NON-DESTRUCTIVE MOLD REMEDIATION SERVICES

BUILDING 10 TELECOM ROOM

I. BACKGROUND: The VA New Jersey Health Care System (VANJHCS) requires remediation of localized visible mold growth in the Telecom Room (aka Control Room) of Building 10 at the Lyons Campus. Localized areas of heavy mold growth are present on specific portions of wall surfaces, however, the majority of wall surfaces in the room do not exhibit visible mold growth. Visible suspect mold growth was not observed on the floor, ceiling or telecommunications equipment.

The objective of this Work Plan is to remove visible mold growth by non-destructive cleaning methods, restore affected surfaces to a visibly clean condition, and verify the effectiveness of the remediation through visual inspection and post-remediation air sampling in order to prepare the room for routine occupancy.

The Telecom Room contains critical telecommunications and server equipment that must remain operational throughout the project, unless a shutdown is specifically coordinated and authorized by VANJHCS. Note that the terms mold, fungal, and fungi are used interchangeably in this Work Plan.

This Work Plan does not address measures that will be necessary to correct the water and moisture issues in the Telecom Room which may have contributed to the mold growth.

II. SCOPE: The contractor shall provide all labor, supervision, equipment, materials, localized barriers, cleaning supplies, personal protective equipment, transportation, and documentation necessary to complete the work. The contractor shall be responsible for the following, but not limited to:

· Pre-work coordination with the COR, VA Facilities Management, Information Technology, Safety, and other affected departments, as well as the independent environmental consultant.

· Isolation of affected work areas and operation of HEPA-filtered air scrubbers.

· Cooling necessary for operation of the Telecom Room, including the Liebert units or other approved cooling systems, shall remain operational throughout the project.

· Protection of unaffected building surfaces, telecommunications equipment, furnishings, cable trays, conduits, and other contents.

· Controlled wet wiping and HEPA vacuuming visibly affected wall surfaces and immediately adjacent surfaces necessary to complete the cleaning.

· Application of a mold-inhibiting primer to designated cleaned and dry wall surfaces after acceptance of the cleaning.

Explicit exclusions and prohibited methods:

· No exploratory openings, cutting, drilling, sanding, grinding, abrasive blasting, pressure washing, or other destructive or dust-generating remediation.

· No indiscriminate spraying, fogging, atomizing, or aerosol application of bleach, disinfectant, sporicidal, antimicrobial, or mold inhibitor products.

· No application of liquids or coatings to energized electrical panels, internal electronic components, data ports, cable terminations, or equipment openings.

· No dry sweeping or use of non-HEPA vacuums.

· No encapsulation or priming over visible mold, residual dust, wet surfaces, or surfaces that have not been approved as clean by VANJHCS.

· No shutdown of critical power, telecommunications, or cooling equipment without prior written authorization and coordination by VANJHCS.

Work should be completed within 30 days.

III. APPLICABLE PUBLICATIONS: The contractor shall perform the work in accordance with applicable federal, state, and local requirements, recognized industry standards, product labels, and the contract documents. The most stringent applicable requirement shall govern.

· 29 CFR 1910.134, Respiratory Protection (OSHA)

· 29 CFR 1910.1200, Hazard Communication (OSHA)

IV. ROLES and RESPONSIBILITIES:

Contractor:

The contractor shall execute the remediation, maintain required work-area isolation and air scrubbing, protect critical equipment, perform cleaning and priming, maintain daily records, and immediately report any changed or unsafe conditions.

Contract Officer Representative (COR):

The COR shall coordinate access, work hours, VA escorts, equipment restrictions, electrical and HVAC support, review of products, and authorization to proceed between project phases.

Independent Environmental Consultant:

A qualified environmental consultant shall establish sampling locations, collect or oversee pre-test and post-remediation air samples, conduct the final visual inspection, interpret results, and issue written clearance. The consultant shall be independent of the remediation contractor and be retained directly by VANJHCS

V. CONTRACT COVERAGE and SPECIFICATIONS: The following steps must be taken during the project, including, but not limited to:

Pre-work requirements:

All bidders shall attend a mandatory pre-bid walkthrough and field-verify dimensions, access, power/water availability, waste route, security requirements, work-hour restrictions, and affected limits. Pricing shall include all labor, equipment, consumables, PPE, engineering controls, decontamination, and documentation necessary to complete the scope unless specifically excluded in writing.

