About this file

This is a Combined Synopsis-Solicitation for commercial products and services issued by the Department of Veterans Affairs Network Contracting Office 2 at the James J. Peters VA Medical Center in Bronx, New York. The solicitation (36C24226Q0940) requests commercial fuel treatment, polishing, and tank bottom cleaning services for the VA Hudson Valley Healthcare System, with service delivery at two locations: Montrose VAMC (2094 Albany Post Road, Montrose, NY 10548) and Castle Point VAMC (41 Castle Point Road, Wappingers Falls, NY 12590). This is a small business set-aside exclusively for Service-Disabled Veteran-Owned Businesses (SDVOSBs) under NAICS code 562998 with a $16.5 million size standard. The solicitation is issued as a Request for Quotation (RFQ) under streamlined procedures for commercial services, with a firm fixed price contract contemplated. Quotations must be submitted electronically by September 11, 2026, at 10:00 AM Eastern Time to Contract Specialist Tiffany Vazquez-Simon at TIFFANY.VAZQUEZ-SIMON.@VA.GOV, with questions due by August 31, 2026, at 9:00 AM Eastern Time.

The contract includes a base performance period from October 1, 2026, through September 30, 2027, with four optional one-year extension periods through September 30, 2031, totaling five and one-half years maximum. Offerors must provide separate pricing for fuel treatment, polishing, and tank bottom cleaning services at both Castle Point and Montrose locations for all contract periods. Evaluation will be based on three factors: Technical Capability (demonstrating specialization in fuel tank cleaning services with qualified key personnel, quality assurance procedures, and no dependency on ostensible subcontractors), Past Performance (two relevant references from the past three years), and Price (reasonableness and consistency with technical proposal). SDVOSBs are subject to a 50 percent subcontracting limitation, meaning no more than 50 percent of government payments can go to non-SDVOSB firms. Invoices are submitted upon job completion or annually, processed electronically through Tungsten Network. Minimum insurance requirements include $500,000 general liability per occurrence, $200,000 automobile liability per person, and employer's liability coverage of at least $100,000, with general liability coverage required without asbestos exclusionary clauses.

All requirements specified in the solicitation are mandatory and by responding to this solicitation offerors are affirming that they can perform all the work and can successfully execute the required services. (The Government may also consider other relevant information when evaluating an offeror’s past/present performance obtained from other federal agency web sites, i.e. CPARS)

VOLUME 3 – FACTOR 3 PRICE

a. Offerors shall provide a complete Price/Cost schedule to be considered for award. If there is no cost for a CLIN, enter $0.00 as the unit cost. Offers that do not include pricing for all CLINs, in all performance periods, will be considered incomplete and removed from any further consideration. Any errors in pricing calculations may result in rejection of the offer or require correction at no additional cost to the Government.

All quotes shall be submitted electronically by e-mail to Contract Specialist Tiffany Vazquez-Simon at TIFFANY.VAZQUEZ-SIMON.@VA.GOV.

2. FAR 52.212-2 Evaluation-Commercial Products and Commercial Services (NOV 2021) (DEVIATION OCT 2025).

Award MAY be based upon a comparative evaluation of quotes in accordance with the Simplified Acquisition Procedures of RFO FAR 12.

Comparative evaluation is a side-by-side comparison of quotations based on the stated decision factors, resulting in the Contracting Officer selecting the quotation most favorable to the Government. The Government is not required to rank quotations or assign adjectival or numerical ratings.

Evaluation factors other than price when combined are approximately equal to price.

The following are the decision factors:

a. Technical Capability - The Government will assess the Contractor’s ability to demonstrate a clear understanding of the services required and its ability to perform the work adequately and satisfactorily in accordance with the Statement of Work and the extent to which potential risks are identified and mitigated, its qualified key personnel, quality control program, and past experience. Certifications, if applicable, will be evaluated on an acceptable/unacceptable basis to ensure compliance with applicable industry standards. Having no past experience with work of similar nature will be considered a high-risk factor in evaluation. The offeror must demonstrate that it is a contractor regularly engaged in the field of fuel tank cleaning services. Being dependent upon an ostensible subcontractor will be considered as a high-risk factor in evaluation.

b. Past Performance – The Government will assess the relative risks associated with a Contractor’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the past performance records. The Government may also consider other relevant information when evaluating an offeror’s past/present performance obtained from other federal agency web sites, i.e., the Contractor Performance Assessment Reporting System (CPARS), etc. The Government reserves the right to consider past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement provided by the offeror, as well as information obtained from any other sources, to establish a past performance rating. A proposal containing no relevant past performance shall have past performance evaluated as “neutral”.

c. Price - The Government will evaluate offers for award purposes based on the pricing for all options to the total price for the basic requirement. The proposed price will be analyzed for reasonableness. It may also be analyzed to determine whether it is realistic for the work to be performed, reflects a clear understanding of the requirements and is consistent with the offeror’s technical proposal. Offers for partial requirement will not be evaluated and will be deemed non-responsive upon receipt. Offerors shall ensure that all pricing is calculated accurately. Any errors on pricing calculations may result in rejection of the offer or require correction at no additional cost to the Government.

Options will be evaluated at time of award.

For purposes of award, the Government intends to evaluate the option to extend services under FAR 52.217-8 as follows: The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be those rates in effect under the contract each time an option is exercised under this clause. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

3. NOTE: RFO FAR 52.212-3 is RESERVED and replaced with: www.sam.gov registration is required to be complete at time of submission of response.] Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://sam.gov/.

System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

4. FAR 52.212-4, Contract Terms and Conditions–Commercial Products and Commercial Services (NOV 2023) (DEVIATION OCT 2025).

ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

52.217-9, Option to Extend the Term of the Contract (MAR 2000)

· (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. (a) Pursuant to 38 U.S.C. 8127(l)(2), the offeror certifies that—

(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:

(i) [X] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.

(ii) [] General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.

(iii) [] Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not certified SDVOSBs listed in the SBA certification database as set forth in 852.219–73 or certified VOSBs listed in the SBA certification database as set forth in 852.219–74. Any work that a similarly situated certified SDVOSB/VOSB subcontractor further subcontracts will count towards the 75% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.

(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.

(3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all of the following:

(i) Referral to the VA Suspension and Debarment Committee;

(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and

(iii) Prosecution for violating 18 U.S.C. 1001.

(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.

(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement.
