business concern agrees that, in the case of a contract for—
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 85 percent subcontract amount that cannot be exceeded; or
(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 75 percent subcontract amount that cannot be exceeded.
(f) A HUBZone joint venture agrees that the aggregate of the HUBZone small business concerns to the joint venture, not each concern separately, will perform the applicable requirements specified in paragraph (e) of this clause.
(g)(1) Unless SBA has waived the requirements of paragraphs (g)(1)(i) through (iii) of this clause in accordance with 13 CFR 121.1204, a HUBZone small business concern that provides an end item it did not manufacture, process, or produce, shall—
(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;
(ii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and
(iii) Take ownership or possession of the item(s) with its personnel, equipment, or facilities in a manner consistent with industry practice; for example, providing storage, transportation, or delivery.
(2) Paragraphs (g)(1) of this clause does not apply to construction or service contracts, or when the price evaluation preference is waived by the offeror.
(h) Notice. The HUBZone small business offeror acknowledges that a prospective HUBZone awardee must be a HUBZone small business concern at the time of award of this contract. The HUBZone offeror shall provide the Contracting Officer a copy of the notice required by 13 CFR
126.501 if material changes occur before contract award that could affect its HUBZone eligibility. If the apparently successful HUBZone offeror is not a HUBZone small business concern at the time of award of this contract, the Contracting Officer will proceed to award to the next otherwise successful HUBZone small business concern or other offeror.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

I. Quote Submission Instructions:
A. Failure to follow the instructions below may result in elimination from award consideration or a non-responsive determination.

The Sections must be clearly identified as described below (either as the title of the document or on the actual document).
3) No price information shall be included in the technical section. If pricing information is found in the technical section, the quote may automatically be considered non-responsive and not evaluated.
B. Section I Administrative/Regulatory. Page limit: None. Please be advised that this Section is not sent for technical evaluation.
1. Completed certifications and representations located at FAR 52.212-3, or an indication that said certifications and representations are current and located in the SAM database. Signed acknowledgements of amendments (SF30). Applicable only if any amendments are issued against this solicitation.
2) Vendors are advised that the requirements of 13 CFR § 125.6 may be applicable to this solicitation and shall respond accordingly. The vendor shall include a narrative regarding subcontractors and a detailed description of how the offeror plans to adhere to the requirements of 13 CFR § 125.6. This narrative shall describe what tasks the prime will perform and what tasks the subcontractors will perform. The response shall also provide the subcontractor’s business name and DUNS. If the offeror does not plan to use subcontractors, they need to respond accordingly. Failure to provide the requested information regarding 13 CFR 125.6 may result in a non-responsive determination.

II. Evaluation of Quotations of Offers IAW FAR 13.106-2(b)(3)
The Government intends to issue a single purchase order in response to this solicitation.
A comparative evaluation of quotes will be performed in accordance with FAR 13.106-2(b)(3) based on the following:
1. Price— Government reserves the right to award to a offeror with other than the lowest price. Award will be made to the offeror whose quote represents the best overall value to the government.
2. Technical—Offeror clearly demonstrates in its response a clear understanding of all the Government’s requirements and effective approach in the completion of service in accordance with the SOW. Certifications are provided and qualifications listed in SOW are addressed.
3.. Past Performance—Offerors must have a record of satisfactory or neutral past performance. If no record of past performance is found, the Offeror will receive a rating of neutral. The Government will utilize but is not limited to internal documentation including Federal Awardee Performance and Information System (FAPIIS) for determining the past performance of offerors.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services, the Offeror shall provide the following information as part of the offer—
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment…