The successful bidder shall:

· Identify critical equipment, surfaces that may be wet-cleaned, surfaces requiring dry-only cleaning, and areas that may not be accessed.

· Confirm how required room cooling will be maintained during work. Protective measures shall not obstruct equipment cooling or discharge disturbed particulate into occupied areas.

· Submit the localized work-area isolation layout, portable HEPA air-scrubber specifications, proposed cleaning agents, proposed primer, SDS, equipment protection plan, respiratory-protection documentation, and emergency procedures for review.

Work-area isolation and engineering controls:

The contractor shall perform the following activities prior to the start of any removal operations:

· The contractor shall coordinate with VANJHCS to have any centralized HVAC systems servicing the Telecom Room shut down or blocked off until final post-remediation sampling results are deemed satisfactory. Cooling necessary for operation of the Telecom Room, including the Liebert units or other approved cooling systems, shall remain operational throughout the project.

· All vents/openings in the work area shall be sealed off with two layers of 6-mil polyethylene (poly) sheeting to prevent the spread of mold spores.

· To isolate the work area, the contractor shall install two layers of 6-mil poly sheeting over each door/entrance to the Telecom Room. The outer facing layer shall be comprised of one layer of 6-mil poly with a zipper for access (i.e. ZipWall® system). The inner facing layer shall be a one layer 6-mil poly flap, weighted at the bottom. The contractor shall also affix a “No Entrance” sign on the outer facing poly layer at each entrance.

· The contractor shall maintain all poly isolation barriers in good condition throughout the project. Polyethylene sheeting shall remain in place until satisfactory final post-remediation sample results are achieved, and the environmental consultant authorizes teardown of the sheeting.

· The contractor shall install a sufficient number of air scrubbers equipped with high efficiency particulate air (HEPA) filters in the Telecom Room to achieve a minimum of (1) full air rotation (recirculate) every (15) minutes; a minimum of four (4) air scrubbers shall be utilized. The contractor shall provide the rated capacity in cubic feet per minute (CFM) of each air scrubber utilized on this project to the VANJHCS prior to their installation.

· Air scrubbers shall run continuously, 24 hours per day, 7 days per week, until satisfactory post-remediation sampling results are achieved.

· All air scrubbers shall be cleaned prior to use and shall be maintained in proper working order for the duration of the project.

Equipment protection and cleaning:

Equipment, cable trays, conduits, and similar components are not designated mold-remediation surfaces, however, the contractor shall HEPA vacuum these items with suitable non-damaging attachments. Before commencing work, the contractor and VANJHCS shall identify equipment requiring specific protection and/or equipment that should not be vacuumed. Equipment cleaning shall be limited to readily accessible exterior surfaces and shall not require removal of covers or access panels.

· Do not direct liquid, mist, or compressed air into equipment, electrical panels, switches, ports, fans, vents, or cable terminations.

· Electronics and energized electrical equipment shall be cleaned only by qualified personnel using methods approved by VANJHCS and the equipment manufacturer.

· Use antistatic and electrical-safety precautions appropriate to the equipment.

· Protect equipment from impact, water, primer overspray, dust, and dislodged debris throughout the work.

· Do not cover any equipment, components, etc. in a manner that restricts cooling or creates a potential overheating hazard.

Non-destructive remediation procedure:

· Initial HEPA vacuuming: HEPA-vacuum the visibly affected wall surfaces and immediately adjacent work area methodically from higher to lower elevations. Avoid aggressive contact that could damage coatings, equipment, cabling, or finishes.

· Wet wiping: Clean the affected wall surfaces with disposable lint-free wipes lightly dampened with water and an approved fungicidal cleaning product. Work in manageable sections. Turn or replace wipes frequently so contamination is removed rather than redistributed.

· Detail cleaning: Clean the visibly affected wall surfaces and a reasonable margin of immediately adjacent wall surface as needed to ensure complete removal. HEPA-vacuum nearby surfaces where remediation dust has settled. Unaffected ceilings, equipment, cabling, conduits, and other room surfaces are not targeted mold-remediation surfaces and do not need to be wet-cleaned.

· Drying: Allow the cleaned surfaces to dry completely. Maintain environmental conditions that prevent condensation and support drying. The contractor may need to install dehumidifier units to achieve these conditions.

· Second HEPA vacuuming: After surfaces are dry, HEPA-vacuum the work area again from higher to lower elevations, including horizontal ledges and the floor.

· Cleaning inspection: The contractor shall inspect the work and repeat cleaning where visible mold, dust, residue, staining attributable to removable surface contamination, or mold-related odor remains. If mold staining remains after the surface has been physically cleaned, the contractor shall ask the environmental consultant to determine whether the condition represents residual surface contamination or permanent discoloration. The presence of staining shall not authorize demolition.

Final cleaning and inspection:

After the primer has dried/cured for the manufacturer-specified time period, the contractor shall remove any protective sheeting and carefully perform final cleaning with HEPA vacuuming of nearby surfaces, and damp wiping where appropriate.

The contractor shall request a final visual inspection of the work area when final cleaning activities are complete. The contractor shall coordinate the timing of the final visual inspection with the environmental consultant and provide at least 24-hour notice of the need for the final inspection. The independent environmental consultant shall then inspect the affected and immediately adjacent areas.

The work area must satisfy all of the following before post-remediation sampling:

· No visible mold growth.

· No visible dust, debris, cleaning residue, or primer splatter/overspray.

· No mold-related odor.

· Surfaces dry with no active water intrusion or condensation.

If during the final inspection any visible dust, debris or suspect microbiological contamination is observed, a thorough re-cleaning of the work area shall be performed by the contractor at no additional cost to the VANJHCS. The contractor shall re-clean as many times as to achieve a satisfactory final visual inspection. The work area shall be deemed acceptable solely at the discretion of the independent environmental consultant.

Air Sampling:

Sampling method:

Air samples shall be collected by the environmental consultant using bio-aerosol spore trap sampling cassettes (i.e. Air-O-Cell®) or an equivalent non-culturable airborne spore-trap method. Samples shall be collected using a calibrated pump at the flow rate and duration specified by the cassette manufacturer and the environmental consultant. A typical sample may be collected at 15 liters per minute for five minutes, but sample duration may be adjusted to avoid particle overloading or to address site conditions. The analytical laboratory shall participate in an appropriate fungal microscopy proficiency program, such as AIHA Environmental Microbiology Proficiency Analytical Testing.

Pre-remediation pre-test Sampling:

The independent environmental consultant shall, at a minimum:

· Collect three air samples representing “inside the work area” in the Telecom Room before remediation begins, and at least one air sample from an indoor location “outside the work area” such as the first floor hallway.

· Collect at least one contemporaneous outdoor control sample.

· Record sample location, flow rate, duration, total volume, temperature, relative humidity, weather conditions, room operating conditions, and visible activities.

· Use the pre-test results to establish the indoor baseline and identify fungal types and concentrations.

Post-remediation Clearance Sampling:

Post-remediation sampling will be conducted by the independent environmental consultant.

· Samples will be collected only after the mold-inhibiting primer has dried/cured sufficiently, and the work area passes visual inspection.

· HEPA equipped air scrubbers shall run for a minimum of 24 hours after the satisfactory visual final inspection prior to collection of clearance samples.

· At the environmental consultant's direction, air scrubbers may be shut down before and during sampling, so the samples represent settled post-cleaning conditions.

· Samples will be collected indoors: inside the work area (IWA) and outside the work area (OWA), and outdoors. A minimum of three IWA samples will be collected. At least one contemporaneous outdoor control sample will be collected.

· The same cassette type, laboratory method, and sampling volume used for pre-test sampling will be utilized for post-remediation sampling, unless a documented technical reason requires an adjustment.

Clearance criteria and response to failure:

There are no state or federal numerical “pass/fail” clearance standards for mold remediation work. Post-remediation air sample results shall be interpreted by the independent environmental consultant using outdoor/background comparison, fungal ecology, visible conditions, and project-specific criteria. Clearance shall be solely at the discretion of the environmental consultant based on their professional evaluation of the complete data set.

At minimum, the post-remediation sampling results shall demonstrate:

· No evidence of indoor fungal amplification based on the types and relative concentrations of spores in the post-remediation indoor samples as compared to the pre-test results.

· Indoor fungal ecology shall be generally consistent with the outdoor control sample and shall not indicate amplification of water-damage-associated fungi.

· Indoor fungal types and concentrations are generally similar to or lower than the contemporaneous outdoor control, accounting for normal environmental variability and professional interpretation.

· No compromised samples due to overloading, inadequate volume, pump malfunction, or other quality-control deficiency.

· The IWA post-remediation final air clearance samples will be deemed acceptable if there is an attenuation in the total airborne spore counts and/or an attenuation in concentrations of particular genera of spores as compared to the pre-test sample results; or, as compared to the OWA and Outdoor samples collected at the same time the IWA samples were collected; or, as determined by the environmental consultant based on site specific conditions.

If the work area does not meet the clearance criteria, the contractor shall maintain required work-area isolation, repeat HEPA vacuuming and cleaning in the affected areas, correct identified deficiencies, and allow surfaces to dry. Additional post-remediation air sampling shall then be performed at the contractor's expense unless the failure is attributable to an unrelated condition outside the contractor's control.

The contractor shall re-clean the work area, at no additional cost to the VANJHCS, in the event post-remediation final air clearance samples are deemed unsatisfactory. The contractor shall re-clean as many times as necessary, at no additional cost to the VANJHCS, to achieve satisfactory final clearance.

Changed or concealed conditions:

If the contractor encounters concealed mold, active leakage, structurally deteriorated material, suspect regulated material, unsafe electrical conditions, or contamination that cannot be addressed by the authorized non-destructive methods, the contractor shall stop the affected work, maintain required work-area isolation, and notify the COR. The contractor shall not demolish, open, remove, or disturb the material unless the Contracting Officer issues separate written authorization.

Schedule and operational coordination:

Work shall be scheduled with the COR to minimize disruption to VA operations. The contractor shall submit a detailed schedule showing mobilization, baseline review, work-area isolation, cleaning, drying, priming, curing, final cleaning, inspection, post-sampling, laboratory turnaround, clearance, and demobilization. Critical telecommunications, power, and cooling shall remain operational throughout the project, except during specifically approved outages.

Completion and barrier removal:

Isolation barriers (i.e. poly sheeting) shall not be removed until the independent environmental consultant issues written clearance and authorizes their removal. Following authorization, barriers shall be dismantled carefully to prevent release of any accumulated dust. The load-out route shall be inspected and HEPA-vacuumed as necessary.

Basis of acceptance:

The work will be accepted when all authorized surfaces have been cleaned without destructive remediation; designated surfaces have received an approved mold-inhibiting primer; visual and airborne spore-trap clearance criteria have been satisfied; containment has been removed without contaminating adjacent areas; required documentation has been submitted; and the COR has accepted the completed work.

VI. DISPOSAL AND SANITATION REQUIREMENTS:

· Place used wipes, disposable PPE, filters, polyethylene, and cleaning debris in sealed bags or containers before removal from the work area.

· Clean the exterior of bags and containers before load-out. Use a clean second bag when necessary.

· Manage ordinary mold-remediation debris as construction or general waste unless waste characterization identifies another regulated component.

· Do not clean or decontaminate waste containers in a manner that releases contaminated water or debris on VA property.

· Comply with applicable federal, state, county, local, and VA waste requirements.

VII. SAFETY REQUIREMENTS: The contractor shall perform a task-specific hazard assessment and provide PPE appropriate to mold, cleaning chemicals, electrical hazards, and site conditions. At minimum, workers performing cleaning within the work area shall use disposable protective clothing, gloves, eye protection, and NIOSH-approved respiratory protection. At a minimum, half-face respirators equipped with P100 filters shall be used. Combination organic-vapor cartridges shall be used only when required by specific product SDS. Respirator use shall comply with 29 CFR 1910.134, including medical evaluation, training, fit testing, inspection, and cartridge/filter change requirements. The Contracting Officer/designee will notify the Contractor of any noncompliance with the foregoing provisions and advise the contractor of the action to be taken. After receipt of such notice, the Contractor shall immediately initiate corrective action. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue a stop- work order for all or any part of the work and hold the Contractor in default as provided elsewhere in this contract.

SECTION C - CONTRACT CLAUSES

C.1 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (OCT 2025) (DEVIATION)

(a) Definitions. The clause at Federal Acquisition Regulation (FAR) 52.202-1, Definitions, is incorporated by reference.

(b) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post acceptance rights—

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(c) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(d) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(e) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause FAR 52.233-1, Disputes, which is incorporated in this contract by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence. Examples of occurrences include acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. When an excusable delay occurs, the Contractor shall—

(1) Notify the Contracting Officer in writing as soon as possible;

(2) Remedy the delay as quickly as possible; and

(3) Notify the Contracting Officer when the occurrence is over.

(g) Invoice. The Government will handle invoices according to the Prompt Payment Act (31 U.S.C. 3903) and 5 CFR part 1315. The Contractor shall submit invoices to the address designated in the contract to receive invoices. An invoice must include the information required by 5 CFR part 1315.9(b).

(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees, and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark, or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(i) Payment—

(1) Items accepted. Payment shall be made for items accepted by the Government that have been delivered to the delivery destinations set forth in this contract.

(2) Prompt payment. The Government will make payment in accordance with the Prompt Payment Act (31 U.S.C. 3903) and prompt payment regulations at 5 CFR part 1315.

(3) Discount. In connection with any discount offered for early payment, time shall be computed from the date of the invoice. For the purpose of computing the discount earned, payment shall be considered to have been made on the date that appears on the payment check or the specified payment date if an electronic funds transfer payment is made.

(4) Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall—

(i) Remit the overpayment amount to the payment office cited in the contract along with a description of the overpayment including the—

(A) Circumstances of the overpayment (e.g., duplicate payment, erroneous payment, liquidation errors, date(s) of overpayment);

(B) Affected contract number and delivery order number, if applicable;

(C) Affected line item or subline item, if applicable;

(D) Contractor point of contact; and

(ii) Provide a copy of the remittance and supporting documentation to the Contracting Officer.

(5) Interest.

(i) All amounts that become payable by the Contractor to the Government under this contract shall bear simple interest from the date due until paid unless paid within 30 days of becoming due. The interest rate shall be the interest rate established by the Secretary of the Treasury as provided in 41 U.S.C. 7109, which is applicable to the period in which the amount becomes due, as provided in (i)(6)(v) of this clause, and then at the rate applicable for each six-month period as fixed by the Secretary until the amount is paid.

(ii) The Government may issue a demand for payment to the Contractor upon finding a debt is due under the contract.

(A) The Contracting Officer and the Contractor are unable to reach agreement on the existence or amount of a debt within 30 days;

(B) The Contractor fails to liquidate a debt previously demanded by the Contracting Officer within the timeline specified in the demand for payment unless the amounts were not repaid because the Contractor has requested an installment payment agreement; or

(C) The Contractor requests a deferment of collection on a debt previously demanded by the Contracting Officer (see FAR part 32).

(iv) If a demand for payment was previously issued for the debt, the demand for payment included in the final decision shall identify the same due date as the original demand for payment.

(v) Amounts shall be due at the earliest of the following dates:

(A) The date fixed under this contract.

(B) The date of the first written demand for payment, including any demand for payment resulting from a termination for cause.

(vi) The interest charge shall be computed for the actual number of calendar days involved beginning on the due date and ending on-

(A) The date on which the designated office receives payment from the Contractor;

(B) The date of issuance of a Government check to the Contractor from which an amount otherwise payable has been withheld as a credit against the contract debt; or

(C) The date on which an amount withheld and applied to the contract debt would otherwise have become payable to the Contractor.

(vii) The interest charge made under this clause may be reduced under the procedures for interest credits prescribed in FAR part 32 in effect on the date of this contract.

(j) Risk of loss. Unless the contract specifically provides otherwise, risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until, and shall pass to the Government upon—

(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or

(2) Delivery of the supplies to the Government at the destination specified in the contract, if transportation is f.o.b. destination.

(k) Taxes. The contract price includes all applicable Federal, State, and local taxes and duties.

(l) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.

(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. The Government will send a cure notice to the Contractor, unless the reason for the termination is late delivery. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.

(o) Warranty. The Contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.

(p) Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.

(q) Compliance with laws unique to Government contracts. The Contractor agrees to comply with 31 U.S.C. 1352 relating to limitations on the use of appropriated funds to influence certain Federal contracts; 40 U.S.C. chapter 37, Contract Work Hours and Safety Standards; 41 U.S.C. chapter 87, Kickbacks; 49 U.S.C. 40118, Government-financed air transportation; and 41 U.S.C. chapter 21 relating to procurement integrity.
